Pu~haser and Seller entered into that certain Purchase and Sale Agreement effective as of Ma~h 19, 2010, executed by purchaser on Ma~h 23, 2010, and exe~uted by Seller on Ma~ 24, 2010 (the "Agreement"). Pur~haser, Seller and corrected Seller wish to amend the Agreement with the follOWing terms and ~onditions: 1. The First Paragraph of the Agreement, and Paragraph 1 of Exhibit "D" to the Agreement, are revised and ~orrected to renect that the ~orrect identity of the Seller is Wells Fargo Bank, N ,A" a national banking association, in its capacity as mortgage loan servi~er and attorney in fact for Wilmington Trust Company, a5 Su~ces50r Trustee to Bank of Ameri~a, National Association (successor by merger to LaSalle Bank National Association) as Trustee for LXS 2007-6. 2. Paragraph 4(b) of the Agreement is revised to provide that, notwithstanding any other provisions of the Agreement, the closing shall take plac;:e on or before May 14, 2010. Except as expressly provided herein, the Agreement between the Purchaser and the Corrected Seller remains in full force and effect a~~ording to the terms and conditions contained therein, and said terms and conditions are applicable hereto ex~ept as expressly provided otherwise herein, IN WITNESS WHEREOF, the Pur~haser, the Seller, and the Corr~ted Seller have ex~uted this Addendum as of the dates hereinafter stated.
