WHEREAS, the LegiBlature ot the St~ste ot F'lorida lnChapter

125, Florida Statute., has conferred on 'all Counties in Florida the

paver to establish, co~rdinate and entorce zonirig and s~ch business
regulations as are necessary (or the protection ot the public; and
WHEREAS, the County pursuant thereto has ad'opted: 'a' Land
Developtlent Code (Ordinance ~lo. 91-102) ....hich establishes
c01ll'prehenslve zoning regulations tor the zoning ot particular
divi.ion~ ot the County, among ....hich i. the granting and extending
the time period ot Conditional U.es; and
WHEREAS, on September 8, 1992, the Board ot Zoning Appeals
enacted Resolution ~ro. 92-67, attached hereto and incorporated
herein, which granted a conditional use pursuant to Ordinance No.
91-102, a single-tamily detached cluster development, on the belo....
described property; and
WHEREAS, on September 7, 1993, the Board ot Zoning Appeals
enacted Resolution No. 93-371, attached hereto and incorporated
herein, which granted a one (1) year extension to the Provisional
Use granted in Resolution No. 92-67;
WHEREAS, SUbsection 2.7.4.5 ot the Land Developlllent Code
provides that the Board ot Zoning Appeals may extend the one (1)
year time period tor a conditional use which has not been
cODllllenced;
NOW, THEREFORE BE IT RESOLVED, by the Board ot Zoning Appeals
or Collier County, Florida, that:

tor the second ot three (3) permitted one (1) year extensions, in
