Purchaser and Seller entered into that certain Purchase and Sale Agreement effective as of March 24, 2010, and executed by Purchaser on March 31, 2010 (the "Agreement"), and the Addendum thereto executed by Seller on March 30, 2010 and by Purchaser on March 31, 2010 (the "Addendum''). Purchaser and Seller wish to further amend the Agreement and the Addendum with the following terms and conditions: 1. The first line of the first paragraph and the second line of paragraph 1) of the Earnest Money Addendum to Purchase Agreement attached to the Agreement are corrected and revised to reflect that the Agreement (referenced in the Earnest Money Addendum as "Purchase Agreement" and "Real Estate Purchase Agreement") is dated as of March 24, 2010. 2. Paragraph 2(a) of the Agreement and Paragraph 1 of the Addendum are revised to proVide that, notwithstanding any other provisions of the Agreement or the Addendum, Earnest Money shall be delivered to the account of Title on or before April 27, 2010. Except as expressly provided herein, the Agreement between the Purchaser and the Seller and the Addendum thereto remain in full force and effect according to the terms and conditions contained therein, and said terms and conditions are applicable hereto except as expressly provided otherwise herein.
