AND GOODLETTE-FRANK ROAD SOUTH OF PINE RIDGE -,ROAD, BY PROVIDING AN INTENT AND PURPOSE, · DEVELOPMENT STANDARDS RELATING TO BUILDING .~]SETBACKS, BUILDING HEIGHTS, LA2;DSCAPING, · '.~ACCESS AND SIGNAGE; BY A/4ENDING THE OFFICIAL · !'JlZONING ATLAS MAPS ;~UMBER 49-25-5, 49-25-7, ~49-25-8 AND 49-26-4; BY SHOWING THE BOUNDARY OF THE CORRIDOR MANAGEMENT OVERLAY DISTRICT; BY PROVIDII;G FOR CONFLICT AND SEVERABILITY; AND BY PROVIDING AN EFFECTIVE DATE. W/4EREAS, Chapter 125, Florida Statutes, establishes the right and power of counties to provide for the health, welfare and safety of existing and future rosidents by enacting and enforcing zoning and business regulations necessary for the protection of the public; and WHEREAS, Chapter 163, Part II, (Local Government Comprehensive Planning and Land Development Regulation Act), Florida Statutes, provides that counties shall have the power and responsibility to plan comprehensively for their future development and growth including the adoption and implementation of appropriate land development .regulations which are necessary or desirable to implement a comprehensive plan, including the regulation of land uses and zoning as provided in Section 163.3202, Florida Statutes; and WHEREAS, the Future Land Use Element of the Growth Management Plan requires that certain Land Development Regulations be adopted to implement the Plan; and WHEREAS, Policy 4.2 of tho Future Land Use Element of the Growth Management Plan requires that a Corridor Management Plan be prepared in conjunction with the City of Naples for Goodlette-Frank Road and Golden Gate Parkway from U.S. 41 to Santa Barbara Boulevard; and WHEREAS, the Corridor Management Plan was presented to the Board of County Commissioners and the Naples City Council in a Joint workshop on February 8, 1989; and ! Words underlined are additions; words e~k-~h=~gh ars deletions. 323 ~{EREAS, the Board o£ County Commissioners directed to draft Land DQvelopment Regulations consistent with the City of Naples to implement the Corridor Management Plan; WHEREAS, the Collier County Planning Commission (Local Planning Agency) has determined that this proposed zoning ordinance is consistent with the adopted Growth Management Plan as required by Section 163.3194(2)(a), Florida Statutes~ and NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FIX)RIDA: Corridor Management Overlay District Ordinance No. 82-2, the Zoning Ordinance of Collier County, Florida is hereby amended by adding Section 9.14 thereto as follows: 9.I4 - Corridor ManaGement Overlay District - Special Regulations For Propgrties Abuttinq Golden Gate Par}~F_~y_~w-st of Santa Barbara Boulevard and fzg.9~kg_~_9~r~Q~_~l_p.f_P~ ne Ridge Road: Intent and Purpose: The purpose of this overlay district is to supmlement existin~ zoninq re~ulat]ons for properties bordering Go~de~ Gate ~rk~_a~ west of ~D_O_~arbara Boulevard and Good]ett¢-yrank Road south of Pine Ridge Road. The over]aV district will [;tQve]oped is the CorrJdor ld0naG~ent Study for Good]erie-Frank Road and Qo~deD Gate Parkway. Thgse requIations recognize that ~o separate Jur]sd~ct]on~ ~overn l~Dd uses in ~corridors a~d aro~estgnod to ~volDp greater consistency in destan standards between Collier County and the City of Naples. Trees must be placed every thirty (30) feet. in landscaped areas, Palm trees may not be substitute~ for canopy trees. Landscape designs shall incorporate the use of xeriscap~ Plant materials species as lis~e~ ~n the XeriscaDe Plant Guide published by the South Florida Water Management District. If any phrase or portion of the Ordinance is held invalid or unconstitutional by any court of competent Jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion. ~ Effective Date This ordinance shall become effective upon receipt of notice from the Secretary of State that this ordinance has been filed with the Secretary of State.
