The "National Electrical Code, 1987 Edition," as published by the
National Fire Protection Association, and as amended herein, is adopted
by taference ns the "Collier County Electrical Code".

ARTICLE 80 - ADMINISTRATION

ARTICLE 80 - ADtIINISTP. ATION
A. - TITLE AND SCOPE
80-1 - TITLE
The provisions embraced within the followin$
chapters and sections shall constitute sad be known
and may be cited a~ "The National Electrical Code,"
hereafter referred to ao "thie code."
80-2 - CODE REMEDIAL
This code is hereby declared to be remedial, and
~hnll be construed tn secure tha beneficial tn~eres~
purposes thereof, which are public safety, health,
and general welfare, by regulating installation and
maintenance of all electrical equtpmen~ and systems.
80-3 - SCOPE
The provisions of this code shall apply to 'the
installation of electrical systems, including
alterations, repairs, replacement, equipment,
appliances, fixtures and fittings.
80-6- ~INTENANCE
All electrical systems, both existing a~d new,
crd nil parts thereof, shall be maintained in a safe
condition. All devices or safeguards which are
required by this code shall be maintained in good
working order. The maintenance of electrical systems
shall be the responsibility of tbs owaar or his
destgnatsd agent.
ORGANIZATION
80-5 - ELECTRICAL OFFICIAL
There is hereby ast~blishsd a dspartmsnt to bs
called the Electrical Department and the parson in
charge shall be knovn as the Electrical Official.
80-6 - INSPECTORS
Tbs Electrical Official nay appoint such'nmnbsr
employees as shall be authorized from time to time.
C. - POWERS AND DUTIES OF ELECTRICAL OFFICIAL
80-7 - RIGHT OF EI~TRY
The Electrical Official shall enforce tha
provisions of this code and he or his duly authorisad
representative may enter any building, attmcture' or
premises to perform any duty imposed upon him bi this
code,
80-8 - STOP ~ORX ORDERS
Upon notice from the Electrical Official that
work on any electrical installation is being dona
contrary to the provisions of this code or in a
dangerous or unsafe manner, such ~;ork shall be
i~nedi~tely stopped. Such notice shall be in v rising
end shall be given to the o~ner of such property, or
to his agent, or the person doing the vork, ~nd shall
state the ccnditions under which work may be resumed.
~ere any emergency exists, oral notice given by the
Electrical Official shall be sufficient.
80-9 - REVOCATION ~F PER}!ITS

such standards, the Electrical Official shall specify
the test procedure.

approval vas based.
80-13 - LIABILITY
Any officer or employee, or member of any Board,
char~ed with the enforcement of this code, acting for
the local governing body in the discharge of his
duties, shall not thereby render himself liable
personally and he ia hereby relieved from all
personal liab£1ity for any damage thac may occur ~o
persona or property as a result of any act required
or perr. it~ed in the discharge of his duties.
APPLICATION PCR PER/tIT
80-1~ - I~EN REQUIRED
A person, rim, or corporation shall not do or
cause :o be done, any installations, alte~ationa,
repairs, or replacement of equipment or systems
covered by the provisions of this code, ~ithout first
having obtained the proper pert. it from the Electric~!
Official. Ordinary repairs, limited to $200.00
value or less, u~ay be ~de vithout a per. it provided
~ha~ such repnirs shall not violate any of the provisions
o[ this ccde and aubJec~ to l) o~r. ers or representative
~itten permission; 2) no inspection required; and
3) repnired by o~fler or licensed contractor.

