Ordinance 91-023 ORDINANCE NO. 91-.2~ AN ORDINANCE AMENDING COLLIER COUNTY ORDINANCE NO. 80-47, AS AMENDED, THE COLLIER COUNTY PARKING ORDINANCE, AMENDING SECTION THREE, DEFINITIONS, BY DEFINING  DEPARTMENT AND TRANSPORTATION SERVICES; SECTION FOUR; REVISING SECTION IVE; REVISING SECTION SEVEN; REVISING '?I ECTION NINE; REVISING SECTION TEN; ADDING  ECTION 13 ENTITLED PARKING FEE SCHEDULE; DDING SECTION 14 ENTITLED OUTSTANDING VIOLATIONS, REQUIRING NOTIFICATION TO THE DEPARTMENT OF HIGHWAY SAFETY AND MOTOR VEHICLES OF OUTSTANDING PARKING VIOLATIONS; RENUMBERING SUBSEQUENT SECTION; PROVIDING FOR CONFLICT AND SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Board of County Commissioners of Collier County, Florida, adopted Ordinance No. 80-47, as amended, the Collier County Parking Ordinance; and WHEREAS, the Florida Legislature has adopted Chapter ~t"~ .'i90-4~, Laws of Florida (1990), and said act requires the County to adopt an ordinance whereby the Clerk of the Court will notify the Department of Highway Safety and Motor Vehicles of .persons who have outstanding parking violations in violation of '~ ~eotion 316.1955 and Section 316.19~6, Florida Statutes; and WHEREAS, the Public Works Division has been reorganized Under the Transportation Services Division. -.~' NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA that: SECTION ONE: Section Three of Collier County Ordinance No. 80-47, as amended, entitled Definitions, is hereby amended to read as follows: SECTION THREE: Definitions ~; 1. Bicycle: Any deride propelled by human power, or any ~....~.. ~ "moped" propelled by a pedal-activated helper motor with a manufacturer'~ certified maximum rating of brake horsepower, upon which any person may ride, having 2 tandem wheels, either of which is 20 inches or more in diameter, and including any device generally recognized as a bicycle though equipped with .~ 2 front or 2 rear wheels. Clerk: The Clerk of the Circuit and County Courts of Collier County, Florida. 6. County: Collier County, Florida. 7. County Road Right-of-Way: Any strip of land granted, dedicated or deeded to tho public occupied or intended to be occupied by a road. 8.Crosswalks: A. That part of a roadway at an intersection included within the connections of the lateral lines of the sidewalks on opposite sides of the highway, measured from the curbs or, in the absence of curbs, from the edges of the traversable roadway; B. Any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian ; crossings by lines or other markings on the "~ surface. 9. Curb Loading Zone: A space adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers or materials. 10. Intersections: ~: A. The area embraced within the prolongation or ~.. '~: connection of the latersl curb lines; or, if none, i-. then the lateral boundary lines of the roadways of two highways which Join one another at, or ~ approximately at, right angles; or the area within ~ which vehicles travel upon different highways Joining at any other angle may come in conflict. ~ B. Where a highway includes two roadways 30' or more apart, then every crossing of each roadway of such divided highway by an intersecting highway shall be regarded as a separate intersection. In the event such intersecting highway also includes two roadways 30' or more apart, then every crossing of two roadways of such highways shall be regards as a separate intersection. ~ 16. Traffic Control Devices: 'All signs, signals, markings, and. devices, placed or erected by authority of · a public body or official having Jurisdiction for the purpose of regulating, warning, or guiding traffic. ~9 20. Operator: Any person who is in actual physical control of a motor vehicle upon the highway, or who is exercising control over or steering a vehicle being towed by a motor vehicle. , ..~0 21. Owner: A p~rson who holds the legal title of a j vehicle, or, in the event a vehicle is the subject of an agreement for the conditional sale or lease thereof with the right of purchase upon performance of the ~' conditions stated in the agreement and with an ' , immediate right of possession as vested in the '"'- conditional vendee or leasee, or in the event a me~a~e~ mortgagor of a vehicle is entitled to the possession, then such conditional vendee, or leasee, or mortgagor, shall be deemed the o%n~er, for the - purposes of this Ordinance. i:I. ~ 22. Pedestrian: .'Any person afoot. ?.5. Public Parking Space: Shall mean any parking space on County owned;leasg~ property or on private property which the owner, lessee, or person in control of such property provides for use -by members of- the public other than employees of such owner, lessee, or person, including, but not limited to, parking spaces at .... shopping centers, .stores, offices, motels, malls, restaurants, and marinas. 26. Right Of Way: The right of one vehicle or pedestrian to proceed in a lawful manner in preference to another vehicle or pedestrian approaching under such circumstances of direction, speed, and proximity to give rise to danger of collision unless one grants precedence to the other. 27. Safety Zone: The area or space officially set apart within a roadway for the exclusive use of pedestrians and protected or so marked by adequate signs or authorized pavement markings as to be plainly visible at all times while set apart as a safety zone. 28. Served by Rules of Civil Procedure: When served by Certified Mail or Sheriff's service. 29. Sidewalk: That portion of a street between the curbline, or the lateral line, or a roadway and the adjacent property lines, intended for use by pedestrians. 30. SECTION TWO: Section Four of Collier County Ordinance No. 80-47, as amended, entitled Placement of Official Parking ; Signs, is hereby amended to read as follows: ~.. SECTION FOUR: Placement of Official Parking Signs. 1. The P~b}~e-We~}~s Transportation Service~ Administrator and/or ~he-eeHm~y-~m~mee=-~h~eu~h the County Manager 9~r his desi~nee, shall investigate and make recommendations to the Board of County Commissioners concerning parking restrictions to be placed upon ~:,~" : .... streets and highways in the unincorporated area of Collier County. These recommendations shall be in )~.. accordance with the terms of this Ordinance in an effort to clearly inform the public as well as to aid in the implementation of the conditions set forth in this Ordinance. Upon the advice of the Services Administrator and/or eo~nty-~n~nee~-end-the ".'> County Manager 9r his designee, the Board of County Commissioners may, by resolution, designate certain areas along County roads and other areas owned/leased · ~',/. by Collier County as being areas in which parking, .~ .._ standing, or stopping is restricted or prohibited. It shall not be necessary for the Board of County ,~" Commissioners to adopt a resolution when criteria for '~?~;<' ~.~:": restricting or prohibiting standing, stopping and -parking have been established in this Ordinance or by any previous resolution or policy establishing . .... ~. restrictions or prohibitions. 3. Upon the Board of County Commissioners enacting a resolution either restricting or prohibiting parking, ~.. ..~.. standing, or stopping in certain areas along County roads, such roads shall be posted with signs specifying the restrictions or prohibitions of " parking, standing, or stopping, as enacted by the Board of County Commissioners. ~ SECTION THREE: Section Five of Collier County Ordinance ~.~ No. 80-47, as amended, entitled Stopping, Standing, or Parking .' It is unlawful for any person or persons to willfully , obstruct the free, convenient, and normal use of any .../: publt~ street, h~ghway or road, by Impeding, <7'~.i hindering, stifling, retarding or restraining traffic or passage thereon, or by endangering the safe ~ movement of ~ehicles or pedestrians travelling thereon: A. No person shall stop, stand or park a vehicle within an alley in a business district except for the e~peditious loading or unloading of material, Words ~ are added; words st~ek-~h~gh are deleted. and in no event for a period of more than twenty minutes, and no person shall stop, stand or park a vehicle in any other alley in euch a manner as to obstruct the free movement of vehicular traffic; B. SECTION FOUR: Section Seven of Collier County Ordinance '[..iNc. 80-4?, as amended~ entitled Penalties, is'hereby amended to .read as follows: SECTION SEVEN: Penalties. /~. A. Pursuant to eha~e~-~9-g46T-Baws-o~-P~o~da-~9~9~ Section 318.14, Florida Statutes, any person cited for a violation of Sections Five and Six of this OrdinanceT shall be deemed to be charged with a noncriminal violation and shall be assessed a civil penalty according to the following schedule: ... (1) Twenty-five ($25.00) dollars for a violation of Subsection One-H of Section Five or of -- Section Six of this Ordinance. · .'