RESOLUTION 93-293
RELATING TO PETITION NO. CU-92-7 FOR EXTENSION OF
CONDITIONAL USE OF PROPERTY HEREINAFTER DESCRIBED
IN COLLIER COUNTY, FLORIDA
WHEREAS, the Legislature of the State of Florida in Chapter
125, Florida statutes, has conferred on all Counties in Florida the
power to establish, coordinate and enforce zoning and such business
regulations as are necessary for the protection of the public; and
WHEREAS, the County pursuant thereto has adopted a Land
Development Code (Ordinance No. 91-102) which establishes
comprehensive zoning regulations for the zoning of particular
divisions of the County, among which is the granting and extending
thQ time period of Conditional Uses; and
WHEREAS, on August 4, 1992, the Board of Zoning Appeals
enacted Ordinance No. 92-52, which granted a conditional use
pursuant to Ordinance No. 91-102, for a sewage treatment plant,
including percolation ponds, on the below described property; and
WHEREAS, Subsection 2.7.4.5 of the Land Development Code
provides that the Board of Zoning Appeals may extend the one (1)
year time period for a conditional use which has not. been
commenced;
NOW, THEREFORE BE IT RESOLVED, by the Board of Zoning Appeals
of Collier County, Florida that:

67-1246, Laws of Florida, and Chapter 125, Florida statutes, has
co~terred on Collier County the power to establish, coordinate and
entoree zoning and such business regulations as are necessary for
the protection of the public; and
WHEREAS, the County pursuant thereto has adopted a Land
Development Code (Ordinance No. 91-102) which includes a
Comprehe~sive Zoning Ordinance establishing regulations for the
zoning ot particular geographic divisions of the County, among
which is the granting of Conditional Uses; and
WHEREAS, the Collier County Planning commission, being the
duly app~~~ted and constituted planning board for the area hereby
attected, has held a public. hearing after notice as in said
regulations made and provided, and has considered the advisability
ot Conditional Use pursua~t to Subsection 2 of Section 2.6.9
(Essential services). in an "I" Industrial zone for a sewage

I, Robert L. Duane, ot HOle, Montes & Associates, Inc., as
authorized agent for Petition CU-92-7, agree to the following
stipulations requested by the Collier County Planning
Commission in their public hearing on July 2, 1992.

The Planning Services Manager may approve minor changes in
the location, siting, or height of buildings, structures,
and improvements authorized by the conditional use.
Expansion of the uses identified and approved within this
conditional use application, or major changes to the site
plan submitted as part of this application, shall require
the submittal of a new conditional use application, and

No construction permits shall be issued unless and until
approval of the proposed construction in accordance with
the submitted plans is. granted by Project Review Services.
Design and construction of all improvements shall be
subject to compliance with the appropriate provisions of
Division 3.2 of the Collier County Land Development Code.

Goodlette-Frank Road right-of-way shall be relocated so as
not 'to,intertere with future roadway improvements and the

No site drainage shall be placed so as to adversely impact
the use ot the Goodlette-Frank Road corridor for roadway
purposes.

m. With regards to the Goodlette-Frank Road corridor, the
Collier County utilities Division shall provide for a
northbound right-turn lane and a southbound lett-turn lane
consistent with Ordinance No. 82-91 and Collier County's
Future Access Management Policy.
n. With regards to the Goodlette-Frank Road corridor, the
Collier County utilities Division shall provide
compensating right-of-way for that land consumed by the
construction ot the northbound right-turn lane and the
southbound lett-turn lane.

new sewage treatment plant expansion.
