AN ORDINANCE ESTABLISHING THE COMBAT AUTOMOBILE
THEFT PROGRAM; PROVIDING FOR FINDINGS AND PURPOSE;
PROVIDING FOR TITLE AND CITATION; PROVIDING FOR
DEFINITIONS; PROVIDING FOR PROGRAM REGULATIONS;
PROVIDING FOR CONFLICT AND SEVERABILITY; PROVIDING
FOR AN EFECTIVE DATE.
WHEREAS, The number of motor vehicle thefts within the
unincorporated areas of Collier County continue to rise, with a
rate increase from 327 in 1986, 367 in 1987, 368 in
1988, 427 in 1989 and 426 for the first ten (10) months of
1990 (not including 280 vehicles recovered for other agencies,
motorcycles, mopeds, ATC's and boats); and
WHEREAS, Motor vehicle theft is a crime of stealth and many
.' vehicles stolen are moved during the pre-dawn hours of I:0OAM -
~ 5:00AM; and
WHEREAS, Motor vehiclm thefts are likely to continue and to
!/" increase unless certain proactive measures are taken to help
~/ prewent such occurrences within Collier County; and
WHEREAS, Pursuant tO section 316.008 (6), Florida Statutes,
a County may enact an ordinance providing for the establishment
of a "Combat Automobile Theft" program; and
· WHEREAS, The occurrence of motor vehicle theft has resulted
in the loss of hundreds of thousands of dollars of property to
citizens, business owners, and guests and required the
expenditures of hundreds of hours of investigative effort by the
Collier County Sheriff's Office at the expense of its taxpayers;
and
WHEREAS, The citizens of Collier County will likely pay for
the continued increase of the motor vehicle thefts through
~. increased insurance premiums; and
WHEREAS, Many of the automobiles and other vehicles that are
stolen in any jurisdiction are in transit during the early
i/ . morning darkness to add to the stealth and reduce detection.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
~ COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
SECTION ONE: Findinqs and Purpose.
In order to enable law enforcement personnel patrolling
Collier County to better detect potential automobile thieves in
~ the act of stealing or transporting stolen vehicles and to reduce
the incidence of lost property, the Board of County Commissioners
finds it necessary to enact this article to protect the 'p~lic
.i~.....~ealth, safety and welfare.
SECTION TWO: Title and Citation.
This ordinance shall be known and cited as the "Collier
County Combat Automobile Theft Program Ordinance".
SECTION THREE: Definitions.
(1) Vehicle: A conveyance meeting the description of a motor
vehicle as defined tn Chaptd~r 316, Florida Statute.
(2) Owner: The legally recorded holder of the title of a motor
vehicle able to apply for a certificate of title or
duplicate certificate of title or register or. transfer title
to a motor vehicle
(3) Decal: An adhesive emblem designed by the Collier County
Sheriff's Office, within the provisions of Section
316.008,Florida Statutes.
(4) Consent Form: A legally binding form, designed by the
Collier County Sheriff's Office, in accordance with Section
316.008,Florida Statutes to be signed by the owner of the
vehicle enrolled in the Combat Automobile Theft Program.
(5) Administrative Fees: The fee paid by the program
participant to cover the co~ts of implementing and operating
this program.
SECTION FOUR: Pro,ram Re~ulations.
Once signed, the consent form will be kept on file with the
Collier County Sheriff's Office and serve as written
authorization to stop the vehicle designated on the form between
'the hours of i:00AM through 5:00AM. All persons wishing.to enroll
a vehicle, or vehicles, in the Collier County Sheriff's Office
Combat Automobile Theft Program (C.A.T.), shall comply with the
followi~g regulations:
(1) Complete and submit a notarized consent form for each
vehicle enrolled in the program to the Collier County
Sheriff's Office Crime Prevention/Outreach Division.
(2) At the time of submission of the consent form, provide the
Sheriff's Office with proof of ownership of each vehicle to
be enrolled in the program, either Certified Title or
Registration Certificate will be accepted.
(3) At the time of submission of the consent form, provide the
Collier County Sheriff's Office with personal
identification, either in the form of a drivers license or
birth certificate. Only the certified owner of a vehicle to
be enrolled may enroll the vehicle into the program.

(4) Pay an administrative fee of one (1) dollar to the Collier
County Sheriff's Office.
(5) At the time of enrollment, the decal must be immediately
affixed to the lower left corner of the back window of the
vehicle.
(6) Upon selling, or otherwise transferring ownership of the
vehicle, the registered owner shall remove the decal
(7) Upon terminating participation in the program, the
registered owner shall remove the decal.
(8) Upon selling, transferring ownership of the vehicle, or upon
terminating participation in the Combat Automobile Theft
Program (C.A.T.), the registered owner shall notify the
Collier County Sheriff's Office via the self-addressed post
card provided at the time of enrollment.
SECTION FIVE: Conflict and Severability.
In the event this ordinance conflicts with any other
ordinance of Collier County or other applicable law, the more
restrictive shall apply. If any phrase or portion of this
ordinance is held invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed a separate
district and independent provision of ~uch holding shall not
affect the validity of the remaining portion.
SECTION SIX: Effective Date.
This Ordinance shall become effective upon receipt of notice
'from the Secretary of State that this ordinance has.been filed
with the Secretary of State.
