RESOLUTION APPROVING WITH CONDITIONS
PETITION CCSL-94-8: REQUESTING A VARIANCE
FROM THE COASTAL CONSTRUCTION SETBACK
LINE TO ALLOW CONSTRUCTION OF A WOODEN
HANDICAPPED RAMP FOR BEACH ACCESS BETWEEN
LOTS 20 AND 21, BLOCK A, UNIT 1 OF
CONNORS VANDERBILT BEACH ESTATES, IN
SECTION 29, TOWNSHIP 48 SOUTH, RANGE 25
EAST, COLLIER COUNTY, FLORIDA.
WHEREAS, Mr. Jerry Neal, Office of Capital Projects Management,
representing Collier County Board of County Commissioners requests a
variance from the Coastal Construction Setback Line (~CSL) as
required by Collier County Ordinance No. 91-102 Division 3.13, as
amended, to allow the construction of a wooden handicapped ramp for
beach access between Lots 20 and 21, Block A, Unit 1, Connors
Vanderbilt Beach Estates; and
WHEREAS, the subject property is located at 9700 GUlfshore
Drive adjacent to LaScala Condominium; and
WHEREAS, the proposed structures will extend approximately one
hundred thirty-five feet (135') seaward of the adopted CCSL; and
WHEREAS, a dune walkover or wooden ramp is a minor structure as
defined by Subsection 161.54(6)(B), Florida Statutes, and is
consistent with the Coastal Zone Protection Act of 19B5; and
WHEREAS, the proposed ramp will allow beach access for
handicapped persons along Vanderbilt Beach; and
WHEREAS, the petition is consistent with the Collier County
Land Development Code Division 3.13, as amended; and
WHEREAS, the petition is consistent with the Collier County
Growth Management Plan
Conservation and Coastal Management
Element.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: Variance Petition
CCSL-94-B be approved subject to the following conditions:
1.
The Wooden ramp, shall be designed in accordance with the
standards of the Florida Department of Environmental Protection
(FDEP) - Division of Beaches and Shores, and an approved permit
shall be obtained prior to issuance of a Collier County building
permit.
2.
Construction activities shall not occur within one hundred (100)
feet of the sea turtle nesting zone, defined by Collier County
Land Development Code Division 3.10, between May 1 - October 31,
sea turtle nesting season, without first submitting and
obtaining FDEP and Collier County Construction in Sea Turtle
Nesting Area Permits.

3. If it is necessary for vehicles to be on the beach during
construction, a Collier County Vehicle on the Beach permit shall
be required, subject to review and approval by the Collier
County Current Planning Environmental Staff prior to any
construction activity. Vehicle on the Beach Permits will not be
issued during sea turtle nesting season unless in accordance
with Collier County Land Development Code Section 3.14.6.

6. Outdoor lighting associated with construction, or development
within three hundred (300) feet of the high tide line, shall be
in compliance with Division 3.10 of Collier County Land
Development Code.
7. Petitioner shall re-vegetate the dune where the dune is devoid
of coastal dune vegetation (appropriate to that specific area
i.e. fore-dune or back dune)~ The re-vegetation shall be
completed, according to a plan submitted to and approved by
Collier County Current Planning Environmental Staff, prior to
the issuance of a Certificate of Occupancy.
8. Prior to issuance of a building permit the petitioner shall
submit a stabilization plan to Collier County Current Planning
Environmental Staff for review and approval. This plan shall
address in detail how any previously stabilized ground which is
disturbed by this construction will again be stabilized to
guarantee against any future erosion.
9. The petitioner shall construct a wooden boardwalk from the
street over exposed tree roots, to the ramp so as not to cause
damage to the trees and to provide safe access over the ground.
10. Minor revisions to Coastal Construction Setback Line Variance
CCSL-94-B (including changes in siting and structures) may be
approved, in writing, by the site Development Review Director or
hiS/her designee.

favoring same.