80-15 - FORM
The applicant shall furnish such information as
may be required to co=plate the application forms.
80-16 - DRAWINGS AND SPECIFICATIONS
Whenever, in the opinion of the Electrical
Official, drawinzs and specifications are needed to
depict or define the nature and character of tbs work
for which the application ia made, the applicant
shall furnish drawings, s~ecifications, panel scheduls
and calculations. The applicant shall furnish savsral
copies to coincide with the permit review process for
the project. The applicant's approved set of drawings,
specific~tions, panel schedule and calculations shall
remain at all times on the Job. Such information o:
drawings and specifications shall be specific, and
this cods shall not be cited as a whole or in p&~t,
nor shall the term "legal" or its equivalent ba
lsgued as a substitute for zpecific information.
80-17 - EXAMINATION OF DPAWINGS
The Electrical Official shall examine or cause
to be examined each application for a permit and the
drawings and specifications which may be filed
therewith, amd shall ascertain by such examination
whether the installation indicated and described-is
in acccrdance with the requirements of this code and
all other applicable laws or ordinances.
E. - PEP}lIT
80-18 - ACTION ON APPLICATIONS
Ca) If the Electrical Official is satisfisd
that the work described i~ an application for permit
and the drawings and specific~tions which may be
filed therewith, conform to the requirements of this
cede, and other applicable laws and ordinances, he
shall issue a permit to the applicant which shall be

posted on the ]ob sits so that, whenever possible,
is visible from the street.
(b) If the application for pe~it and the
drawings and specifications which may be filed
therewith describe work which does not conform to the
requirements of this code or other applicable laws or
ordillancas, the Electrical Official shall not issue ·
permit but shall return the drawings to the applicant
with his refusal to issue such a permit. Such
refusal shall, when requested, be in writing and
shall contain the reasons therefor.
80-19 - CONDITIONS OF TllE PERMIT
(al The Electrical Official shall act upon
application for a permit with plans as filed, or as
amended, without unreasonable or unnecessary delay.
A permit issued shall be construed to be a license to
proceed with the work and shall not be construed as
authority to violate, cancel, alter, or set aside any
of the provisions of this code, nor shall such
issuance of a permit prevent the Electrical Official
from thereafter requiring correction of errors in
plans or in construction, or of violations of this
code. Any permit issued shall become invalid unless
the work authorized by it shell have been inspected
within six (6) months after its issuance or if the
work authorized by such permit is suspended or
abandoned for a period of six (6) months after the
time the work is inspected; provided, that for cause,
one or more extensions of time for periods not
exceeding ninety (90) days each, may be allowed in
writing by the Electrical Official.
(b) Plans for new construction or any change in
existing electrical installation over 400 amps on
restdentinl and over 400 mnps on commercial or
industrial zhe]l be prepared by, and each sheet shall
bear the impress seal of, a Florid· Registered
Professiovsl Engineer and shall conform with the laws

of the State of Florida, The plans shall show the
c~lculations, size of service and ~aximum avsilable
fault current and interrupting capacity of ~ain and
sub-feeder breakers or fuses, wires and conduit, the
location o~ service svitches and center or centers of
distribution, and the arrangement of circuits showing
the number of outlets connected thereto. The
Electrical Official shall examine all plans for
compliance vith the Electrical Code. It shall be thc
duty of the architect, engineer and builder to obtain
~eter and conduit locations from all utility
companies for all types o~ service before
construction is comaenced. Such ~eter and conduit
locations shall be indicated on the dra~ings.
(c) The installstion of uhe ~iring, apparatus
or equipment for light, heat or power! within or
attached to any building or prcaises whether fo~
private or public use, shall be done in accordance
with the apprnv~d plans and spscifications and shall
confot~ to the Collier County Electrical Code. Any
chsn~es or omissicns in ~he viring system ~rom that
sho~n cn per~itted plans must be reviewed by ~ha
Electrical Official and the request !ct the change
shall be made by the permit holder, snd ~pprove~.by
the o~rner and original engineer or his representative
or engineer appointed by architect of o~iginal plan.
Three (3) copies of the plan shoving the chan~e muse
be submitted ~i~h all sheets bearing tbs original
engineer's seal as provided for above,
F. - FEES
80-20 - COST OF PE~HIT
The Board of County Cmmnissioners shall
establish, by resolution, a schedule of fsss and
charges for matters pertaining to this Ordinance and
sssociated matters, It is the inteut o~ thesa
reEulatlons that the County shall ncc be required to
bear any part of the cost of applications made under
this Ordinance,
The schedule cf fees and char/es shall be posted
in the office of the Development Services Department.
The char~es listed may be changed by resolu:lon of
the Board o£ County Cot~r. issioners and are not subject
to the procedure otherwise neceosary for amendment of
this Ordinance.
''G, - INSPECTION
80-21 - INSPECTION REQUIRED
All new work and such portions of existing
system~ a~ ~y be affected by new work, or any
changes, shall be inspected to insure compliance with
all the requirements of this code and to assure that
the installation and constrnction of the electrical
system is in accordance with approved plans.
80-22 - NOTIFICATION
Advance Notice: It shall be the duty of the
permit holder to give reasonable advance notice to
the Electrical Official when work is ready for
inspection.
Reinspection: If the Electrical Official finds
that the work will not pass the inspection, the
installer shall be required to make necessary.
e~rreeticns find the work shall then be resubmitted
fcr inspecti~n. ~ere additional inspections are
necessary, there shall be an additional fee for each
such'inspection as indicated in the schedule of fees
and charges.
80-23 - }~TERIAL AND LABOR INSPECTIOMS
The equipment, material, power, and labor
necessary for the inspection shall be furnished by
the installer.

B0-24 - INSPECTIONS
Any portzon of an electrical system islanded to
be concealed by any per~,anent portion of the building
shall not be concealed until inspected and approved
by the Electrical Official, Equipment regulated by
this code she1! not be connected to the fuel or powsr
supply or plseed in cperation until it complies with
all applicable requirvnents of this code and a final
inspection approval has been issued. A final inspection
approval may, upon notice, be revoked by the Electrical
Official if it is fouvd that the electrical ~ystem
fails in any respect to comply with the requirements
cf this code. The Electrical Official may accept
inspection certification reports from a nationally
recognized approval agency in lieu of on-site inspection
when on-site inspection is impractical.
H. - CERTIFICATE OF APPROVAL
80-25 - FINAl, INSPECTION
Upon satisfactory completion and final
inspection of tile electrical installation, a
certificats of approval shall be issued by th~
Electrical Official. The building shall not be
occupied prior to completion of said system and/or
issuance of certification of approval.
80-26 - IE}~ORARY APPROVAL
A temporary certificate of approval may be
issued for a portion or portions of an slectrieal
system ~hich may be safely operated prior to final
completion of the building.
1. -VIOI. ATIO~S AND PENALTIES
80-27 - VIOLATIO~;S AND PFPAI,TIES
If any person, firm, corporation, or other legal
entity whether public or private, shall fail or
refuse to obey or co~ply with, or violates, nny of
tile provisions of this Ordinance, such person, firm,

corporation, or other legal entity, upon conviction
of such offense, shall be punished by a fine not to
exceed Five llundred Dollars ($500.00) or by
imprisonment not to exceed sixty (60) days in the
county Jail, or both, in the discretion of the court.
Each day of violation or non-ccmpliance shall be
considered as a seFarate offense. In agdition, any
person, fir=,, corporation, or other legal entity
whether public or private, convicted under the
provisions of this section shall pay all costs and
expenses involved in the case.
Nothing herein ccntained shall prevent the
County from taking such other lawful action in any
court of competent Jurisdiction as is necessary to
prevent or remedy any violation. Such other lawful
action shall include, but shall not be limited to, an
equitable action for injunctive relief and an action
at law for damages.
J. - APPEALS
80-28 - APPEALS
Whenever the Electrical Official shall reject or
refuse mode or manner of construction prcposed to be
followed or materials to be .sod in the erection or
alteration of a building or structure, or when ~ is
claimed that the provisions of this code do not
apply, or that an equally good or more desirable form
of construction can ~e employed in any specific case,
or when it is claimed that the true intent and
meaning of this code or any of the regulations
thereunder have been misconstrued or wrongly
interpreted, the c~mer of such building or structure
or his duly authorized agent, may appeal from the
decision of the Electrical Official to the Board of
Adjustments and Appeal., pursuant to the procedures
as set forth in the Collier County Ordinance

is tied down in conformity with Collier County
Ordinance.

set a minimum of five feet (5') deep, properly
preserved to protect it from decay and insect damage.

Amend subsections 680-20(a)(1) to read
as follows:
(1) Swimming pool and spa lighting shall ba Iow
voltage supply frcm an approved transformer and in
all ether ways shall conform to the National Electric
Code~ Ail pools shall have a rough and final
