COMES NOW, the undersigned, Jean-Joseph Beauharnais, on behalf of himself enters into this Stipulation
and Agreement with Collier County as to the resolution of Notices of Violation in reference (case) number
CEV20090013007 dated the 7 day of August, 2009_.
In consideration of the disposition and resolution of the matters outlined in said Notice(s) of Violation for which
a hearing is currently scheduled for October 2, 2009 ; to promote efficiency in the administration of the code
enforcement process; and to obtain a quick and expeditious resolution of the matters outlined therein the
parties hereto agree as follows:
1) The violations noted in the referenced Notice of Violation are accurate and I stipulate to their existence.
Commercial vehicles or commercial equipment parked in a residential zoning district.
THEREFORE, it is agreed between the parties that the Respondent shall;
1) Pay operational costs in the amount of $117.78 incurred in the prosecution of this case.with y 30
days of this hearing. / }/o /'>J

2) Abate all violations by: Removing all commercial vehicles or commercial equipment parked in
the residential zoning district within one day of today's hearing or a fine of$100.00 a day will be
imposed for each day the violation exist. In the future no commercial vehicles or equipment be
will parked on the residential property.
3) Respondent must notify Code Enforcement within 24 hours of abatement of the violation and request the
Investigator perform a site inspection to confirm compliance.
(24 hours notice shall be by phone or fax and made during the workweek. If the violation Is abated 24 hours prior to a Saturday,Sunday or legal holiday,then the
notification must be made on the next day that is not a Saturday,Sunday or legal holiday.)
4) That if the Respondent fails to abate the violation the County may abate the violation and may use the
assistance of the Collier County Sheriff's Office to enforce the provisions of this agreement and all
costs of abatement shall be assessed to the property owner.

Lori,
We were out this morning to 3152 Karen Drive, one of the properties of Claude Martel for a possible water theft complaint
from Customer Service. When we arrived, we found the meter box covered by trash cans that when moved aside showed
that there was a hose connected to the curb stop that was turned half on.
We called the Sheriff's Department to have a Deputy respond to a water theft complaint. Upon the Deputy's arrival we
continued onto the adjoining property and found the hose branching and connected to the trailer at several points. This
address is 3176 Karen Drive. Continued investigation found that there was also water being supplied to 3190 Karen Drive
through a buried connection.

We shut off the curb stop, disconnected the hose, removed the meter connector and plugged the curb stop with a locking
plug. There is no longer any water at either of the trailers. Collier County Code Enforcement responded to the location as
well.
I submitted a sworn statement and received a report number. I will pick up a copy of the report early next week.

In consideration of the disposition and resolution of the matters outlined in said Notice(s) of Violation for which a hearing is
currently scheduled for October 2nd, 2009; to promote efficiency in the administration of the code enforcement process;
and to obtain a quick and expeditious resolution of the matters outlined therein the parties hereto agree as follows:
1) The violations noted in the referenced Notice of Violation are accurate and I stipulate to their existence.
The violations are of Collier County Code of Laws and Ordinances, Chapter 22, Article VI, Section 22-231(12i),
Section 22-243 and described as a vacant mobile home with broken window that is unsecure.
THEREFORE, it is agreed between the parties that the Respondent shall;
1) Pay operational costs in the amount of$117.87 incurred in the prosecution of this case within 30 days of
this hearing.
2) Abate all violations by:
1) Obtaining a Collier County boarding certificate and boarding mobile home to the specified ordinance
requirements by October 8th, 2009, or a fine of$250 a day until all violations are abated.
2) Repairing broken windows and securing mobile home OR hiring a general contractor licensed in Collier
County to obtain permit; inspections; and certificate of completion for the demolition of the mobile home by
April 8 h,-' 9A9;-or a fine of$250 a day until all violations are abated.

disposal facility, within seven days of today's hearing or a one hundred dollar ($100) a day fine be imposed
until violation is abated.
3) Keeping the property free of any and all litter until no longer the property owner of record.
4) Respondent must notify Code Enforcement within 24 hours of abatement of the violation and request
the Investigator perform a site inspection to confirm compliance.
(24 hours notice shall be by phone or fax and made during the workweek. If the violation is abated 24 hours prior to a Saturday,Sunday or legal holiday,then the
notification must be made on the next day that is not a Saturday,Sunday or legal holiday.)
