representing SouthWest Professional }{ealth Park Land Trust, petitioned
the Board of Counts Commissioners to change the zoning classification
of the herein described real property;
NOW THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY COM]{ISSIONERS
OF COLLIER COUNTY, FLORIDA;
The Zoning Classification of the herein described real property
located in Section 26, To~u~ship 48 South, Range 25 East, Collier
County, Florida, is changed from "PUD" to "PUD" Planned Unit
Development in accordance with the PUD Document, attached hereto as
Exhibit "A", which is incorporated herein and by reference made part
hereof. The Official Zoning Atlas Map Numbered S526N, as described in
Ordinance Number 91-102, the Collier County Land Development Code, is
hereby amended accordingly.
Ordinance Number 89-74, as amended, kno~n~ as the Southwest
Professi)nal Health Park PUD, adopted on November 14, 1989 by the Board
of County Commissioners of Collier County, is hereby repealed in its
entirety.

STATEMENT OF COMPLIANCE
This project is in compliance with az goals and objeczives of the Growth Management
Plan as defined by the Future Land Use Element. The Future Land Use clement designates
the subject area as an =Urban Residential Area" and further provides that non-residential
uses including community service facilitics of tl~ type proposed by this re-zone p.'tition are
to be allow~d based upon certain geographic relationships to other community service
facilities. Permitted uses also inclu~ support medical facilities provided they are with 1/4
mile of hospitals or major treatment centers. T!~ Southwest Professional Health Park
PUD will be located approximately !,000 feet east of the Collier Health Center while the
proposed uses arc medically related.

SECTION II
PROJECT DEVELOPMENT
2.1 General
2. I. 1 Regulations for development of Southwest Professional Health Park shall
be in accordance with the content of this P.U.D. Ordinance, the PUD-
Planned Unit Development District and other applicable sections and parts
of the Collier County Land DevoUt Code and Grov~h Management
Plan in effect at the time of building permit application. Wher~ these
regulations fail to provide dewlopmental standards, then the provisions of
the most similar dislrict in the County Land Development Code shall
apply.
2. 1.2 Unless otherwise noted, the definitions of all terms shah be the same as
the definitions set forth in the Collier County Land Development Code in
effect at the lime of building permit application.
2.1.3 All conditions imposed and all graphic material presented depicting
e restrictiett~ for the development of the Southwest Professional Health Park
shall become part of the t~lulations which govern the matmet in which the
' PUD site may be developed.
2. 1.4 Unless modified, waived or excepted by this PUD, the provisions of the
Land Development Codes, where applicable, remain in full force and
, effect with respect to the development of the las~l which comprises this
PUD.
2.1 ..~ Development permitted by the approval of this petition will be subject to a
concurrency review under the ptovislo~s of Division 3.1:5, Adequate
Public Facilities, at the earliest or next to occur of either final SDP
approval, final plat approval, or building permit issuance applicable to
this development.
2.2 Project Development Plan and Land Use
2.2.1 Land uses permitted in this PUD shall be distributed on the prolx'~ as
described in this document, on the land use tracts depicted by Exhibit
the Southwest Professional Health Park PUD Master Plan.
2.2.2 Ea~-ments (utility, drainage, private, ere.} shall be emblisbed as
necessary or deemed desirable to serve the project.
2.2.3 Any variation from the adopted PUD Master Plan shall be reviewed under
the provisions of Section 2.7.3.5. of the Collier County Land
Development Code.
2.3 Project Plan Approval
Final plans of the site improvements shall receive the approval of all apprc~ria~
Collier County and governmental agencies to insure compliance with Exhibit "A",
PUD Master Plan, the Collier County Land Development Code and the platting
laws and utility regulations.
The Southwest Professional Health Park PUD Mas~r Plan, Exhibit "A",
constitutes the required PUD Master Plan.

