A RESOLUTIOtf PROVIDIHGFOR THE ESTABLISHMElfT OF A
RETAIL PLANT tfURSERY IN THE "A" ZONIPlG DISTRICT
PURSUNrT TO SECTION 2.2.2.3.21 or TH.E COLLIER
COUNTY LAUD DEVELOPMENT CODE FOR PROPERTY LOCATED
IN SECTION 12., TOWNSHIP 49 SOUTH, RAltGE25. EAST,
COLLIER COUNTY, FLORIDA.
WHEREAS, the Legislature of the State ot Florida in Chapter
67-1246, Laws of Florida, and Chapter 125, Florida Statutes, has
conterred on Collier County thn power to establish, coordinate and
entorce zoning and such busine!l"l regulations as are necessary tor
the prote~ion ot the public; and
WHEREAS, the County pursu~nt thereto has adopted a Land
Development Co1e (Ordinance No. 91-102) which includes a
Comprehensive Zoning Ordinance ~stablishing regulations tor the
zoning at particular geographic divisions ot the County, among
which is the granting ot Conditional Uses; and
WHEREAS, the Collier County Planning Commission, being the
duly appointed and constituted planning board tor the area hereby
attected, has held a public hearing attar notice as in said
regulations made and provided, and has considered the advisability
of Conditional Use "21" ot Section 2.2.2.3 in an "A" zone tor a
retail plant nursery on the property hereinatter described, and has
tound as a matter at tact (Exhibit "A") that satisfactory provision
and arrangement has been made concerning all applicable matters
required by said regulations and in accordance with Subsection
2.7.4.4 ot the Land Development Code tor the Collier County
Planning Commission; and
WHEREAS, all interested parties have been given opportunity to
be heard by this Board in a public meeting assembled and the Board
having considered all matters presented.
NOW, THEREFORE BE IT RESOLVED, BY THE BOARD OF ZONING APPEALS
ot Collier County, Florida that:

PUJrnIUG:
a. The Currant Planninq Manager may approve minor. chanqes in
the location, siting, or hei9h~ ot buildings,..t~ctures,
and improve.ants authorized by the conditional use.
Expansion of the uses identitied and approved within this
conditionaiuse application, or major changes to the site
plan submitted aa part of this application,' shall require
the submittal ot a new conditional use application, and
shall comply with all applicable County ordinances in
ettect at the time ot 5ub:nittal, including Division 3.3,
Site Development Plan Revie.... and approval, ot the Collier
County Land Development Co'le (Ordinance tlo. 91-102).
b. This proj~ct shall be required to meet all County
Ordinances in ettect at the time tinal construction
documents are submitted tor development approval.
c. Required parking tor the retail plant nursery in the FPL
easement shall be approved by FPL prior to Site
Development Plan approval,
d. The sale. at power equipmen~ such as la',m mowers, tractors
and the like shall not be permitted.
e. Landscaping and butterin'] shall be provided around the
entire site in accordance ~ith Division 2.4 ot the Collier
County Land Development Code.
t. The applicant shall provide a note on the site plan that
states that all exotic vegetation, as detined by County
Code, shall be removed tro~ the site and that the property
owner sha 11 be respons i b 1 e for subsequent annua 1 exot ic
remova 1.
g. The proposed driveway access to pine Ridge Road (CR-S96)
shall comply with the County'S 1\ccess Management Policy,
Resolution 92-422.

h. The master: plan shall pro'llde a Jlaximum of two ingress/
egress driveways to Living!;ton Road. One driveway shall
align with Livingston Woods Lane and the other. driveway
shall comply with the County's Access Management Plan
spacing requirement..
1. The present two lane cond i tion for Livingston Road may
require a l.tt turn lane and southbound right turn lane to
serve the project depending on operational and safety
conditions and constraints. The determination ot the
necessity ot any such turn lanes shall be at the
discretion ot the Transportation services Division (TSD).
A quarterly tratf ic volUJllc and turning 1Il0ve'lDent. report
shall be submitted to the TSD. .tor a period ot three years
troD the dat@ at the Certificate of Occupancy.
j. The County reserves the right ot access control under the
tour lane con1ition tor Livlngston Road.. Median openings,
either. tull Qr"c1ir,ctional, shall be determined during' the
design of,~ ..t.ivingaton' Road tour-laning. llothing in any
development; 51erait; issued by the Count.y shall .operate to
vest any right. to:a lIedIan opening in this project. Nor
shall the' 'Cdunty ..be liable for any ciaim ot damages due to
the presence or absence ot any median opening at any point
along any road frontage of this project.
k. The County reserves the right to acquire right-ot-way tor
the Livingst~n Ro~d project at a fixed cost tor land and
improvements without severance damage. at the time needed
based on the current lIarket value at that time.
1. The petitioner shall revise the master plan to illustrate
the tuture use ot that area designated as miniature golt
course and provide only one caretaKers residential
dwelling unit on-site.