? (2) Five ($5.00) dollars for a violation of all i:~i remaining Subsections of Section Five of this -. Ordinance. "~ B. Each day any violation occurs or continues shall be a separate offense. For parking in excess of .. the time authorized in a public parking space, ..~.~ each succeeding equal time period beyond that authorized as the maximum time period for said parking place shall constitute a separate offense. C. The amount of any penalty specified in this section shall be increased by five ($5.00) dollars if payment is not received by the Clerk prior to Notice being mailed to the Registered Owner by Cert~fied Mail pursuant to Subsection D of Section Nine of this Ordinance. 10 Words L~ are added; words straek-~h~ea~h are deleted. SECTION FIVE: Section Nine of Collier County Ordinance No. 80-47, as amended, entitled Procedures Governing Payment of ~Civil Penalties and Proceedings to Enforce Payment for County Parking Violations, is-hereby amended to read as follows: SECTION NINE: Procedures Governing Payment of Civil Penalties and Proceedings to Enforce Payment for County Parking Violations A. Any person issued a County parking citation, -~ pursuant to Section Eight of this Ordinance, shall answer the'citation by either of the following .... procedures within ten (10) days after the date of issuance of the citation. (1) Payment -of-the penalty indicated on the cita- .~. tion may be remitted to the Clerk, pursuant to the directions on such citation, or (2) A hearing may be requested by the person receiving such citation or the cited vehicle's Registered Owner for the purpose of presenting evidence before a County Judge concerning a parking violation. Any person requesting a hearing shall execute a statement on a form prepared by the County Attorney indicating his or her willingness to appear at such hearing at a time and place specified thereon. Any person who requests a hearing and does not .~' appear in accordance with said statement shall be subject to contempt proceedings or to other such penalties as the Court may, in its discretion, impose to require compliance with this Ordinance. B. Pursuant to the provisions of ehap~e=-~e-4e~?-Baws e~---~a--~9~9~ Section 316.1967. Such Notice shall be sent by Certified Mail and shall inform said Registered Owner concerning the nature and location of the parking violation ~, and direct compliance with either of the alternatives specified in Subsection A of this section within fourteen (14) days after the date said Notice is mailed, according to the records maintained by the Clerk. D. If the Clerk receives proof of delivery of the Notice mailed by Certified Mail, pursuant to Subsection C of this section, and payment of the penalty is not received or a hearing requested within the fourteen (14) day period specified therein, the Clerk shall cause the Registered Owner first listed on the parking citation to be served in accordance with the Florida Rules of Civil Procedure with a Court Order requiring payment or attendance at a hearing at a time and place specified in such Order. Pursuant to the provisions of eha~te~--~9-4e~?--~ews--~-P~da ~}9~9~ Section 316.19~7, F~orida Statutes, a County Judge after said hearing shall make a determination as to whether a parking violation has been committed and may impose a fine not to exceed One Hundred ($100.00) dollars, plus Court costs. SECTION SIX: Section Ten of Collier County Ordinance No. 80-47, as amended, .entitled Procedures Governing Payment of .'C~vil Penalties and Proceedings to Enforce Payment for 'M~nicipal Parking Citations, is hereby amended to read as "follows: -- SECTION TEN: Procedures Governing Payment of Civil Penalties and Proceedings to Enforce Payment for Municipal Parking Citations. A. The Clerk shall process parking violations issued by a law enforcement officer within the boundaries of a chartered municipality in accordance with the procedures contained in Section 9 of this i...~ Ordinance only after th~ municipality has adopted .. an Ordinance, pursuant to the provisions of Chapter 316, Florida Statutes as--eme~de~--by eh~p~e~--~9-48~?-Laws-e~-P~e~*da-~9~9~, governing the regulation and enforcement of parking within the boundaries of such municipality, which i.!~: provides ~e~ that: ~"i:~?' SECTION TEN~ Conflict and Severability In the event thi~ Ordinance conflictu with any other ordinance of Collier County or other applicable law, the more restrictive shall apply.
