UNINCORPORATED AREA OF COLLIER COUNTY,
FLORIDA, BY AMENDING THE OFFICIAL ZONING
ATLAS MAP NUMBER 7904N BY CHANGING THE
ZONING CLASSIFICATION OF THE HEREIN
DESCRIBED PROPERTY LOCATED ON THE
SOUTHWEST CORNER OF SEVENTH STREET AND
SECOND AVENUE, IMMOKALEE, FLORIDA, IN
SECTION 4, TOWNSHIP 47 SOUTH, RANGE 29
EAST, COLLIER COUNTY, FLORIDA, FROM C-4
TO MH FOR A MOBILE HOME PARK; PROVIDING
FOR STAFF AND PLANNING COMMISSION
STIPULATIONS; AND BY PROVIDING AN
EFFECTIVE DATE.
WHEREAS, David S. Wilkison of Wilkison & Associates,
Inc., representing Cleveland A. Blocker, petitioned the Board
of County Commissioners to change the zoning classification
of the herein described real property;
NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA:
The Zoning Classification of the herein described real
property located in Section 4, Township 47 South, Range 29
East, Collier County, Florida, is changed from C-4 to MH, and
the Official Zoning Atlas Map Number 7904N, as described in
Ordinance 91-102, the Collier County Land Development Code,
is hereby amended accordingly:
Lots 26 thru 32, Block A, of Joyce Park Subdivision,
as recorded in Plat Book 2, Page 101, of the Public
Records of Collier County, Florida,
be and the same for which the rezone is hereby approved
subject to the following conditions:
a. The existing non-conforming single-family home
shown on the plan shall not be reconstructed
in the event such non-conforming structure or
non-conforming portion of the structure is
destroyed by any means to an extent of more
than fifty percent of its actual replacement
cost at time of destruction, as determined by
a cost-estimate submitted to the Site
Development Review Director, per Section.
1.8.10.2 of the Collier County Land
Development Code.
b. The developer shall be responsible for a fair
share contribution towards sidewalks/bike
paths on abutting roadways (Second Avenue and
Seventh Street). Such contribution shall be
determined by the Collier County Transporta-
tion Services Division and shall become due
and payable at such time as a community
sidewalk/bike path program is implemented.
c. The developer shall install individual
driveway pipes such that no hindrance to
runoff flow is created. Additionally, water
management planning shall include confirmation
of positive outfall and the capacity thereof.
d. Road impact fees shall apply in accordance
with the applicable fee schedule set forth in
Ordinance 92-22, as amended.
SECTION TWO:
This Ordinance shall become effective upon receipt of
notice from the Secretary of State that this Ordinance has
been filed with the Secretary of State.
PASSED AND DULY ADOPTED by the Board of County
Commissioners of Collier County, Florida, this 13th day of
