A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA.
CANCELING CURRENT TAXES UPON LAND
ACQUIRED FOR PUBLIC USE.
WHEREAS, property located as a part of Lot 1, Block 340, Marco Beach
Unit 10, Plat Book 6, Pages 74 thorough 79, Collier County, Florida, more
particularly described as Exhibit "A" and Exhibit "B" attached hereto and
incorporated herein by reference, and known as the County Parking Facility
and Beach Access Area, and were conveyed to the County by Warranty Deed and
Special Warranty Deed, respectively, for public purpo.es; and
WHEREAS, the Warranty Deed for the County Parking Lot was recorded in
O.R. Book 1970, Page 769, et seq, of the Public Records of Collier County,
Florida, on July 25, 1994; and
WHEREAS, the Special Warranty Deed for the twenty foot (20') Beach
Access was recorded in O.R. Book 1163, Page 1358, et seq, on November 6,
1985, and that certain Notice of Release of Right of Reverter for the twenty
foot (20') Beach Access Area was recorded in O.R. 1970, Page 766, et seq, on
July 25, 1994, all collectively of the Public Records of Collier County,
Florida; and
WHEREAS, the property will be utilized for public purpose. as a
maximum of seventy (70) parking space. and a twenty foot (20') beach access
area for the general public; and
WHEREAS, the Board of County Commissioners of Collier County, Florida
approved Resolution No. 93-499 on November 2, 1993, approving a policy to
cancel current taxes upon land acquired by Collier County or the Collier
County Water-Sewer District under certain circumstances for public use; and
WHEREAS, Sections 196.28 and 196.29, Florida Statutes, provides that
the Board of County Commissioners of each County of the State of Florida is
given full power and authority to cancel and discharge liens for taxes,
delinquent or current, upon land held or owned by said County for public use
by the governmental unit,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS
OF COLLIER COUNTY, FLORIDA, that the current outstanding taxes on the
property located as a part of Lot 1, Block 340, Marco Beach Unit 10, Plat
Book 6, Pages 74 thorough 79, Collier County, Florida more particularly
described as Exhibit "A" and Exhibit "B" attached hereto and incorporated
herein by reference, and known as the County Parking Facility and Beach
Access Area are canceled as of January 1, 1994.
This Resolution adopted after motion, second and majority vote.
