WHEREAS, the Florida Legislature has enacted Section
.316.655(6), Florida Statutes, to authorize any Florida county
that participates in an intergovernmental radio communications
program approved by the Division of Communications of the
Department of General Services to assess up to a $12.50
surcharge for each moving traffic violation to fund that
county's participation in its approved intergovernmental radio
communications program; and
WHEREAS, Collier County, Florida, has such an approved
(800 megahertz) intergovernmental radio communications program;
WHEREAS, the Board of County Commissioners of Collier
County has determined that it is appropriate an~ in the best
interests of the citizens of Collier County to enact this
Ordinance to provide for a $12.50 surcharge to fund Collier
County's participation in said approved intergovernmental radio
· ~. communications program.
NOW, TNEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY
"' COMMISSIONERS OF COLLIER COUNTY, FLORIDA that:
· ~ SECTION ONE~ ASSESSMENT OF BURCHARGE
~,,~, A. ASSESSMENT OF SURCHARGE. Pursuant to Section 316.655,
Florida Statutes, in addition to any other penalties provided
for violations of Chapter 316 or Chapter 318, Florida Statutes,
there shall be assessed a $12.50 surcharge for each moving
traffic violation committed in Collier County.
B. DISPOSITION OF FUNDS. In addition to other
disposition of penalties by County Courts under Section 318.21,

Florida Statutes, or otherwise, the Clerk of the Circuit Court
of Collier, c~unty is hereby authorized and directed to collect
thesQ SZ2:.50;~surcharges','~o:convey all.such collected funds
monthly$~.O:.~O~,l~ar,:Couu~yf:.andr to~. maintain month-to-month
records;,of- Si1'/: surcharges collected.
C. USE OF FUNDS. All funds generated by each surcharge
shall be used only to fund Collier County's participation in
its 800 megahertz Intergovernmental publto Bervices/emergency
radio communicatione program, the sams being a County-wide 800

In the event this' Ordinan~a conflicts with any oth.r
ordin~n~ of Collier County or other applicnbl~ law, th~ mor~
restrictive shall apply. If any phrase or portion of this
Ordinance is held invalid or unconsti~uttonal by any cour~ of
competent Jurisdiction, such portion ~hall be deemed a
separate, distinct, and tndepenOent provision and such holding
shall not affect the validity of the remaining portion.
BE~ION T~EE. EFFECTIVE DATE.
A certified copy of thl~ Ordinance shall be filed in the
Off Ica of the Secretary of State by the Clerk of the
Co~isstoners within ten (10) days after aOoption of this
, Ordinance by the Board of Count~ Co~missioners. This Ordinance
,. = shall take effect at 12:01 A.M. on Friday, October 1, 1993.
