STATemENT OF COMPLIANCE
Leawood Lakes IV is to be a residential development of ~" dwelling
units. ~
This project will remain subject to concurrency with the Growth
Management Plan throughout the life of the project.
Leawood Lake IV compile:3 with the planning and development
objectives of the Growth Management Plan. The project lies within
the Urban Designated Area ~s identified on the Future Land Use Map
and a. base density of 4,.0 dwelling units per gross acre is
· ~a. permitted.
Leawood Lakes IV is consistent with it s surrounding land use. To
the.east is an existing Circle K convenience store and mobile home
". park To the west is Lea.wood Lakes a residential multi-family
project of 144 units (7+ upa). To the south is the existing Moon
Lake Development. Radio Road borders the north line of Leawood
Lakes IV.
Leawood Lakes IV is located in an area that would bear no negative
impact due to the requested zoning change.
County water and sewer s~stemm are or will be available at the
property line to serve the project. Water management will consist
of a lake and other convel%tional items to comply with applicable
regulation~s.

The purpose of this Section is to set;forth the location and

The East 212 feet of the West 1/2 of the Northwest 1/4 of the

~ Elevations within the project site range from 8.5 to 10.2 feet
above mean sea level. Most of the area, however, falls within the
~r:~' 9 fOOt elevation. Further, the depths to bedrock in the area
varies from some seven feet to more than ten feet. All of the site
is in Flood Zone X according to FIRM Map 120067 0415 D.
The soil types on the site include 7.7 ± acres of SCS 14, Pineda
fine sand with limestone substratum and 5.5 ~ acres of SCS

~:~The subject site consists of the following vegetation communities:
Palmetto Prairie (5.4 acres)
Pine Flatwoods (1.S.~acres)
Pine/Cypress/Cabbage Palm Forest (6.0 acres)
The Pine Flatwoods and Pine/Cypress/Cabbage Palm Forest are noted
to have the vegetation typical for the respective communities with
an invasion of melaleuca (Melaleuca guinquenervia) and brazilian
pepper (Schinus terebi, nthifolius).
TW,. historic hydroperiod for the Pine/Cypress/Cabbage Palm Forest
has been altered due to previously altered drainage patterns.
Consequently, the existing trend is toward a drier system with
increased invasion by exc]tics.
1.6 PROJECT DESCRIPTION
The project is a residential development consisting of multi-
family dwelling units with a maximum building height of 30
feet. The character of the proposed development is in general
intended to be an extension of the SDP approved (but not yet
constructed) Leawood Lakes.
The individual dwelling units will be attached with possible
2-story units. The final design will determine the specific
nature and function of the buildings relative to the site.

PROJECT DEVELOPMEN~
:~ . The purpose of this Section is to delineate and generally
. :~ describe the project plan of development, the respective land
? . uses of the tract included in the project, as well as the
.project criteria for Leawood Lakes IV.
'A, Regulations for development of Leawood Lakes IV shal! be

condominium documents verify that it does not qualify under
the subdivision regulations as a subdivision.

of Radio Road. Prior to final Site Development Plan

the dedication ~as made. Final plans shall show right-
of-way as dedicated, not as reservation.
E. The developer shall provide 25 feet of additional road
right-of-way along the south side of Radio Road and shall
receive impact fee credits to the extent provided for in
Ordinance 85-55 as amended.

made and a copy provided to Project Review Services prior
to construction plan approval.

lake(s) in accordance with Collier County Ordinance
N~ber 88-26, and South Florida Water Management District
(Sf'WMD) rules.
?i D. The water management ~ystem shall be able to bleed down

first day in accordance with SFWMD rules.

C. It is anti~ipated that a pump station located west of the

.,.- will be completed by the fall of 1990 and a 12 inch force
main will be e~tended to southerly right-of-way line of
'"<" Radio road. The utility construction documents for the

which will connect the project to the central sewerage
facilities of the District in Radio Road rights-o~-way.
The force main must be extended from the main on-site
Road.

D. Sewer lines on-site w~ll be privately owned and
maintained. Homeowners ~ssociation document's must be'
provided with the final site plan and provide for the
property ownership and maintenance.
E. Design and construction of these facilities must be in
compliance with Ordinance 88-76, as amended.
F. No Certifica.tes of OCcUpancy will be issued until the
regional sewer services of the Collier County Water-Sewer
District are in place and operational.
O. All customers connecting to the water distribution and
sewage collection facilities to be constructed will be
customers cf the County and will be billed by the County
in accordance with the County's established rates.
4.12 EASEMENTS FOR UNDERGROUND UTILITIES
Easements for underground utilities such as power, telephone,
TV, cable, wastewater collection and transport, water
distribution lines and other similar utilities necessary for
the service of the project shall be located as required and
granted ~or those purposes.
4.13 ~NTAL
:.-.. The development o~ this PUD Master Plan shall be subject to
% and governed by the ~ollowing conditions:
A. The applicant shall be subject to all environmental
ordinances in effect at the time of all final development
order approvals.
B. Rezone approval does not absolve the applicant from
supplying necessary information as required for
· subsequent site plan approval (i.e. wildlife surveys,
~-..~,'. Jurisdictional wetland information and appropriate
mitiDation).
.." C. All miti~ation ~or impacted wetlands shall comply with
the ratios and requirements of Appendix 7 of the South '-
Florida Water Management District rules and may consist
~-. o~ wetland creation or upland compensation for wildlife. '
Mitigation areas shall be surveyed prior to final (site
plan~construction plan) approval and designated as a
conservation easement and/or tract with protective
covenants pursuant to Florida Statutes, Chapter 704.06.
D. Preservation and mitigation areas shall be designated as
preservation ' ' ·
,. . tracts and/or conservation easements on all
subsequent site plans and shal~ be recorded on the plat
~- subject to the uses and limitations Chapter 704.06 of the
.'.. Florida Statutes
E. Preservation areas located approximately 150 feet south
of Radio Road along the eastern boundary, and
approximately 500 feet south of Radio Road along the
western boundary and totaling no less than 1.4 acres in
area, shall be field verified and approved by Collier
~County Project Review Environmental Staff. These areas
'~.: shall retain the existing natural canopy, understory and
groundcover vegetation and shall be maintained free
exotics in perpetuity,
4.14 COMMON AREA OWNERSHIP AND ~{~INTENANCE

shall be submitted to Project Review Services for review. No
construction permits shall be issued unless and until approval

plans is granted by Project Review Services.
Design and construction of all improvements shall be subject
