Adjourn. 1 June 8. 1999 EXECUTIVE SUMMARY OPINION OF THE OFFICE OF THE COUNTY ATTORNEY REGARDING FLORIDA ETHICS RULES AND APPLICANTS FOR MEMBERSHIP ON THE ENVIRONMENTAL ADVISORY COUNCIL. OBJECTIVE: To inform the Board of County Commissioners about the ethical rules affecting applicants to the Environmental Advisory Council. CONSIDERATIONS: At the August 3, 1999 Board of County Commissioners meeting, the Board requested an opinion from the Office of the County Attorney and/or the Commission on Ethics of the State of Florida as to whether any or all of the applicants for EAC membership were prohibited from service on the EAC by Chapter 112, Florida Statutes, and the conflict rules contained therein. The County Attorney's Office has researched the applicable law and conferred with the staff attorney at the Commission on Ethics regarding this topic. It is the opinion of the Office of the County Attorney that the Florida Ethics Rules contained in Chapter 112, Florida Statutes, do not prohibit the Board of County Commissioners from appointing any of the applicants for membership on the EAC. However, as discussed in the attached memorandum, the applicants have a responsibility to determine if their occupations and/or associations will prevent them from serving on the EAC pursuant to the applicable rules. The applicants will also have a continuing duty to determine if any of the rules would be violated by their activities. In these regards, the Office of the County Attorney had circulated a June 1, 1999 memorandum prepared for then members of the EAC to these new applicants to inform them of the issues and rules affecting their service on the EAC. In addition, the members are always flee to consult with the Office of the County Attorney and/or the Commission on Ethics as specific factual scenarios arise potentially affecting their votes and/or participation on the EAC. FISCAL IMPACT: None. GROWTH MANAGEMENT IMPACT: None. RECOMMENDATION: The Board of County Commissioners may appoint any of the applicants on the list for service on the EAC and it is the duty of the applicants to comply with Sections 112.313(7)(a), and 112.3143(4), Florida Statutes, and all other ethical provisions affecting their service on the EAC. Weigel, County Attorney Date: August 5, 1999 Re: Legal Opinion Regarding Applicants for Service on the Environmental Advisory Council At the August 3, 1999 meeting, the Board of County Commissioners requested that the County Attorney render an opinion as to whether the applicants for membership on the EAC listed in the Executive Summary of Agenda Item No. 10(C) could serve on said Council. It is my opinion that none of the applicants are prohibited from applying and being appointed to the EAC. However, any appointee will be governed by the ethical rules which will be briefly discussed below. Section 112.3143(4), Florida Statutes, prohibits members of advi:s. ory boards from voting on matters which would inure to the special private gain or loss of the applicant, the applicant's principal, relative or business associate. This section also prohibits the advisory board member from participating in any matter of that nature unless the applicant first makes disclosures as outlined in the statute. Section 112.313(7)(a), Florida Statutes, prohibits conflicting employment or contractual relationships. Under this section of the statute, a member of the EAC cannot bring before that Council any petition involving the member's principal or a person or entity whom the member or the member's principal represents. The last clause of section (7)(a) of the statute also prohibits employment or contractual relationships that would "impede the full and faithful discharge of his or her public duties." August 5, 1999 Page 2 It is important to emphasize that the Chapter 112 provisions mentioned above deal with economic gain or loss as opposed to philosophical interests that an applicant may have regarding EAC matters. It is nearly impossible to judge, in advance, on the basis of a resume whether applicants will have either the Section 112.3 13(7)(a) or Section 112.3143(4) conflicts. It is my opinion that the Board can appoint any of the applicants and it will then be incumbent upon the applicants to comply with the appropriate rules regarding voting conflicts and conflicting employment or contractual relationships. It appears that the subject matter of the EAC is broad enough that although any of these applicants may have isolated conflicts, they would not have the type of recurring conflict contemplated in 112.313(7)(a), Florida Statutes. If the facts ~vere to develop to the contrary, then that member would be required to resign from the Counsel to avoid violating 112.313(7)(a), Florida Statutes. CONSIDERATIONS: The Environmental Advisory Council has 5 vacancies due to resignations. This 9 member council acts in an advisory capacity to the Board in matters dealing with the regulation, control, management, use or exploitation of any or all natural resources within the County, and the review of all land development petitions which require an environmental impact statement (EIS) per section 3.8 of the Code, all developments of regional impact (DR.I), lands with special treatment (ST) or Area of Critical State Concern/Special Treatment zoning overlays, areas of the county covered by interlocal agreements, any petitions which carmot be resolved between the applicant and staff. The membership will include technical and non-technical members. Technical members shall demonstrate evidence of expertise in one or more of the following areas related to environmental protection and natural resources management: Air Quality, Biology (including any of the sub-disciplines such as botany, ecology, zoology, etc.), Coastal Processes, Estuarine Processes. Hazardous Waste, Hydrogeology, Hydrology, Hydraulics, Land Use Law, Land Use Planning, Pollution Control, Solid Waste, Stormwater