RESOLUTION NO. 93-543
RESOLUTION BY THE BOARD OF COUNTY COMMISSIONERS
OF COLLIER COUNTY, FLORIDA, CONFIRMING ACTION
AUTHORIZING THE EXCHANGE OF THE PROPERTY IN THE
FAKAHATCHEE ST~tD STATE PRESERVE FOR THE MARCO
ISLAND AIRPORT PURSUANT TO HOUSE BILL 1851 PASSED
BY THE FLORIDA LEGISLATURE ON MAY 15, 1993, AND
REQUESTING ASSISTANCE OF THE COLLIER COUNTY
LEGISLATIVE DELEGATION IN GAINING FINAL APPROVAL
OF THE CABINET AND GOVERNOR.
WHEREAS, the Florida LegiSlature passed House Bill 1851 on
May 15, 1993, as shown on Attachment 1, which provides for the
transfer of property between the State and Collier County by
December 31, 1993; and
WHEREAS, on November 23, 1993, the Board of County
Commissioners approved Resolution No. 93-542, Attachment 2,
thereby closing Janes Scenic Drive, and approved the execution of
documents and ""ul timate transfer of real properties as set forth
in House Bill 1851; and
WHEREAS, the Board of County Commissioners requested
notification and assistance of the Collier County LegiSlative
Delegation for the purposes of assisting the County in the land
transfer as set forth in House Bill 1851.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA that:
1. The Board of County Commissioners, by copy of this Reso-
lution, transmits the above-referenced attachments to the
County's
Legislative
Delegation
for
the
purpose
of
documenting the action step taken in meeting the requirements
of House Bill 1851;
2. The Board of County Commissioners, in transmitting the above-
referenced information, requests the "assistance of Collier
County's
Legislative Delegation
for the purposes of
supporting and assisting in the processing for approval by
the Cabinet and the Governor, the transfer of property as set
forth in House Bill 1851;
3. The Board of County Commissioners hereby directs the Collier
County Transportation Services staff to assist the County's
Legislative Delegation to the degree necessary in processing

Be It Enacted by the Lerislature of the State of Florida:
Section 1. . (i) By December 31, 1993. the Board oC Truatees of the Internal
Improvement Trust Fund shall convey to Collier County 66.39 acres otland known
as the Marco Island Airport and which is described as tollows: That certaiD land

Section 3. This act shall take e!fect upon becoming a law.

RESOLUTION BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER
COUNTY, FLORIDA APPROVING AND AUTHORIZING THE EXCHANGE OF
THE PROPERTY IN THE FAKAHATCHEE STRANO STATE PRESERVE FOR
THE MARCO ISLAND AIRPORT PURSUANT TO HOUSE BILL 1851 PASSED
BY THE FLORIDA LEGISLATURE ON MAY 15, 1993.
WHEREAS, the Florida Legislature passed House Bill 1851 on May 15, 1993, as
shown on the attached Exhibit "A", which requires the Board of Trustees of the
Internal Improvement Trust Fund to convey to Coll ier County the Marco Island
Airport by December 31, 1993;
WHEREAS, the deed of conveyance shall conta in 1 anguage that the t i tl e to
the Marco Island Airport shall revert to the Board of Trustees of the Internal
Improvement Trust Fund if it ceases to be used as an airport;
WHEREAS, in exchange for the above property, by December 31, 1993, Collier
County shall conv!y to the Board of Trustees of the Internal Improvement Trust

Fund of the State of Florida One Thousand Nine Hundred Twenty (1,920) acres of
land within the Fakahatchee Strand State Preserve, more particularly described
as Sections 15, 21 and 22, all in Township 51 South, Range 29 East, Collier
County. Florida;
WHEREAS, by December 31, 1993. Collier County shall close to general public
traffic that part of Janes Scenic Drive lying within the Fakahatchee Strand
State Preserve, as shown on the attached Exhibit "B"; and
WHEREAS, Coll ier County desires to acquire the Marco Island Airport in
exchange for the property located within the Fakahatchee Strand State Preserve
and close Janes Scenic Drive pursuant to House Bill 1851 passed by the Florida
Legislature on May 15. 1993.
NOW. THEREFORE. BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY. FLORIDA that:
1. The Board of County Commissioners approves and authorizes the
conveyance of One Thousand Ni ne Hundred Twenty (1,920) acres (more or 1 ess) of
land in the Fakahatchee Strand State Preserve by December 31, 1993. more
particularly described as Sections IS, 21 and 22. all in Township 51 South,
Range 29 East, Collier County, Florida, to the Board of Trustees of the Internal
Improvement Trust Fund of the State of Florida;
2. The Board of County Corrvni ss i oners approves and authori zes the
acceptance of the deed conveying the Marco Island Airport to Collier County with

the stipulation that the Marco Island Airport shall revert to the Board of
Trustees of the Internal Improvement Trust Fund of the State of Florid~ if the
property ceases to be used as an airport; and
3. The Board of County Commissioners approves and authorizes County staff
to close to general public traffic that part of Janes Scenic Drive ]ying within
the Fakahatchee Strand State Preserve by December 31, 1993 by posting signs that
state -Road Closed To General Public Traffic" and "Open To Local Traffic Only".
4. The Board of County Commissioners authorizes County staff to follow
proper real estate closing procedures and record all relevant documents in the
Public Records of Collier County, Florida.

COLLIER COUNTY, a political cubdivision; the State of Florida, whose
post office address is 3301 Tamiami Trai East, Naples, Florida 33962,
hereinafter called the "Grantor" to the BOARD OP TRUSTEES OP THE
INTERNAL IMPROVEMENT TROST POND OP THE STATE OP PLORIDA, whose address
is 3900 Commonwealth Boulevard, Room 438, Tallahassee, Florida 32399,
hereinafter called the "Grantee".'
(Whenever used herein the terms "Grantor" and "Grantee" include
all the parties to this instrument and their respective heirs, legal
representatives successors and assigns.)
WITNESSETH that the Grantor, for and in consideration of the sum
of Ten DOllars, ($10.00) to it in hand paid by the Grantee, receipt
whereof is hereby aCknowledged, has granted, bargained and sold to the
Grantee, the following described land lying and being in Collier
County, Florida:
