NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA:
The Zoning Classification of the herein described real
~roperty located in Section 26, Township 46 South, Range 29
East, Collier County, Florida, is changed from "A-iMM" to "I"
and the Official Zoning Atlas Map Number 46-29-7, as described
in Ordinance 82-2, is hereby amended accordingly:

This Ordinance shall become effective upon receipt of
notice from the Secretary of State that this Ordinance has been
filed with the Secretary of State.

LEGAL DESCRIPTION
A certain tract or parcel of land lying in Section 27,
Township 46 South, Range 29 East, Collier County, Florida,
and more particularly do~cribod as follows:
BEGINNING at the Southeast corner of Section 27, Township 46
South, Range 29 East and thence proceeding West along the
section line between Sections 27 and 34 a distance of
approximately 2,200 feet to a point on a property line, said
property line being the Southeast Right-of-Way of the
Seaboard ~Coast Line Railroad (now abandoned); thence N 18"
46' 49" E a distance of approximately 1,450 feet to a
property corner; thence S 87" 48' 52" E a distance of
1,636.03 feet to a point on the section line between Sections
26 and 27; thence South along the Suction line between
Sections 26 and 27 ad distance of approximately 1,350 feet to
the Southeast Section corner of Section 27 and the point of
beginning.

I, George Archibald, as owner or authorized agent for
Petition R-90-15, agree to the following stipulations requested
by the Collier County Planning Commission in their public
hearing on April 19, 1990.
Water ManaGement and Engineerina=
a. Detailed paving, grading, site drainage and utility
plans shall be submitted to Project Review Services
for review. No construction permits shall be issued
unless and until approval of the propoued
construction in accordance with the submitted plans
is granted by Project Review Services.
b.. Design and construction of all improvements shall be
subject to compliance with the appropriate provisions
of the Collier County Subdivision Regulations.
c. In accordance with the Rules of the South Florida
Water Management District, (SFWMD) Chapters 40E4 and
40E-40, this project shall be designed for a storm
event of 3-day duration and 25-year return frequency.
d. If applicable, an Excavation Permit will be required
for the proposed lake(s) in accordance with Collier
County Ordinance No. 88-26 and SFWMD rules.
e. This project is recommended for approval for rezoning
purposes only. Detailed water management plans and
calculations will have to be submitted prior to SMP
approval and be scheduled for review by WMAB.
f. A copy of SFWMD Permit or Early Work Permit is
required prior to construction plan approval.
g. Platting is required in accordance with Collier
County Subdivision Regulations, if any lots, tracts,
or parcels are to be sold.
h. Work within Collier County right-of-way shall meet
the requirements of Collier County right-of-way
Ordinance 82-91.

i.All requirements of subdivision ordinance must be met
since no variances were requested.
J. Access into each tract as shown on the master plan is
informational only. Location and number is subject
to Subdivision Master Plan or SDP approval.
k. This proJ,ct is recommended for approval for rezone
purposes only. A Subdivision Master Plan shall be ,
submitted which complies with all the design
standards of the Subdivision Regulations unless
specific exceptions are requested and supported by
sound engineering reasoning during its approval
process. Approval of this rezone does not constitute
an approval to any subdivision design standards
contained within the petition or supporting drawings
or exhibits. The zoning petition master plan
submitted shall not be considered to suffice for the
Subdivision Master Plan required pursuant to Collier
County Ordinance 76-06, as amended.
Utilities:
a. Verification from the Immokalee Water-Sewer District
stating they have reviewed and approved the water and
sewer service construction documents mu~t accompany
the final site plan.
b. Verification of sewage treatment capacity pursuant to
Ordinance No. 80-112 to service this project must
accompany the final construction plan submission.
Znviromnsntal:
a. Any protected species as defined by the Florida Game
and Freshwater Fish Commission and U.S. Fish and
Wildlife Service which are identified during any
subsequent site plan review process must be
administered according to the management guidelines
of these agencies with approval from Collier County.
b. An EIS shall be required for any proposed SDP or PU
which proposes the handling, storage or utilization
of hazardous chemicals as defined by the FDER or
PETITIONER OR AGENT
