WHEREAll, =he Naples Heritage Comnmnity Development District
was established on September 24, 1996, by Ordinance No. 96-57
which became effective on October 1, 1996; and
W/FERZAS, the Board of Supervisors of the Naples Heritage
Community DevelopmetE District (*District*) has requested the
consent of Collier County to exercise certain additional special
[x~wers pursuant to Section 190.012(2), Florida Statutes; and
WHIMlAB, tpe District's Board of Supervisors has requested
that Collier C~unty consent to ~he exercise of special powers
relating to parks and recreation and security; and
WHEREAS, Collier County has reviewed the District Board of
Supervisors' request at a public hearing.
NOW, THXREFORE, BE IT OKDAINED BY THE BOARD OF COUNTY
COMMISSIONlit8 01~ COLI~IIll COUNTY, FLORIDA thats
SECTION OWZs A new section shall be added to Collier County
Ordinance No. 96-57 and will read as follows:

Consent to exercise the above ~rs by the Board of ~gunty
e Commissioners in no way implies that Collier County has any
obligation or responsibility to ensure that these special Dowers
are exercised by the District nor any liability in regards to the
District's exercise of these special Dowers.
SECTION TWOs CONFLICT AND SEVERA~ILITY
In the event this Ordinance conflicts with any other ordinance
of Collier County or other applicable law, the more restrictive
shall apply. Jf any phrase or ~ortion of this Ordinance is held
invalid or unconstitutional by any court of competent Jurisdiction,
such portion shall be deemed a separate, distinct, and independent
provision and such holding shall not affect the validity of the
remaining portion.
SECTION TBREZs INCLUSION IN T~[ CODE OF LAWS AND OEDINANCES
The provisions of this Ordinance shall become and be made a
part of the C~% of Laws and Ordinances of Collier County. Florida.
The sections of the Ordinance may be fenumbered or relettered to
accomplish such, and the word 'ordinance" may be changed to
'section', 'article', or any other appropriate word.
BZCTZON FOU]~s EFFECTIVE DATE
This Ordinance shall become effective upon receipt o[ notice
from the Secretary of State that this Ordinance has been filed with
the Secretary of State.
