WHEREAS; the PeU2an 8ay I.tprovement Diatrict (hereinatter
-District.) -wa. ereatedandoperated pUrsuant to the provisions of
Chapter 74-4-62; Law.' ot Plorida, as amended, and was vested with
the po'Jerandauthoiityto levy and collect special assessments and
charges agafnat red property with the District; and
WHEREAS, the Board ot County cOltltissioneis ot Collier County,
Florida, on '.tune 19, 1990 succeeded to the principal tunctions ot
the Pelican Bay I.provesent District pursuant to Chapter 74-462,
Lavs ot Florida; and
WHEREAS, the Pelican Bay I.prove.ent District coapleted
con.tructionot certain vater .anage.ent i.prove.ents in accordance
vith the Plan'ot ReclalllAtlon ot the PelIcan Bay Improve.ent
DIstrIct and such I.provements are currently In operatIon; and
WHEREAS, the District's Board ot SupervIsors adopted a plan
ot dissolutIon tor the District transferring title to all property
owned by the District to Collier County, including the water
aanag..ent syste.; and
WHEREAS, the Board ot County CO.llisgioners ot Collier County
accepted the District's plan ot dissolution and Collier County now
owns and operates the water manage.ent syste. and is responsible
tor the collection ot the debt .ervice tor the outstanding bonds;
and
WHEREAS, the Board ot County co..is.i~ner. adopted Ordinance
No. 90-111 creating the Pelican Bay Municipal Service
Taxinq and Benetit Unit which permits the levy ot special
assessments; and
