Ordinance 95-06 ORDZNANCE NO 95 6 AH ORDZHANCE M4ENDZNO TH~ CO~ZER COUNTY ORDZNANC~ ~-- RO. 94-26, ~ZRG ~[ CO~Z[R COUNT~ COUNCZ~ O~- O~ZC~; QUOR~; RU~S OF PROCEDURE; PROV~DZZI~ FOR CONFLI~ AND S~BILITY; PROVIDING FOR IN~SION IN THE CODE OF ~WS AND ORDINANCES; AND PROVIDING AN EFFE~IVE DATE. ~R~S, the Board of County Co~issioners adopted Collier County Ordinance No. 94-26, creating the Collier County Council of ~on~ic Advisors on May 10, 1994 to assist in the estab- lishment, review and enhancement of policies, programs and plans to increase and promote economic vitality and economic o~rtunities that are compatible with the quality of life in Collier County; and ~S, Ordinance No. 94-~, as enacted, provides for a C~ncil c~osi~ion of nine (9) regular members and a maximum of three (3) non-voting alternate members; and ~~, the appointed mem~rs of the Council and the Board of County Couissioners have detemined that it is preferable and in the public interest for all twelve (12) ap~inted mem~rs to the Council to be re~lar, voting members, with no provision for alternate, non-voting members. NOW, ~EFORE, BE IT ORDAINED BY ~E BOARD OF CO~Y ~ISSIONRS OF COLLIR COUNTY, F~RIDA, that: 8E~ION O~{ ~MM TO SE~ION UO OF COLLI~ CO~Y ORDXM~C{ NO. 94-~. Section ~o of Collier County Ordinance No. 94-26 is hereby amended to read as follows: SE~ION ~O. APPOIN~M AND COMPOSITION. C. Appointment of members to the Council shall be by resolution of the Board of County Commissioners and such Resolution shall set forth the date of appointment and the term of office of each member. SF~'rIONTWOz M~ZNDNZ~[T TO SECTION THREE OF COLLIER COUNTY ORDINXNCE NO. 94-26. Section Three of Collier County Ordinance No. 94-26 is hereby amended to read as follows: SECTION THREE. TERMS OF OFFICE. The initial terms of office of the Council members shall be as follows: A. ~ +9+ Four~4~ members to serve for two (2) years. B. ~ +a+ F_g&LL_L~ members to serve for three (3) years. Appointments to fill any vacancies on the Council shall be for the remainder of the unexpired term of office. SECTION TMIE!, ~MZ~DMMMT TO SECTION FIVE OF COLLIER COUNTY O~DIFANCE NO. ~4-2S. Section Five of Collier County Ordinance No. 94-26 is hereby amended to read as follows: SECTION FIVE. OFFICERS; QUORUM; RULES OF PROCEDURE. A. Annually the membership of the Council shall elect a chairman and vice chairman from among the ~cgular members. -2- Words ~ are added; words eee~e~--t~ouzf~ are deleted. Officers' terms shall be for one (1) year with eligibility for re-election. B. The presence of f~v: e~ seven (71 or more r:gular members shall constitute a quorum. A majority vote of those regular members present is necessary to take action and transact business. C. The Council shall, by majority vote of the entire ~ membership, adopt rules of procedure for the transaction of business and shall keep a written record of meetings, resolutions, findings and determinations. Copies of all Council minutes, resolutions, reports, and exhibits shall be submitted to the Board of County Commissioners. D. Clerical and reasonable staff support shall be provided by the County Administrator's Office. The County Administrator shall also designate, from the County Administrator's Staff, one or more staff member(s) to act as liaison to the Collier County Council of Economic Advisors. 8ECTIO!IFOURx COlrFLICT AND SEVERABILITY. In the event this Ordinance conflicts with any other ordinance of Collier County or other applicable law, the more restrictive shall apply. If any phrase or portion of this Ordinance is held invalid or unconstitutional by any court of .. competent Jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion. SECTION FIVEI INCLUSION IN THE COD~ OF LAWS AND ORDINANCES. The provisions of this Ordinance shall become and be made a part of the Code of Laws and Ordinances of Collier County, Florida. The sections of the Ordinance may be tenumbered or relettered to accomplish such, and the word "ordinance" may be changed to "section", "article", or any other appropriate word. SECTION silt EFFECTIVE DATE.
