CORRECT A SCRIVENER'S ERROR IN THE LEGAL DESCRIPTION OF THE NEREIN DESCRIBED PROPERTY AND ACREAGE DETERMINATION REFERRED TO AS QUAIL WEST PHASES I AND \5 , TO.SHIP SOU H, NGE EAST, COLLIER ~_ ~M04~d ~ COUNTY, FLORIDA; AND BY PROVIDING FOR AN ~ %~" EFFECTIVE DATE. WHEREAS, the Collier Couhty Board of County o~ ~ o Ur: ~ -Commissioners adopted Ordinance No. 93-44, an amendmer~ to :, the Quail West, Phase I PUD on July 27, 1993, and WHEREAS, following said action adopting Ordinance No. 93-44, staff was advised that a portion of the site's legal description was in error resulting in an increase in the ~ n~mber of acres in Phase I and its correction constitutes a ,~ scrivener's error. '? NOW, THEREFORE BE IT ORDAINED, by the Board of County Commissioners of Collier County, Florida that: SECTION ONE: THE SCRIVENER'S ERROR AMENDMENT TO STATEMENT OF COMPLIANCE. The Statement of Compliance with Growth Management Plan of ordinance No. 93-44 is hereby amended to read as follows: The Quail West Phase I project area is 531 538 acres. Phase I land uses will consist of a maximum of 325 single family residences, an 18 hole championship golf course, a golf and country club complex, accessory and utilitarian uses, and a system of natural open space preserves. Phase II is located in Lee County, and complies with applicable Lee County plans and regulations. The Phase III project area is ~323.19-acres. The Phase III project land uses will consist of a maximum of 191 single family residences, 9 golf holes, accessory and utilitarian uses and common open space. Quail West Phases I and III will be consistent with the growth policies, land development regulations, and applicable Collier County Growth Management Plan objectives for the following reasons: 1. The property lies within the Urban R~sidential Land Use designation as identified on the Future Land Use Map and as required in Objective 1, Policy 5.1. and Policy 5.3. 2. The project location is accessible to all required public services and facilities as required by Objective 2 of the Future Land Use Element. 3. The planned project will be compatible and complementary to existing and future surrounding land uses as required by Policy 5.4. of the Future Land Use Element. Development of the project will result in an efficient and economical extension of community facilities and services as required in Policy 3.1.H. and L. of the Future Land Use Element. 6. The maximum project density of 604 dwelling units per acre is far below the density limitation of four units per acre which is established by the Density Rating System of the Future Land Use Element. SECTION TWO: SCRIVENER'S ERROR AMENDMENT TO LEGAL DESCRIPTION Paragraph 1:2, Legal Desd'ription, of Section I, Property Ow~ership and Description, of Ordinance No. 93-44, Quail west Phase I and IIi PUD, is hereby, amended to read as follows: 1.2 LEGAL DESCRIPTION Phase I: That portion of the east half of Section 7, Township 48 South, Range 26 East, Collier County, Florida lying easterly of 1-75 (State Road 93) ~-- ~A ~ ~, and the west half of Section 8, Township 48 South, Range 26 East, Collier County, Florida lc== ~..an n==~..~ fact thcrcof, containing 538~ acres. Phase III: The east half of Section 8, Township 48 South, Range 26 East, Collier County, Florida, containing 323.19 acres. The aggregate acreage of Phases I and III is 861.19. SE~ION ~EE: EFFECTIVE DATE This Ordinance shall become effective upon receipt of notice from the Secretary of State that this Ordinance has been filed with the Secretary of State.