Management, Water Resources, Wildlife Management, or other representative areas deemed appropriate by the Board such as, but not limited to, a representative of the development community. Members are required to file a Form 1 Statement of Financial Interest each year with the Supervisor of Elections. After initial appointments, terms are 4 years. Cautero, AICP, Administrator Community Development and Environmental Services Division SUBJECT: EAC Applicants Staff has reviewed the ten applicants for the five open positions on the EAC and finds they are all qua!ified to fill the vacancies. It appears that two of the applicants have job descriptions similar to the five EAC members that recently resigned due to a conflict of interest. Those applicants are James L. McVey and Thomas Masters. Copies of their applications were sent to the County Attomey"s Of'rice for review. You may wish to contact Ramiro Manalich regarding these applicants and ask that their ofiqce call them to discuss the potential for a conflict of interest. The four EAC members remaining on the Council include 2 Professional Engineers, 1 Ph.D. Limnologist, and 1 Developer (President of Grey Oaks). Seven of the ten new applicants have technical expertise. They are: 1 Biologist, 1 Professional Geologist, 1 Professional Engineer, 1 Environmental Lawyer and 3 Lawyers with land use experience, The non-technical applicants are: 1 FinanciaI Planner, 1 Media/Legislative liaison, and 1 Builder (general contractor). He enlisted in the Marine Corps in 1966, graduated from Boot Camp and was assigned to Camp Lejeune, N.C. After several promotions and cruises aboard Navy Ships, he was selected to attend Officer's Candidate School and graduated in 1967. Following completion of the Basic Officers School at Quantico, V.A., he was assigned. as an Infantry Platoon Commander with 1st Battalion, 7th Marines, Republic of Vietnam in Jan 1968. Tours of duty included Company Commander, Executive Officer and various staff positions. Upon his return to the USA in February 1969, he w~s assigned as a Company Commander with 2nd Bn 28th Marines at Camp Pendleton, Ca. In 1970, he was selected to complete his degree at Texas AaM University and graduated in 1971. Transferred to Quantico, Va., captain coe became a Company Commander at Officers Candidate School and subsequently attended Amphibious Warfare School. Captain Coe later served as the Commanding Officer, Marine Detachment USS Forrestal (CVA59) from 1972-1974 and then was reassigned as a recruit Commander at Parris Island, S.C. Promoted to Major in 1978, he w~s assigned to Language School Motterry, Ca!if and on to Thailand as the Marine Advisor to the Thai Marine Corps. He was the first US Marine to attend the Thai Parachute Course and subsequently earned his Navy/Marine Parachute wings at age 36. He returned to Camp Lejeune, N.C. and served as the Executive Officer and Commanding Officer of 2nd'Reconnaissance Battalion prior to promotion to Lieutenant Colonel in 1981. After over 15 years as a Commander, he was assigned ~8 staff position with 2nd Marine Division and sent to Norwegian Ski Schooi and Cold weather training at age 38. Lieutenant Colonel Coe w~s then sent in 1983 to the European Command as a Liaison Officer with the Multinational Forces where he worked with the American Embassy Staff, Ambassador Habib, and the international community during the Israe!i-Palestinian-Lebanese-Syrian Crisis. He was in the American Embassy when it was bombed in April 1983, and subsequently returned to Camp Lejeune where he completed his tour as Executive Officer, Infantry Training School and a member of the General Staff. He retired in February, 1989 with 23 Years of service. I am an "average" person. I am not a developer or large landowner. I work in a white collar capacity as an office manger. Educationally I am a graduate of Miami Dade Community College, with AA degrees in History and English. I have had continuing education with the Federal Highway Administration, for Bridge Inspection, both In- Service and Construction. At one time, I was certified as an Emergency Medical Teci~n~ciar~. And presently t am CerLified by ASE as an Auto Parts Specialist. I believe that there should be a balance struck between growth and preservation. I do not believe that every proposal brought forth by either developer or "environmentalist" is a good idea. Some of the environmental proposals I have heard violate Constitutional protections, and some proposals from developers offend good sense. I believe I can advise Collier County in its environmental decisions by bringing a moderate influence to the board. After gaining field experience as field engineer and assis'rant superintendent, he was moved to the office to take on estimating and project management duties. Projects James worked on included office buildings, retail facilities such as shopping centers, industrial projects, medical facilities, etc. James left Tribble and Stephens in 1985 as a vice president to join the development firm of Birtcher Wadsworth. As Vice President of Construction. James developed the constrnction department to complete the projects initiated by the dcvclopment side of the company. In 1987, James accepted a position as project manager/estimator for Pointe Builders of San Diego, California. Some of James' major projects included a community shopping center, a 179 room Best Western Motel and the Solona Beach Inn Suites project After San Dic~o, James ~vorked as a project manager/estimator for Boran Craig Barber Cons~truction Co. of Naples. Florida from 1989 to 1995. He constrncted retail and medical, office buildings and condominium projects up to 30 million dollars in contract value. In 1995 James joined forces with Todd Gates to form the General Contracting firm of Gates McVey Builders. Inc. In a short 4 year period this company has grown to become the premier construction company in south~'est Florida.
