'i~ WHEREAS, Collier County Ordinance No. 86-41 sets forth the
requiremen~s for creating County Adviso.-y Boards~ and
WHEREAS, Collier County Ordinance No. 91-107 created the
Forest Lakes Roadway and Drainage Municipal Service. Taxing Unit in
Co~lier County, Florida~ and
- WKEREAS, Ordinance No. 91-107, Section Three, provides for
the establishment of an advisory committee to advise the Board of
County Commiss~onere in matters perta£ntng to the Municipal
Service Taxing Unit (MSTU).
NOW~ THEREFORE, BE IT ORDAINED BY TBE BOARD OF COUNTY
OF COLLIER COUNTY, FLORIDA:
~ ~[~J,.~.,~[_~.~]. Creation of the Forest Lakes Roadway and Drainage
There is hereby created and established the Forest Lakes
Roadway and Drainage Advisory Committee, hereinafter referred to
as the "Committee".
:~. Appointment end ComDosit~on.
A. The Committee shall consist of five (5) members which
:i' generally represent the area within the Forest Lakes Roadway and
Drainage Municipal Service Taxing Unit as said MSTU is described.
Ordinance No. 91-107.
B. Members of the Committee shall be appointed b~ and
serve at the pleasure of the Board of County Commissioners. Said
i. members shall be permanent residents w~thin the MSTU and electors
iof Collier'County.
C. Appointment of members to the Committee shall be by

SE~ION FO~. Removal from Officer Failure to atten~ meetin~s.
A. ~y me.er of the Co~ittee may be removed from off~ce
with our without cause by a majority vote of the Board of County
Co~iss ioners.
,, B, If any me.er of the Co~ittee fails to attend two (2)
=onse~tive Co~ttee meetings without a sat[sfacto~ excuse or
a me.er is absent for more than one-half of the Co~ittee~s
?meetings ~n a given fiscal year, the Co~ittee shall reco~end 2he
]me~er~s seat to be declared vacant and if approved, ~he vacancy
be f~11ed by the Board of County Co~[s~ioners.
Off~cers~ Ou~Z ~ules o~ procedure.
A. At its earliest opportunity, the me~ership of the
'Co~ittee shall elect a chai~an and vice chai~an from amon~ the
~me~ers. Officers" te~s shall be for one (1) year, w~th
for re-election.
B. The presence of three (3) or more members shall
:ute a quorum o~ the Committee necessary to take action and
transact business.

Members of the Committee shall serve without compensation,
but shall be entitled to receive reimbursement for expenses
ly incurred in the performance of their duties upon prior

The functions, powers and duties of the Committee shall be as

[~ A. TO aid and assist the Board of County Commissioners'tn
~.:arrying out the purposes of providing and maintaining improved
y related drainage and roadway restoration within the area
of the Unit as set forth in County Ordinance No. 91-107.
B. To prepare and recommend to the Board of County
ioners an itemized budget of the amount of money required
carry out the business of the Hunicipal Service Taxing Unit for
the next fiscal year. In carrying out this responsibility, the
Committee shall, no later than April 1st of each year, meet with
the Collier County Project Administrator or his Designee and
outline to the Administrator those projects which the committee
wishes to'see acc6mplished during the next fiscal year. Based
Upon this information, the Administrator or his Designee 'shall
prepare a proposed budget for the Municipal Service Taxing Unit,
'~in accordance with standard county guidelines regarding the
preparati'on of budgets. This proposed budget shall then be
reviewed by. the Committee and upon approval by the committee be

through the Project Administrator to the Board of
Commissioners.. for - adoption in accordance with the
?.~rocedurss for. the adoption of budgets set forth under general law
and~.~'~.th~ ~oard of 'County Commissioners t policy. Should the
~. Committee · fail to"approve a budget by June 1st of each year, the
Count~'.~Manager. shall be' authorized to submit a proposed budget to
'the.'Board of County Commissioners.
_~.~ The .,Committee shall recommen~ work programs and
iri°rit/~s -to the Project Administrator or his Designee in
with-the adopted budget or budget amendments which may
~"be.ladopted by-the Board of County Commissioners. The execution of
workv,~:- programs ..shall. be under the direct supervision and

work .~:.may be performed under contract (in accordance with law) or
by County forces.
i'!'.~ D. The Committee may adopt and amend "Guidelines" to govern
operation and the operation of the Municipal Service Taxing
'Unit, subject to approval by the Board of County Commissioners.
",~~. Duties of the Pro4eot ~dministrator or
Desi~nep.
The duties of the Project Administrator or his Designee shall
be:
A. To administer the activities of the Municipal Service
!Taxing Unit in accordance with established policies of the Board
County Commissioners and guidelines adopted by the Committee.
'B. To prepare the annual budget in accordance with Section
Seven, Paragraph B, .above.
C. To provide periodic written reports to 'the Commi~tee,
the County Manager and the Board of County Commissioners on the
i'activities of the Municipal Service Taxing Unit and its finances
in accordance with established guidelines of the Board of County
ioners or the Committee.
D. Attend all Committee meetings.

~:. In the event this Ordinance cOnflicts with any other
ordinance of Collier county or other applicable law, the more
restrictive shall apply. If any phrase or portion of th~s
:Ordinance ~s ~ald ~nvali~ or unconstitutional by any cou~ of
Jurisd~ction, such potion shall ba deemed a separate,
and ~ndepandant prov~sion and such holding shall not
'. affect ~ha validity of ~a
~s Ordinance shall become effective upon receipt . of
c~owladgament from ~a Secrata~ of State that th~s Ordinance