2.4 Project Phasing
Project phasing will be dictated by market response.
2.5 Project Plan Approval Requirements
Prior to t~ recording the Record Plat, final plans of the required improvements
shall receive the approval of all appropriate Collier County gove~tal agencies
to insure complianc.~ with the P.U.D. Master Plan, tl~ Prelimina~ Subdivision

classified as medical or medical orientated such as doctors, dentists,

GENERAL DEVELOPMENT COMMITMENTS

and local laws, codes and regulations.

4.3 XMater Management Stipulations
I.' Detailed paving. grading and site drainage shall be submitted to Project
Review Services for review. No construction permits shall be issued
unless and until approval of the proposed construction in accordance with
the submitted plans is granted by Project Review Services.
2.. An excavation permit will be required for the propogd lake in accordance
with the Collier County Land Development Code and SFWMD rules.
4.4 Utilities Stipulations
I. Water distribution, sewage collection and transmission and interim water
and/or se~,,~ge treatment facilities to serve the project arc to be ticsigned,
constructcs:l, conveyed, owned and maintained in accordance with Collier
County Ordinance No q-76, as amended, and other applicable County
Rules and regulations.
2. All customers connecting to dg water distribution and sewage collection
facilities to be constructed will be customers of th~ County and will be
billed by the County in accordance with tl~ County's established rates.
Should the County not be in a position to provide water and/or sewer
service the project, the water and/or sewer customers shall be customers
of the interim utility established to serv~ the project until the County's off-
site water and/or sewer facilitics are available to serve the project.
3. It is anticipated that the County Utilities Division will ultimately supply

the sewage generated by this project. Should the County system not be in
a position to supply potable water the project and/or m:civc the projcct's
wastempter at the time development commcnces, the Developer, at this
expense, will install and operate interim water supply and on-site
treatment facilities and/or interim on-site sewage treatment and dislx~al
facilities adequate to meet all rcqulrcraents of the appropriate feudatory
agencies. An agreement shall be entered into between the County and the
Developer, binding on the Developer, his assigns or successors regarding
any interim treatment facilities to be utilized. Th~ agreement must be
legally sufficient to tha County, pri~r to the approval of construction
documents for the project and be in conformance with the rccluircments of
the Collier County Land Dcvclopmcnt Code.

4.~ Solid Wasw Manage·mr
Solid waste managcmc~t shall be assigned to · CounD/franchiscd hauler
who sMll be responsible for the collection and disposal of all solid waste
generated by this develop·cat.
4.6 Environmental Stipulations
I.. Petitioner shall preserve the small oak/cabbage palm hammock located in
the northeast comer of the propcrD/and shall adjust the site plans
accordingly. The hammock area shall be labelcd as aprcscrvc on all
subsequent site plans.
2. The Petitioner shall design the lake to the minimum size ncccssa n/to
comply with water marsager·mr requiremeals.
3. Environmental permitting shall be in accordance with the State of Florida
Environmental Resource Permit Rulcs, and be subject to review and
approval by Current Planning Environmental Rcvicw Staff. RcTnoval of
exotic vcgctation alone shall not be the sole component of mitigation for
impacts to Collicr County jurisdictional well·ads.
4. All conservation areas shall be designated ms conservation/preservation
tracts or casctncnLs on ·11 construction plans and shall be recorded on the
plat with protcctiv= covenants per. or similar to, Scction 704.06 of the
Florida Statutcs.
5. Buffers shall be provided around wetlands, where possible, extending at
least fitteen (15) fcct landward from Ihc edge of v~-tland prcscn, cs in all
places, and an average oftwent'y-five (25} fca from the landward edge of
wetlands. Whcrc natural buffers arc not possible, strudural butTcts shall
be provided in accordance with the State of Florida Envirowncntal Permit
Rulcs. and be subject to review and approval by Current Planning
Environmcntal Review Staff.
6. Pctitioncr shall comply with the gugdclincs and recommendations of the
Florida Game and Fresh Water Fish Commission (FGFWFC} regarding
potential impacts to protectcol wildlifL specics.
