A RESOLUTION OF COLLI ER ComITY, FLORIDA, AUD
THE COLLIER COUNTY WATER-SEWER DISTRICT
SUPERSEDInG RESOLUTIon NO. 91-755 AND THE
PELICAN BAY IHPROVDiENT DISTRICT RESOLUTION
DATED KAY 20, 1987 BY ADOPTIUG THE CURRENT
WATER, SEWER AnD IRRIGATION RATE SCHEDULE
APPLICABLE TO PROPERTIES WITHIN THE COLLIER
CO~~T{ WAT~-SEWEROISTRICT FOR ALL PROPERTIES
LOCATED WITHIN THE PELICMI BAY COMMUNITY.
WHEREAS, the Board or County Commissioners or Collier
County, Florida, adopted ~e.olution No. 91-755 setting forth
the DOnthly rat.., r.es and other charges tor all water and
wastevater service. provided within the Pelican Bay Services
Division service areaj and
WHEREAS, the Board ot Supervisors ot the Pelican Bay
Inprove:llent District ("District") adopted a resolution on May
20, 1987 establishing rates, tees and other charges tor utility
services provided by the District ("District ReSOlution"); and
WHEREAS, the water, sever and irrigation tacilities trans-
!erred to Collier County pursuant to the Plan ot Dissolution
tor the District vere transterred to the Collier County Water-
Sever District; and
WHEREAS, the Collier County Water-Sever District continued
to charge the rates set forth in Resolution No. 91-755 and the
rates adopted by the District Resolution pursuant to the Plan
or Dissolution; and
WHEREAS, the Plan ot Dis.olution provides that the County
shall not blend, and thereby raise, the total rates ot the
residents or rate payers vithin what was heretotore the
District relative to water, s.."er or irrigation rates until
such tia. as comparable utility rates within the Collier County
Water-Sever District and the areas previously served by the
Pelican Bay Improvement District are generally on parity with
each other; and
WHEREAS, the Board ot County Commissioners amended the
Plan ot Dissolution to remove the limitation pertaining to the
blending ot water, sewer and irrigation rates; and

WHEREAS, the Board of County Commissioners or Collier

WHEREAS, the Board of Supervisors ot the Pelican Bay

WHEREAS, the water, sewer and irrigation facilities trans-
terred to Collier County pursuant to the Plan ot Dissolution
tor the District vere transferred to the Collier County Water-
Sever District; and
WHEREAS, the Collier County Water-Sewer District continued
to charge the rates set forth in Resolution No. 9l-755 and the
rates adopted by the District Resolution pursuant to the Plan
ot Dissolution; and
WHEREAS, the Plan of Dissolution provides that the County
shall not blend, and thereby raise, the total rates of the
residents or rate payers within what was heretofore the
District relative to water, se'"er or irrigation rates until
such tiae as cOJllparable utility rates within the Collier County
Water-Sever District and the areas previously served by the
Pelican Bay Improvement District are generally on parity with
each other; and
WHEREAS, the Board ot County commissioners amended the

WHEREAS, this Resolution has been advertised tor a public
hearing to be held on August l5, 1994, in accordance with all
laws and statutes or the State or Florida.

COMMISSIonERS OF COLLIER COmITY, FLORIDA, AS THE GOVERNING BODY

1. Resolution No. 9l-755 is hereby superseded in its
entirety.
2. The ronner Pelican Bay Improvement District Resolu-
tion adopted on May 20, 1987 is hereby superseded in its
entiroty.
J. The rates, tees and. charges set forth in Collier
County ordinance Nos. 86-67, 90-8.6 ,and 90-87, as amended, shall
apply to those properties located within the Pelican Bay
C01IIIUni ty. A copy of the current rate~, fees and charges is
attached hereto as Exhibit "A."
4. The attache.d rates, tees and charges shall become
eftective October l, 1994.
5. A copy ot. the att;ach~i ,chedule ot rates, fees and
charges shall be ~t.d in the of !ices of the Pelican Bay
Services Division and the Collier County Utilities Division and
be open to public inspection during business hours.
