Contract Addendum #2 NEIGHBORHOOD STABILIZATION PROGRAM Property Address: 475 Golden Gate Boulevard East Folio Number: 37285360004 ADDENDUM #2 TO CONTRACT OF SALE BETWEEN THE UNDERSIGNED PARTIES CONCERNING THE PROPERTY AT 475 GOLDEN GATE BOULEVARD EAST. NAPLES. FL 34120 THIS ADDENDUM is entered into by and between FEDERAL HOME LOAN MORTGAGE CORPORATION, Seller, and COLLIER COUNTY, a Political Subdivision of the State of Florida, Purchaser. Purchaser and Seller have entered into that certain Contract of Sale concerning the property at 475 Golden Gate Boulevard East (hereinafter referred to as "Property"), and Addendum #1 to Contract of Sale, both dated of even date herewith, and Purchaser and Seller wish to amend the foregoing with the following additional terms and conditions: 1. The Contract of Sale, the Addendum #1 to Contract of Sale, and this Addendum #2 to Contract of Sale shall, collectively, constitute the "Agreement" between the parties, which Agreement shall only be effective upon the execution of all three referenced documents by both parties. 2. The first paragraph of Addendum #1 to Contract of Sale is revised to reflect that the date of the Agreement shall be the date upon which all three instruments constituting the Agreement have been executed by the last one of the Purchaser and Seller to sign, and is further revised to reflect that Purchaser is Collier County, a Political Subdivision of the State of Florida, and any requirements for initials or handwritten entries are waived. 3. Paragraph 2 of Addendum #1 to Contract of Sale is revised to reflect that the only deed acceptable for conveyance shall be a Special Warranty Deed. 4. Paragraph 4 of Addendum #1 to Contract of Sale is revised to reflect that Closing shall occur on or before March 26, 2010, and is further revised to reflect that $0.00 per diem shall be paid in the event of a written extension. 5. Paragraph 18 of Addendum #1 to Contract of Sale is revised to reflect that Purchaser is also exempt from payment of state taxes and tax stamps on deeds and that therefore no such taxes will be payable as a result of this transaction. 6. Paragraph 19 of Addendum #1 to Contract of Sale is deleted in its entirety. 7. Paragraph 20 of Addendum #1 to Contract of Sale is revised to reflect that Seller may also not 3ssign the contract without express written consent of Purchaser. 8. The Seller and Purchaser signature blocks on Page 7 of 7 of Addendum #1 to Contract of Sale shall be deleted and replaced by the notation "See Following Substitute Signature Page." 9. The Commission Authorization for Selling Broker attached to Addendum #1 to Contract of Sale is not applicable, and is deleted in its entirety, and any requirements for signatures or handwritten entries are waived. 10. The first paragraph of the Property Condition Addendum and Release attached to Addendum #1 to Contract of Sale is revised to reflect that the date of the Property Condition Addendum and Release shall be the oate upon which said Addendum is executed by the last one of the Purchaser and Seller to sign. 11. The Seller and Purchaser signature blocks on the Property Condition Addendum and Release attached to Addendum #1 to Contract of Sale shall be deleted and replaced by the notation "See Following Substitute Signature Page." 12. The requirements for initials by both Purchaser and Seller at the bottoms of Page 1 of 7 through Page 7 of 7 are waived in their entirety.
