Ordinance 91-086 82-2, THE COMPREHENSIVE ZONING REGULATIONS FOR THE UNINCORPORATED AREA OF COLLIER COUNTY, FLORIDk, BY AMENDING THE OFFICIAL ZONING ATLAS MAP NUMBER 0633S; BY CHANGING THE ZONING CLASSIFICATION OF THE HEREIN DESCRIBED REAL PROPERTY FROM "PUD" TO "PUD", PLANNED UNIT DEVELOPMENT, KNOWN AS VICTORIA FALLS PUD, FOR 76 MULTI-FAMILY DWELLING UNITS, FOR PROPERTY LOCATED ON THE SOUTH SIDE OF US-4X EAST AND ON TIlE EAST SIDE OF BAREFOOT WILLIAMS ROAD, LYING IN SECTION 33, TOWNSHIP 50 SOUTH, RANGE 26 EAST, COLLIER COUNTY, FLORIDA, CONSISTING OF 25 · 41 ACRES; AND BY PROVIDING AN EFFECTIVE DATE. W~EREAS, the Victoria Falls Planned Unit Development (PUD), which permits 157 dwelling units at a density of 6.18 units per acre, has been found to be inconsistent with the Density Rating System contained in the ~h~ture Land Use Element of the Growth Management Plan; WNEREAS, the Collier County Growth Planning Department petitioned the Board of County Commissioners to change the zoning classification of the herein described real property to be consistent with the Future Land Use Element of the Growth Management Plan; NOW THEREFORE BE IT ORDAINEO BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA; SECTION_ONE~ The Zoning Classification of tbs herein described real property located in Section 33, Township 50 South, Range 26 East, Collier County, Florida, is changed from "PUD" to "PUD", Planned Unit Development, in accordance with the PUD document attached hereto as Exhibit "A" which is incorporated herein and by reference made part h'ereof. The Official Zoning Atlas Map Number 0633S, as described in Ordinance Number 82-2, is hereby amended accordingly. Ordinance Number 80-62, known as the Victoria Falls PUD, adopted on July 29, 1980 b~ the Board of County Commissioners of Collier County, Florida, is hereby repealed in its entirety. This Ordinance shall become effective upon receipt of notice from the Secreta~-y of State that this Ordinance has been filed with =he Secretary of State. The proposed land use is compatible with the surrounding 2. The project sha~l comply with all applicable County, State and Federal laws regulating development of the property. 3. The project will be served by County approved potable water. 4. The project will be served by an on-site wastewater treatment plant until County service is available. 5. A de-acceleration lane is to be constructed on U.S. 41 to secondary road leading to entrance of proposed condominium site. 6. Detailed site and drainage plans will be submitted when development orders are requested for the project. 7. The property is located in the Urban Coastal Fringe Area and the Traffic Congestion Arsa as designated on the Future Land Use Map and in the Future Land Use Element of the Growth Management Plan. The project density at 3 %mits per acre conforms with the Density Rating System contained in the Future Land Use Element. Interconnection with adjacent properties is not appropriate. In the case of cjustered buildings with a common architectural theme, these distances may be less provided that a site plan is approved in accordance %;ith the site development plan regulations in the zoning ordinance in effect at the time of application. 5... Water Management: The water management system shall comply with the requirements of the South Florida Water Management District and Collier County. The final water management system design shall be reviewed and approved by the County Engineer prior to the commencement of the development · 4 11. Sanitary Sewage Treatment= An on-site sanitary sewage collection and treatment system shall be provided to comply with all applicable local and state reguirementm or connecting into an off-site sewage disposal plan presently serving the Hitching Post Mobile Home Park immediately west of this Planned Unit Development. 12. Road Improvements: The proposed new road connecting this project to U.S. 41 shall be completed and available to traffic before any certificates of occupancy are issued. Its intersection with U.S. 41 shall be at an existing or FDOT approved median opening. Subject to FDOT approval, the developer shall provide a right turn deceleration lane, left turn storage lane and a new median opening on U.S. 41, if required. ~he developer shall, after improvement of the sub-baee by the County, improve and extend I]arefoot Williams Road to the eastern edge of his property line. 13. Flood Elevation~ Buildings shall be elevated to meet the County's Flood Ordinance by using fill from the proposed lake or bring in additional fill to raise the buildings to the required flood elevation of AE 7'. 5 DEVELOPMENT STANDARDS 1. Purpose: The purpose of this s,ction is to set forth the standards for the development of the project. 2. Easements: ii~ A. All necessary easements, dedications, or other ~" instruments shall be granted to insure the continued operation of all service utilities. 3. Site Plan Approval: Prior to the issuance of a building permit, a Site Plan shall be submitted to and approved by the Collier County Planning Commission. The request shall include materials necessary to demonstrate that the approval of the site plan will be in harmony with the general intent and purpose of this document. Such material may include, but is not limited to, site plans at an appropriate scale showing proposed placement of structures on the property; provisions for ingress and egress, parking areas; and required yards and other open spaces. 4. Design and Operation: .. A. The project will be a condominium apartment complex. B. The design of the apartment buildings, landscaping and recreational facilities, as well as the marketing and advertising themes, will be directed toward the moderate income working residents of Collier County. C. The complex shall include two bedroom apartments. D. Recreational facilities shall include a children's play area, tennis court and shuffleboard courts containing not less than 3/4 of an acre. E.
