ORDINANCE NO. 91-40 AN ORDINANCE AMENDING ORDINANCE NO. 82-2, THE COMPREHENSIVE ZONING REGULATIONS FOR THE UNINCORPORATED AREA OF COLLIER COUNTY FLORIDA, BY AMENDING SECTION 20, DEFINITIONS, TO ADD CERTAIN DEFINITIONS REI~TIVE TO AIRPORT NOISE AND SAFETY; BY ~ENDING SECTION 9.9, SPECIAL REGULATIONS FOR SPECIFIED AREAS IN AND AROUND THE NAPLES, EVERGLADES, AERO-OASIS, MARCO ISLAND AND IM~OKALEE (ED SCOTT AIRFIELD) AIRPORTS TO AMEND THE TITLE, TO MAKE REVISIONS TO TEXT TO ADD CERTAIN LAND USE RESTRICTIONS, TO AMEND NONCONFORMING USE REQUIREMENTS, AND TO REDESIGNATE THE AIRPORT NOISE ZONE; BY ADDING A NEW SLIBSECTION 9.9 d., NAPLES MUNICIPAL AIRPORT NOISE ZONES, LAND USE RESTRICTIONS, SOUND LEVEL REQUIREMENTS (SLR) FOR STRUCTURES, AND SLR DESIGN R[:QUIREMENTS, TO REGULATE THE SOUND LEVEL REDUCTION REQUIREMENTS FOR RESIDENTIAL DEVELOPMENT; BY ADDING A NEW SUBSECTION 9.9 e., TO REQUIRE NOTIFICATION OF POTENTIAL NOISE IMPACT; BY PROVIDING FOR CONFLICT AND SEVERABILITY; AND BY PROVIDING AN EFFECTIVE DATE. WHEREAS, Chapter 125, Florida Statutes, establishes the right ' and power of counties to provide for ~he health, welfare and safety of existing and future residents by enacting and enforcing zoning and business regulations necessary for the protection of the public; and WHEREAS, the Section 9.9 of the Zoning Ordinance regulating · land %~ses in and around the airports in the unincorporated area of Collier County, Florida contains outdated and incorrect information; and WHEREAS, the inconsistencies of information may prevent regulators from recognizing an airport obstruction which may pose a potential hazard to aircraft operations as well as to persons and property on the ground in the vicinity of the obstruction; and WHEREAS, an obstruction may affect land use in the vicinity and may reduce the size of areas available for taking off, 441 Words ~e~e~-ehr~h are deleted; words underlined are added. maneuvering and landing of aircraft, this, tending to impair or destroy the utility of the airports in Collier County, and the public investment therein; and WHEREAS, it is hereby found that aircraft noise may be an annoyance or objectionable to residents in the community surrounding the airports in Collier County; and WHEREAS, Chapter 163~,~ Part-II;. (Local Government comprehensive Planning and Land'Development Regulation Act), Florida Statutes,'provides.that counties shall have the power and " responsibility to plan.~'~mprehensively for their future development and'growth including the adoption and implementation of appropriate ia~ developme~t'regulations'which are necessary or desirable to impIement a comprehensive plan, including the regulation of'the use'of land tO ensure'the compatibility of adjacent uses-as2provided in"Section' 163,3202(2)(b)., Florida Statutes; and'__~ .... _ WHEREAS,'the Futu~e'La~d Use Element of the Growth Management Plan requires ~h~t Certain ~and' Development Regulations be adopted to implement the plan; and WHEREAS, Policy 3.1.J in the ~uture Land Use Element of the Growth'~ana~em~nt Plan requires the adoption of Lank'Development R~gulations that contain provisions for the soundproofing of residential development within the designated Noise Zone and the proper notification of properties within and around the Noise Zone of potential noise impact; and WHEREAS, the Collier County Planning Commission (Local Planning Agency) has determined that this proposed Airport Noise and Safety Zone Ordinance is consistent with the.adopted Growth Management Plan as required by Section 163.3194(2)(a), Florida Statutes; NOW THEREFORE BE IT ORDAINED by the Board of County Commissioners of Collier County Florida: 442 Wo:rds m~-~hr~h are deleted; words underlined are adde~. 2 SECTION ONE: DEFINITIONS Section 20, "Definitions", of Ordinance No. 82.2, the Comprehensive Zoning Regulations for the Unincorporated Area of Collier County, Florida, shall be amended to add the following: ,Definitions" As used in the Ordinance, unless the context otherwise requires: ~" (1) AMSL - Above M~an Sea Level.
