At the time that an agenda is presented for adoption, it is in order for any member to move to amend the proposed agenda by adding any item which the member desires to add, or by proposing any other change. It is common for the president to prepare a proposed agenda, but that becomes binding only ifit is adopted by the full assembly, perhaps after amendments as just described. rRONR (10th ed.), p. 363,1. 8-20; see also p. 16 of RONR In Brief] \ http://www.robertsrules.com/faq .html 4/812010 Dear Coastal Advisory Committee Members, The County's Coastal Zone Management department has pushed the issue to obtain and use studies by PBSj in Clam Bay meant to justify taking additional sand from its ebb shoal. The PBSj Clam Bay Data Collection and Analysis report was not at all well received by many persons, including members of the Clam Bay Advisory Committee. They did not approve it. Clearly, Mr. McAlpin is in need of a positive peer review that will approve of the PBSj report. He has told you and others that the entities and persons he is recommending to do the Peer Reviews of the PBSj work are derived from recommendations from the FDEP. However, that is not at all what the records show. Attached to this commentary is an email to Gary McAlpin from David Tomasko of PBSj firm, whereby he recommend entities and persons for review of his own work.... Note that he may expect these entities or persons to approve of his work, particularly if Mr. McAlpin provides a very narrow scope of work for the review that would ensure a favorable outcome. Certainly, the concept of an "Independent" peer reveiw has been lost here. However, there are SEVERAL INDEPENDENT PROFESSIONAL REVIEWS ALREADY DONE. The two technical specialists members of the CBAC submitted their own written reviews of the PBSj report that criticized it for poor historical data review, skewed reporting of newer data, improper characterizations of benthic or biological components and inappropriate comparisons between the canal waterway system of Doctor's Pass/Moorings Bay and the natural vegetated shorelined waterways of the Clam Bay Conservation and NRPA. The Mangrove Action Group commissioned an "Independent" Peer Review done by Dr, Harold Wanless and provided it to the Coastal Advisory Committee (CAC). Several CAC agendas continued it repeatedly and it has yet to be aired publicly by either the sub- committee on Clam Bay or the full CAC board. In Summary: The Coastal Zone Manager has attempted to control the process for selection and scope of work for professional review of the PBSj Clam Bay Data Collection and Analysis. There has been an outrageous lack of transparency and accountability in the choice of PBSj as the professional consultant and the nature of the work they are doing for Collier County. The PBSj report has attempted to either marginalize or discredit all prior Clam Bay studies and substitute their own highly questioned report of data to justify major alterations to the preserve waterways. When this was questioned and criticized, those criticisms were shoved aside for recommendations of a reviewer who will give approval of the PBSj report. The public has a right to be informed of all professional/technical reviews of the PBSj report including the Indepenent Review done by Harold Wanless, Chair of Geological Sciences of the University of Miami. I request that the reviews by Kathy Worley of the Conservancy and David Roellig a retired Corps geologist be publicly aired and discussed and once again request for the Wanless Review to be publicly discussed on the record by this committee. If the concerns were mostly related to water quality assessments (which seems to me to be the case) then I'm not sure of how his experience is relevant to those questions. Instead, I would put forth that the Senior Scientists of the Sarasota Bay and Charlotte Harbor National Estuary Programs would be more appropriate. Both of them work with data on water quality and ecological characterizations, and both are scientists, not engineers. As it seems the science part is the one with more controversy, perhaps that's a good place to start. For Sarasota Bay, the scientist to contact is Dr. Jay Leverone, who can be reached via email at jay@sarasotabay.org For Charlotte Harbor, the scientist to contact is Judy Ott, who's email address is jott@swfrpc.org As well, contacts with FDEP, related to the TMDL program and/or "impairment" issues would include Julie Espy, Kevin Petrus, and Paul Kurisko. Getting the report to FDEP might be a good way to kill a couple of birds with one stone, get a review of the work we did, get an answer as to the value of the existing water quality monitoring data, and also answer the questions about the need for data to be put into STORET and whether or not such data (not our data, but the County's data) would indeed result in a finding of impairment. That might be a way to get the Conservancy and Pelican Bay to really take a stand on their data - do they think FDEP would agree that Clam Bay is "pristine"? Let's put the question to the people who are charged with making that call. Why not, right? Finally, whoever is chosen, please ensure that they understand the budget and scope and timeline we had. You can always do more work (I pointed that out in my response) but the question is did we do a good job considering what we were tasked with doing. Thanks!
