or repair control panel line parking lot on affected areas. Health, safety, & welfare.

September, 2008.
In consideration of the disposition and resolution of the matters outlined in said Notice(s) of Violation for which

the code enforcement process; and to obtain a quick and expeditious resolution of the matters outlined therein
the parties hereto agree as follows:
1) The violations noted in the referenced Notice of Violation are accurate and I stipulate to their existence.
THEREFORE, it is agreed between the parties that the Respondent shall;
1) Pay operational costs in the amount of $ incurred in the prosecution of this case
within 30 days of this hearing.
2) Abate all violations by:
Applying for and obtaining a Collier County Building Permit OR Demolition Permit for such
improvements, all related inspections and CO, within 30 days of this hearing or a fine of $100.00 per
day will be imposed until the violation has abated.
3) Respondent must notify Code Enforcement within 24 hours of abatement of the violation and request
the Investigator perform a site inspection to confirm compliance.
(24 hours notice shall be by phone or fax and made during the workweek. If the violation is abated 24 hours prior to a Saturday, Sunday or legal
holiday, then the notification must be made on the next day that is not a Saturday, Sunday or legal holiday.)
4) That if the Respondent fails to abate the violation the

Enforcement Department for the purposes of determining if the subject building meets the definition of "dangerous
building".
In accordance with the 2004 Florida Building Code any building or structure or any individual member with any of the
structural conditions or defects described below shall be deemed dangerous. A check mark next to any paragraph below
is an indication one or more of the dangerous structural conditions have been found.
Z 1. The stress in a member or portion thereof due to all factored dead and live loads is more than one and
one third the nominal strength allowed in the Florida Building Code, Building fog new buildings 4 similar
structure, purpose, or location.
® 2. Any portion, member, or appurtenance thereof is likely to fail, or to becomd deiached or dislodged, or to
collapse and thereby injure persons.
® 3. Any portion of a building, or any member, appurtenance, or ornadientation on the exterior thereof is not
of sufficient strength or stability, or is not anchored, attached, or fastened in place so as to be capable of
resisting a wind pressure of two thirds of that specified in the Florida Building Code, Building for new buildings of
similar structure, purpose, or location without exceeding the nominal strength permitted in the Florida Building
Code, Building for such buildings.
® 4. The building, or any portion thereof, is likely to collapse partially or completely because of dilapidation,
deterioration or decay; construction in violation of the Florida Building Code, Building, the removal, movement or
instability of any portion of the ground necessary for the purpose of supporting such building; the deterioration,
decay or inadequacy of its foundation; damage due to fire, wind or flood; or any other similar cause.
® 5. The exterior walls or other vertical structural members list, lean, or buckle to such an extent that a plumb
line passing through the center of gravity does not fall inside the middle one third of the base.
The field inspection revealed the building satisfied one or more of the conditions noted above. Based on the
inspection findings the building was found to be dangerous and unsuitable for the safe occupancy of its intended purpose.
Immediate remediation of the conditions up to and including demolition of the structure are required.
COMMENTS: The structure is in a complete dilapidated condition and should be removed from the
property, unless a Florida Design Professional can submit plans for its repair.

COMES NOW, the undersigned, Albert Lee, on behalf of himself and his wife Margaret Lee, enters into this Stipulation
and Agreement with Collier County as to the resolution of Notices of Violation in reference (case) number
CEPM20080015571 dated the 23rd day of October, 2008.
In consideration of the disposition and resolution of the matters outlined in said Notice(s) of Violation for which a hearing
is currently scheduled for April 17`x', 2009; to promote efficiency in the administration of the code enforcement process;
and to obtain a quick and expeditious resolution of the matters outlined therein the parties hereto agree as follows:
I) The violations noted in the referenced Notice of Violation are accurate and I stipulate to their existence.
The violations are of Collier County Code of Laws and Ordinances, Chapter 22, Article VI, Section 22-231.
Subsections 9, 10, 11, 12b, 121, 12j, 12k, 121, 12p, 19, and 20 and described as a mobile home being used for rental
purposes that has several property maintenance violations.
THEREFORE, it is agreed between the parties that the Respondents shall;
1) Pay operational costs in the amount of $118.40 incurred in the prosecution of this case within 30 days of
this hearing.
2) Abate all violations by:
The respondents must correct all violations outlined in the property maintenance inspection report dated October
22"d,22008. within days of this hearing or a fine of $250 a day until all violations are abated.
Alternately, the respondents must hire a general contractor licensed in Collier County to obtain pennit; inspection;
and certificate of completion for the demolition of the mobile home within 60 days of this hearing or a fine of
$250 a day until all violations are abated.
3) Respondents must notify Code Enforcement within 24 hours of abatement of the violations and request the
Investigator perform a site inspection to confirm compliance. If the Respondents fail to abate the violations the
County may abate the violations and may use the assistance of the Collier County Sheriffs Office to enforce the
provisions of this agreement. All costs of abatement will be accessed to the property owner.

trailer from residential property within 45 days of this hearing or a $50.00 per day fine will be imposed
for each day the violation remains.
3) Respondent must notify Code Enforcement within 24 hours of abatement of the violation and request
the Investigator perform a site inspection to confirm compliance.
(24 hours notice shall be by phone or fax and made during the workweek. If the violation is abated 24 hours prior to a Saturday, Sunday or legal holiday, then the
notification must be made on the next day that is not a Saturday, Sunday or legal holiday.)
4) If the Respondent fails to abate the violation the County may abate the violation and may use
the assistance of the Collier County Sheriff's Office to enforce the provisions of this agreement.
