PROVIDING FOR CONFLICT AND SEVERABILITY;
PROVIDING FOR INCLUSION IN THE CODE OF LAWS AND
ORDINANCES OF COLLIER COUNTy; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the Marco Water and Sewer District provides sewer
services to certain areas of Marco Island that are not served b~
Southern States Utilities; and
WHEREAS, the treatment facilities are o~lled by Southern
States Utilities and the Marco Water and Sewer District is billed
by a bulk sewage treatment agreement with Southern States
Utilities; and
W~IEREAS, Southern States Utilities has implemented four
separate rate increases for bulk sewage treatment since the Marco
Water and Sewer District's last rate increase in January, 1989;
and
WHEREAS, the Boar~ of County Commissioners as the governing
body of Collier County and as Ex-Officio the Governing Board of

the Marco Water and Sewer District has determined that the monthly
sewer rates within the Marco Water and Sewer District shall be
increased thirty-eight percent (38%) the first year and thirty
percent (30%) the second year to offset the operating and
maintenance costs within the District.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, AS EX-OFFICIO THE
GOVERNING BOARD OF THE MARCO WATER AND SEWER DISTRICT OF COLLIER
COUNt, FLORIDA, that=
SECTION ONE. Amendments to Section 5 of Collier County Ordinance
}Io. 83-39/Resolution No. MWS-83-1, as amended.
Section 5 of Collier County Ordinance No. 83-39/Resolution
No. NW8-83-1 as amended, is hereby amended to read as follows:
Section 5. Rates.
The monthly user rate will be:
1) Residential
Single family residences, multi-family
residences, apartment residences,
mobile home residences:
I Each one bath living unit ~ $17.11 S20.83
Each additional bath per
living unit ~ S 3.80 $ 4.62
2) Non-Residential
Each facility shall be billed
based upon the total of the
following units contained
therein.
a) Hotel, motel and trailer
rental units:

SECTION TWO. Conflict and Severability
The provisions of this Ordinance shall be liberally construed
to effectively carry out its purposes in the interest of public
health, safety, welfare, and convenience. If any section, phrase,
sentence or portion of this Ordinance is for any reason held
invalid or unconstitutional b~ any court of competent
Jurisdiction, such portion shall be deemed a separate, distinc~,
and independent provision, and such holding shall not affect the
validity of the remaining portions thereof.
SECTION SEE. Inclusion in the Code of Laws and Ordinances.
The provisions of this Ordinance shall become and be made a
part of the Code of Laws and Ordinances of Collier County,
Florida. The sections of the Ordinance may be tenumbered or
relettered to accomplish such, and the word "ordinancem may be
changed to "sectiona, ~artiole", or any other appropriate word.
SECTION FOUR. Effective Date.
This Ordinance shall become effective upon filing this
Ordinance with the Department of State.
