WHEREAS, the Board of County Commissioners of Collier County,
adopted the Concurrency Management System of its Capital
Improvement Element (CIE) of the Collier County Growth Management
Plan by ordinance Number 89-05 on January 10, 1989, as required by
Section 163.3184, Florida Sta~es; and
WHEREAS, in March, 1990, Collier County adopted its Adequate
Public Facilities Ordinance (Ordinance No. 90-24) which
implemented the Concurrency Management System of the Growth
Management Plan; and
WHEREAS, in September, 1990, certain provisions of the
Adequate Public Facilities Ordinance regarding the implementation
of concurrency were challenged pursuant to Section 163.3213,
Florida Statutes; and
WHEREAS, on November 26, 1991, the Department of Community
Affairs held a preliminary hearin~ pursuant to Section
163.3213(4), Florida Statutes, to determine whether or not the
challenged portions of the Adequate Public Facilities ordinance
were consistent with the CIE of the Growth Management Plan; and
WHEREAS, on December 6, 1990, the Department of Community
Affairs issued its Final Order determining that certain provisions
~f the Adequate Public Facilities Ordinance were inconsistent with
the CIE of the Growth Management Plan; and
W~EREAS, on February 6, 1991, the Department of Community
affairs and others petitioned the Division of Administrative
Hearings on the issue of consistency of certain provisions of the
Adequate Public Facilities Ordinance with the CIE of the Growth
Management Plan pursuant to Section 163.3213(5) (b), ~lorida
Statutes; and
WHEREAS, an administrative hearing was conducted in Collier
County between July 22 and July 26, 1991, wherein the Division of
Administrative Hearings Hearing Officer heard testimony and
received evidence concerning the issue of the consistency of the
Adequate Public Facilities Ordinance with the CIE of the Growth
Management Plan; and
WHEREAS, on August 27, 1992, the Hearing Officer issued a
final order finding certain of the challenged portions of the
Adequate Public Facilities Ordinance inconsistent with the CIE of
the Growth Management Plan and recommending the imposition of
substantial sanctions upon Collier County as a result pursuant to
Section 163.3213(6), Florida sta~u~es; and
WHEREAS, on March 16, 1993, the Board of County Commissioners
of Collier County entered into a Stipulated Settlement Agreement
with the Department of Community Affairs and the other parties to
the Adequate Public Facilities Ordinance challenge in which it was
agreed that Collier County would amend the Concurrency Management
System of the CIE pursuant to Rule 9J-5.0055, Florida
Administrative Code, and later amend certain portions of the
Adequate Public Facilities Ordinance causing it to become
consistent with the Concurrency Management System amendments to
the CIE; and
WHEREAS, on April 13, 1993, the Administration Commission
issued its Final Order Number AC-93-036, approving the Stipulated
Settlement Agreement and directing Collier County to adopt the
remedial amendments to the Concurrency Management System of the
CIE.

WHEREAS, on May 25, 1993, the Board of County Commissioners
of Collier County did take action in the manner prescribed by law,
did hold public hearings concerning the adoption of the remedial
plan amendment and did adopt such amendments as ordinance No.
93-25; and
WHEREAS, through inadvertence, Ordinance No. 93-25 was
incorrectly transmitted to the Secretary of State; and
WHEREAS, it is necessary for the Board of County
Commissioners of Collier County to readopt, reconfirm and ratify
the adoption of Ordinance No. 93-25; and
WHEREAS, all applicable substantive and procedural
requirements of law have been met.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
~: Readoption Of Remedial Plan Amendment.
Ordinance No. 93-25, the 1993 Concurrency Management System
Remedial Plan Amendment for Collier County is hereby readopted,
reconfirmed and ratified in its entirety as more fully set forth
in Exhibit A attached hereto and incorporated by reference herein.
The Amendment consists of amending the Concurrency Management
System Objectives and Policies, the Schedule of Capital
Improvements, Costs and Revenues by Type of Public Facility and
Implementation Programs of the Capital Improvement Element, and
Implementation Strategy of the Traffic Circulation Element as set
forth in said Exhibit A.

