RESOLUTION NO. 9 2 - 51 JftN2881 RESOLUTION APPROVING USER FEES FOR COLLIER COUNTY EMERGENCY MEDICAL SERVICES AMBULANCE SERVICES PURSUANT TO COLLIER COUNTY ORDINANCE NO. 91-46 WHEREAS, Collier County Emergency Medical Services provides emergency health care services to the residents and visitors of Collier County; and WHEREAS, the Collier County Emergency Medical Services operating budget is funded exclusively through ad valorem taxes and user fees; and WHEREAS, the Collier County Emergency Medical Services Advisory Council has recommended that user fees be equitably distributed between residents and non-residents of Collier County; and WHEREAS, the Collier County Board of County Commissioners . finds that user fees should be equitably distributed between those contributing to the ad valorem tax base ("County Residents" as base ("Non-County Residents"); and WHEREAS, the Collier County Emergency Services Administrator WHEREAS, the Collier County Emergency Medical Services Advisory Council has recommended that the user fees for Collier County Emergency Medical Services be increased; and WHEREAS, the Board of County Commissioners of Collier County, Florida, finds it necessary to increase the Emergency Medical Services user fees to better serve the public; and WHEREAS, Collier County Ordinance No. 91-46 provides that user fees for emergency medical services may be established by resolution of the Board of County Commissioners. ., JAN 2 8 1992 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA that: 1. The user fees set forth in Section 3 below are hereby approved and shall become effective as of the date of adoption of this Resolution. 2. The term "County Resident" as used in this Resolution shall mean: a. Natural persons who are owners of real property located in Collier County, dependents of said owners and members of said owners' households who have contributed to the payment of ad valorem taxes. b. Natural persons who have paid rent for a place of abode in Collier County for a period of six months or more within the preceding twelve-month period or natural persons who have a current written real property lease of a duration of six months or more; dependents of said persons and members of said persons' households who have contributed to the payment of rent. c. Natural persons who have paid rent for a business establishment in Collier County for a period of six months or more within the preceding twelve-month period or natural persons who have a current written real property lease of a duration of six months or more for a business located in Collier County; dependents of said persons and members of said persons' households who have contributed to the payment of rent for the business. d. Anyone meeting more than one of the "County resident" definitional categories set forth in "a" through "c" above shall be eligible for only a single County resident discount as set forth in section 3 of this Resolution per transport. 3. The user fees for special events set forth in this Resolution shall be decreased by fifty percent (50%) by the Collier County Emergency Services Administrator for special events conducted and/or sponsored by governmental organizations. 5. Collier County Resolution No. 90-501 is hereby repealed and superseded. 6. The Collier County Emergency services Administrator may adjust mileage fees in accordance with current fuel costs and shall not be restricted by the limitation set forth in Section IV above. 7. If any phrase or portion of this Resolution is held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion.
