DEVELOPHENT STANDARDS FOR PORTABLE ASPHALTIC CONCRETE
BATCH FLANTS; AND BY PROVIDING A~ £FFECTIVE DATE.
Portable Asphaltic Concrete batch plants are presently
permitted tn the Industrial ionia8 District and provisionally per~ttted
in the Light Industrial Zoning District; and
V~ERF. AS, RequirtnI the said use to be z~ned for only industrial
purposes ~ay not be in the long cern interests of the County and may
result in the potent/a! for incompatibilities between land uses; and
Currently, there ts no provision for provisional uses for
the said use in the A-2 District; and

and excavation which ia only per~itted in the Agriculture Districts as
Provisional Uses.

Collier Couuty, Florida:
Collier County Ordinance 82-2, Section 7.9, A-2, Rural A~rtculture,
Subsection 7.9.b,3), Permitted Provisional Uses and Structures, shall be
amended as follovsl

Subsection 7.9 c., Development Standards, shall ba amended by adding a

Standards for Portal1· Asphaltic Concrete Batch Plants:
The intsnt of this provisional uss is to provide the
opporttrnitT to install · Portable Asphaltic Concrete Batch Plant
at an approved earth sinin~ site. The installation of said plant
at an earth minin~ site could reduce associated trucking by
loc·tins a manufacturin~ plant adjacent to the sources of raw
material. Vtilizin~ an approved earth sinin~ provisional use
sits for said,.plant naT, at certain locations.be aqua1 in
intensiCT co th· current uae and. therefore, 2a~ hOC have an
advsrse imp·cc on the surroundins area. Prior to lrantin~
spproval of the provisional use, the follovin~ standards, st a
sinimum~ shall be met:
(a) An approved provisional use permit for earth minin~ rich
a minimum size of 80 acres.

(d) There shall be a height limitation of sixt~ (60) feec for

Section lO.~ of the ZoninS Ordinance shall be submitted
ac the time of application for Provisional Use.
(f) Li~itations mat be placed on the hours of operation co

conditions varrant.
(6) The provisional use parcel for a Portable Asphaltic
Concrete Batch Plant shall have a minimus setback of five
hundred (500) feet fro· the boundar~ line of the earth
mtnin~ provisional use site.

.(h) Any such provisto~al uss ~rantsd hereunder shall ex~tre
five (5) 7ears after the effective date of a?proval of the
provisional 'use or upon expiration of the excavation pez~ic or
any other required petals whichever occurs first. The
provisional use ~ be renewed foll~in~ the same procedure as
~tlined in Section 13.1. of the Zoninl Ordinance 82-2. ~e
fee requirements ~11 be waived for this re-application.
(i) All petrole~ related products shall be stored able
~nd and located in a diked imperious cell to
safe.etd nlainst vertical and horizontal ~r~nd
cont~inati~.
(~) ~e s~rce of the ~ority of the ray ~aterials used in
the batch plant shall be the excavation site at ~hich
the plant is located as it is the intent of this
pr~isionnl use that the plant function as an accesso~
use :o un-site excretion.
SECTION THREE:
This Ordinance shal! become effective upon notice that it has been
receiv~ by the Office of the Secretary of State.