If any phrase or portion of this Ordinance is held invalid or
unconstitutional by any court of competent~ jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portion.

~: Effective Date.
This Ordinance shall become effective upon receipt of notice
from the Secretary of State that this Ordinance has been filed
with the Secretary of State.

for levels of service. Notwithstanding other provisions of this
policy, general obligation bonds approved by referendum may be used
for any public facilities to acquire capacity needed within the five
year capital improvements plan or for excess capacity.
PoLicy 1.2.5:
The County shall not provide a public facility, nor shall it accept
the provision of a public facility by others, if the County is unable
to pay for the subsequent annual operating and maintenance costs of
th,e facility.
Policy 1.2.6:
Prior to fiscal year 1989-90, the County shall adopt a revised Road
Impact Fee Ordinance requiring the same level of service standard as
adopted in Policy 1.1.5 of this element in order to assess new
development a pro rata share of the costs required to finance
transportation improvements necessitated by such development.
Policy 1.2.7:
The County shall continue to collect impact fees for Parks and
Recreation and Library facilities requiring the same level of service
standard as adopted in Policy 1.1.5 of this element in order to assess
new development a pro rata share of the costs required to finance
Parks and Recreation and Library improvements necessitated by such
development.
# Policy 1.2.8:
Prior to fiscal year 1992-93 the County shall adopt a Stormwater Run
off Utility Fee System or alternative revenue source in order to fund
drainage facility improvements.
# Policy 1.2.9~:
The County will issue Revenue Bonds in FY94 and ~YgC secured by a
non-ad valorem covenant to budget and appropriate to fund the revenue
shortfall for County road improvements identified in the Schedule of

OBJECTIVE 1.5:
To ensure that public facilities ,and services needed to support
development are available concurrent with the impacts Of such
development, the County's Concurrency Management System, shal,l be
consistent with Chapter %63° Part_ II, Florida Statutes, and Rule

executed contract which provides for commencement of

REQUIREMENTS FOR CAPITAL IMPROVEMENTS IMPLEMENTATION

The Schedule of Capital I~provements on the following pages will
eliminate existing deficiencies, replace obsolete or worn out
facilities, and make available adequate public facilities for
future growth.
Each project is numbered and named, and its cost during each of the
next five fiscal years is shown in thousands of dollars (000). The

Circulation Element.

In o~der to evaluate ~l~e curren[ level dC service of any s,egment o~
high~ay identi~ied on the Exis[~ng Traffic Circulation Hap, the County
~ill put into place a monitoring program that ~ll[ dete~ine the
existing level dE service o~ those ~oads ~ith special a~tention
~oads tha~ have exceeded their adopted level o~ se~ice standard
during the previous year. It is ~he intention of this program to not
~nly determine i~ a level has been exceeded, bu~ to elso predict
~o~ecast ~hen a level might be exceeded in the ~uture. Such
~onitoring program ~ill permit the proper planning and progta~ing o~
the v4=ious phases of the roadway pro~ects (design, right-of-way
acquisition, permitting and construction).
Honitotinq
~he County ~ill be ~esponsible [or maintaining quarterly 24 ho~
traffic counts on each County ~acility ~or ~hich the =level o~ se~ice
standard is applicable. ~his includes all arterials and collectors
identified in the ~ra~fic Circulation Hap Series (Hap TR-1A). ~he
quarterly counts ~ill be taken in such a manner ~o allo. averaging to
~,eplicate an annual average daily volume. ~he State i:s ~esponsible
~,o~ maintaining an annual count program on all S~ate ~cilities
identi[ied on ~ap ~R-iA (~ and E).
~e peak hour interpretation ~ill be pe~or~ed using the methodology
a~d capacity tables in the ~a[~ic Circulation Element.
p,ea~ hou~ level o~ service ~[ll be compared against the adopted
standard ~esulting in one of the following:
~or Roads with an Adopted LOS of 'mD" standard:
1. If the current ~S measured is "D" or better, no mitigating action
is required.
