AN ORDINANCE AMENDING COLLIER COUNTY ORDINANCE NO.
88-28 WHICH CONFIRMED THE CREATION OF THE MARCO
ISLAND BEAUTIFICATION ADVISORY COHHITTEE~ REVISING
THE APPOINTHENTAND COMPOSITION OF THE ADVISORY
COM~ITTEE~ AMENDING SECTION THREE TERMS OF OFFICE~
PROVIDING FOR CONFLICT AND SEV~RABILITY~ ANO
PROVIDING AN EFFECTIVE DATE.
WHEREAS, Collier County Ordinance No. 81-35 created the Marco
Island Beautification Municipal Service Taxing Unit for the
purpose of beautifying and maintaining the median stripe of
boulevards and certain other public areas within the Unit as
determined by the Advisory Committee~ and
WHEREAS, the Board of County Commissioners on March 1, 1988
adopted Collier County Ordinance No. 88-28 confirming the creation
of the Marco Island Beautification Advisory Committee~ and
WHEREAS, Collier County Ordinance No. 88-28 provides that the
Advisory Committee shall consist of seven (7) members with six (6)
members being representatives of Marco Island community
organizations and one (1) member "at large"~ and
WHEREAS, it ia the desire of the Board of County
Commissioners to have five (5) members being representatives of
Marco Island community organizations and two (2) members "~.
NOW, THEREFORE, BE IT ORDAINED.BY THE BOARD OF C~NTY r~ .~--
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
SECTION ONE. Amendments to Section Two of Collier Co~ty
Ordinance No. 88-28.
Section Two of Collier County Ordinance No. 88-28 is hereby
amended to read as follows:
SECTION TWO: Appointment and Composition.
The Committee shall consist of s~-~$~ five ~) members
which representation shall consist of one (1) member being an
individual in good standing with their organization and
recommended for appointment by the President of each of the
following Marco Island community organizationsc
1. Marco Island Chamber of Commerce
2. Marco Island Civic Association
3. Marco Association of Condominiums

associated with any Marco Island organization. After
publication of a vacancy notice in ~ publication of general
circulation within Collier County and posted in the County
libraries and County Courthouse, ~h*s the "At Large" member&
shall be recommended for melsction by review of
qualifications end vote of the Committee.
Members of the Committee shall be appointed by and serve
at the pleasure of the Board of County Commissioners. Each
member shall be a resident and elector of the Marco Island
Beautification Municipal Service Taxing Unit (hereinafter
referred to as "Unit").
Appointment of members to the Committee aha11 be by
resolution of the Board of County Commissioners, which
resolution shall sat forth the date of appointment, the term
of office and applicable community organization in which the
member would represent.
SECTION TWO. Amendments to Section Three of Collier County
Ordinance No. 88-28.
Section Three of Collier County Ordinance No. 88-28 is hereby
amended to read as follows:
SECTION THREE: Terms of Office.
The initial terms of office of the Committee members
have been draw~ by lot and shall be as follows:
Marco Island Chamber of Commerce member 2 years
Marco Island Civic Association member 3 years
Marco Association of Condominiums member 3 years
Ma=eo-~s}and-Jayeees ~member 2 years
Marco Island Taxpayers Association member 2 years
Marco Island Woman's Club member 3 years
"At Large" member I years
Thereafter, each appointment or rea~pointment shall be for a
term of four (4) years. Should a vacancy occur, that vacancy
shall again represent his particular Marco Island Community
Organization or "At Large" seat& on the Committee and said

i~'~ vacancy appointment shall be filled in the same manner as
· specified in Section Two. Appointments to fill any vacancies
" on the Committee shall be for the remained of the unexpired
~. term of office.
i~:i: Should a member resign prior t~ the completion of hie
term of office, that member should advise, in writing, the
President of the organization which he represents if
applicable, the Committee Chairman and the Board of County
~ ' Commissioners.
'i SECTION THREE. Conflict and Severability.
In the event this Ordinance conflicts with any other
Ordinance of Collier County or other applicable law, the more
restrictive shall apply. If any phrase or portion of this
Ordinance is held invalid or unconstitutional by any court of
competent Jurisdiction, such portion shall be deemed a separate,
distinct and independent provision and such holding shall not be
construed as to render invalid or unconstitutional the remaining
provisions of the Ordinance.
SECTION FOUR. Effective Date.
This Ordinance shall become effective upon .receipt of notice
from the Secretary of State that this Ordinance has been filed
with the Secretary of State.
