AN EMERGENCY ORDINANCE AMENDING 0OLL~E
COUNTY ORDINANCE NO. 88-13 BY AMENDING
SECTION ONE TO INCLUDE THE VINEYARDS
UNIT 3; REPEALING COLLIER COUNTY ORDINANCE
NO. 89-72; PROVIDING FOR CONFLICT AND
SEVERABILITY; DECLARING AN EMERGENCY; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, a portion of Tho Vineyards Unit 3 has been deeded to
Collier County and the Collier County School Board thereby
decreasing the taxable value within The Vineyards Unit 3; and
WHEREAS, the property owners within The Vineyards Unit 1,
including Tracts "F" and "K" receive a benefit from the streut
lighting installed within The Vineyards Unit 3; and
WHEREAS, it is in the best interest of Collier County to
have one Street Lighting District within The Vineyards.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
SECTION ONE. Amendment to Section One of Collier County ordinance
No. 88-13
Collier County Ordinance No. 88-13 is hereby amended to read
as follow:
Section One: Vineyards Unit i (including Tracts "F" and
"K"), Vinev~Fds Unit 3 Street Lighting
Municipal Service Taxing Unit Created;
Boundaries.
Pursuant to Chapter 125 of the Florida Statutes, the
Vineyards Unit 1 (including Tracts "F" and "K") and Vineyards
Unit 3 Street Lighting Municipal Service Taxing Unit is
hereby created for the purpose of providing street lighting
to the residents of the taxing unit, the boundaries of which
are hereinafter described:
All of Vineyards Unit i (including Tracts "F" and "K")
as recorded in Plat Book 14, Pages 67-74, 86-88, and
96-97, inclusive, of the public records of Collier
County, Florida; all being a part of Section 5 & 6 and 5
& 8, Township 49 South, Range 26 East, Collier County,
Florida, containing 559.04 acres more or less; and All
of Vineyards Unit 3 as recorded in Plat Book 16. PaGes
2-5, inclusive, of the Public records of collier

SECTION TWO. Repeal of Collier County ordinance No. 89-72
Collier County Ordinance No. 89-72 is hereby repealed in its

SECTION THREE. Conflict and Severability
? In the event this Ordinance conflicts with any other
ordinance of Collier County or other applicable law, the more
restrictive shall apply. If any phase or portion of this
ordinance is held invalid or unconstitutional by any court of
competent Jurisdiction, such portion shall be deemed a separate,
distinct and independent provision and such holding shall not
affect the validity of the remaining portion.
SECTION FOUR. Declaration of Emergency
This Board does hereby declare that an emergency exists and
that immediate enactment of this ordinance is necessary, and by no
less than four-fifths (4/5ths) vote of the membership of the Board
does hereby waive notice of intent to consider this ordinance.
SECTION FIVE. Effective Date
~" A certified copy of this ordinance, as enacted, shall be
filed by the Clerk of the Board with the Department of State of
the State of Florida, as soon after enactment as is practicable by
depositing the same with the postal authorities of the government
of the United States for special delivery by registered mail,
postage prepaid, to the Florida Department of State.
This ordinance shall become effective as provided in Section
125.66(3), Florida Statutes.
