J 994 RESOLUT IOU 94- ~4 A RESOLUTIOtf PROVIDIHGFOR THE ESTABLISHMElfT OF A RETAIL PLANT tfURSERY IN THE "A" ZONIPlG DISTRICT PURSUNrT TO SECTION 2.2.2.3.21 or TH.E COLLIER COUNTY LAUD DEVELOPMENT CODE FOR PROPERTY LOCATED IN SECTION 12., TOWNSHIP 49 SOUTH, RAltGE25. EAST, COLLIER COUNTY, FLORIDA. WHEREAS, the Legislature of the State ot Florida in Chapter 67-1246, Laws of Florida, and Chapter 125, Florida Statutes, has conterred on Collier County thn power to establish, coordinate and entorce zoning and such busine!l"l regulations as are necessary tor the prote~ion ot the public; and WHEREAS, the County pursu~nt thereto has adopted a Land Development Co1e (Ordinance No. 91-102) which includes a Comprehensive Zoning Ordinance ~stablishing regulations tor the zoning at particular geographic divisions ot the County, among which is the granting ot Conditional Uses; and WHEREAS, the Collier County Planning Commission, being the duly appointed and constituted planning board tor the area hereby attected, has held a public hearing attar notice as in said regulations made and provided, and has considered the advisability of Conditional Use "21" ot Section 2.2.2.3 in an "A" zone tor a retail plant nursery on the property hereinatter described, and has tound as a matter at tact (Exhibit "A") that satisfactory provision and arrangement has been made concerning all applicable matters required by said regulations and in accordance with Subsection 2.7.4.4 ot the Land Development Code tor the Collier County Planning Commission; and WHEREAS, all interested parties have been given opportunity to be heard by this Board in a public meeting assembled and the Board having considered all matters presented.
