AN ORDINANCE CREATING THE CHOKOLOSKEE ISLAND MUNICIPAL SERVICE
TAXING UNIT AND DESCRIBING THE LANDS TO BE INCLUDED IN THE UNIT AS
GENERALLY ALL THOSE LANDS ON CHOKOLOSKEE ISLAND; PROVIDING THE
UNIT PURPOSE AND INTENT; PROVIDING FOR A GOVERNING BO;tRD WITH
POWER AND AUTHORITY TO CONDUCT THE AFFAIRS OF THE UNIT; PROVIDING
FOR CONSTRUCTION AND SEVERABILITY; PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:

There is hereby created the Chokoloskee Island
Se~ice Taxing Unit. The Unit shall include all lands wit~i~ ~e
following boundaries:
All those lands described as;
~e Southeast one. ~a~er (SE 1/4) of the Southeast one
~arter (SE 1/4), of Section 25, and the East one half (E 1/2) of
Section 36 all in To,ship 53 South, Range 29 East, together with
The Southwest one quarter (SW 1/4) of the Southwest one
~a~er (SW 1/4) of Section 30, and the West one half (W 1/2) of
Section 31 all In Township 53 South, Range 30 East, said lands as
described above being othe~ise known as Chokoloskee Island,
Collier County, Florida.
~: ~POSE ~D INTENT.
~e Unit hereby created is for the pu~ose of exercising
those powers authorized by Chapter 125, Florida Statutes, and
other applicable law. It ~s the ~ntent to utilize all revenues
generated by the Unit to defray all feasibility costs incurred
they may relate to the petitioned Chokoloskee Island Waterline
Improvements. Final design and const~ction costs will be
financed under provisions contained in Ordinance No. 88-23.
~E~ION T~EE: GOVE~ING BO~D.
The Board of County Co~issioners of Collier County shall be
the governing board of the Unit, with power and authority to
conduct th~ affairs of th~ ~ntt a~ prescribed by Florida~_ ~fit

~: CONSTRUCTION AND SEVERABILITY.
A. This Ordinance shall be liberally construed to
effectuate its public purpose.
B. It is declared to be the intent of the Board of County
Commissioners that if any section, subsection, sentence, clause,
phrase or provision of this Ordinance is held invalid or
unconstitutional by any court of competent Jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such invalidation or unconstitutionality shall not
be so construed as to render invalid or unconstitutional the
remaining provisions of this Ordinance.
~J~_~: EFFECTIVE DATE.
This ordinance shall become effective upon receipt of notice
from the Secretary of State that this Ordinance has been filed
with the Secretary of State.
