WHEREAS, on May 14, 1996 the Board of County Commissioners
heard a presentation by a committee organized by State
Representative Burt L. Saunders for obtaining funding to acquire
land primarily in and around the urban areas of Collier County to
preserve as green space; and
WHEREAS, the land to be acquired would be for the purposes as
set forth in Sestion 212.055(2), Florida Statutes, to preserve the
biodiversity, air and water quality, groundwater recharge, flood
control, aesthetics, providing passive recreation areas and
density reduction; and
WHEREAS, the purpose of preserving the green space is to
maintain and enhance the quality of life in Collier County; and
WHEREAS, the Board of County Commissioners has determined
that a one-half of one percent discretionary sales surtax may be
the appropriate funding source for acquiring laa~d~a for green
space; and
WHEREAS, the Board of County Commissioners on June 25, 1996
adopted Collier County Ordinance No. 96-34 providing for the
creation of the Land Acquisition Advisory Board to provide
recommendations to the Board of County Commissioners on the
rankings of sites to be acquired, specific site assessments, and
to prepare a budget for the capital expenditures of the funds
collected by the one-half of one percent surtax for a four (4)
year period commencing February 1, 1997 and ending on January 31,
2001; and
WHEREAS, the ballot question provides for the purchase of
lands primarily in and around the urban areas of Collier County;
and
WHEREAS, it is the intention of the Board of County
Commissioners that no parcel of land shall be considered for
acquisition by the Land Acquisition Advisory Board or the Board of
County Commissioners unless at least 50% of said parcel lies
within the urban areas of Collier County as defined in Collier
County Ordinance No. 96-34; and
WHEREAS, it is the intention of the Board of County
Commissioners to retain title to lands acquired in perpetuity to
maintain and enhance the quality of life in Collier County; and
WHEREAS, it is the intention of the Board of County
Commissioners to provide adequate staff support to ensure the
acquisition of lands pursuant to the procedures and criteria
established herein for the purposes provided in the ballot
question and the provisions of Collier County Ordinance No. 96.-34;
and
WHEREAS, Collier County Ordinance No. 86-41, as amended, sets
forth the requirements for creating County advisory boards; and
WHEREAS, it is the intention of the Board of County
Commissioners that this Ordinance shall become effective only if
the one-half of one percent Local Government Infrastructure
Discretionary Sales Surtax as set forth in collier county
Ordinance No. 96-34 to fund the acquisition of land as green space
is approved by the qualified electors of Collier County voting in
a referendum election on November 5, 1996 as provided in
Resolution No. 96-302; and
WHEREAS, it is the intent of the Board of County
Commissioners that the Nap].es City Council: (1) enact enabling
ordinance(s) to implement the land acquisition program utilizing

the same criteria and procedures attached hereto; and (2) create a
City of Naples Land Acquisition Advisory Board with the same
qualifications. for membership as contained herein for the
expenditure of the City of Naples' portion of the surtax as
provided by Section 212.062, Florida Statutes or interlocal
agreement pursuant to Section 212.055, Florida Statutes.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
CO~4ISSIONERS OF COLLIER COUNTY, FIX)RIDA, that:
SECTION ONE. .Findings and Determinations.
1) All properties purchased by the County through the
procedures and criteria adopted herein shall be held by the County
in perpetuity for the purposes as described herein, as set forth
in Section 212.055(2), Florida Statutes, and Collier County
Ordinance No. 96-34.
2) Properties purchased through the procedures and criteria
established herein shall be used in supplementation to and not in
substitution of other land or facility acquisitions which may be
required by federal, state, or local laws or regulations, ',
including the Collier County Comprehensive Plan requirements for
parks and recreation.
3) Properties purchased through the procedures and criteria
established herein shall not be used in whole or in part for any
federal, state or local required environmental mitigation for any
public or private works or construction projects.
4) Once a determination has been made to acquire lands
pursuant to this program, the Board of County Commissioners shall:
a) provide appropriate staff support to ensure that all the
procedures and criteria contained herein are followed; b) ensure
that all applicable laws and regulations pertaining to the
acquisition of real property are followed; and c) negotiate and
close all purchase transactions in accordance with applicable laws
and regulations. Title to all lands acquired by Collier County
shall be held for the purposes provided herein in the name of

Collier County, Florida, or in the name of the City of Naples for
lands purchased by the City of Naples if the Naples City Council
adopts enabling ordinance(s) to implement the land acquisition
program. The City of Naples may create its own land acquisition
advisory board or enter into an interlocal agreement to implement
the City of Naples' program.
5) Any of the lands acquired pursuant to the procedures and
criteria contained heroin, in any manner, shall not be used as any
part of any transfer of development rights program now in effect
or enacted and implemented in the future.
SECTION TWO. Creation of the Land Acquisition Advisory Board.
The Land Acquisition Advisory Board is hereby created to
meet, receive and review information relating to land acquisition
pursuant to Section 212.055(2), Florida Statutes, and the
procedures and criteria contained heroin, and Collier County
Ordinance No. 96-34. Said Board shall provide reports and
recommendations to the Board of County Commissioners on the
rankings of sites to be acquired. The Land Acquisition Advisory
Board shall prepare an annual budget for the capital expenditures
of the funds collected by the one-half of one percent surtax for a
four (4) year period commencing February 1, 1997 and ending on
January 31, 2001 as set forth in Collier County Ordinance No.
96-34. The Board shall further prepare annual budgets for the
expenditures of all funds collected pursuant to Collier County
Ordinance No. 96-34 that have not been expended for each
subsequent year after collection of the one-half'of one percent
surtax has been terminated.
SECTION THREE. Appointment and Composition.
A. The Land Acquisition Advisory Board shall be composed of
fifteen (15) voting members, with representatives of the following
professions or groups with the following qualifications:
Biologist - one appointee - A practicing professional
biologist with a minimum of a BA/BS in the biological
sciences from an accredited university. Advanced degree
preferred and with five years of work experience as a

biologist.
Ecologirst - one appointee - a practicing professional
ecologist or environmental scientist with a minimum of a
BA/BS in the biological sciences/ecology/environmental
sciences from an accredited university. Advanced degree
preferred and with five years of work experience as an
ecologist or environmental scientist.
Realtor - one appointee - Florida licensed real estate broker
with 5 'years of work experience as a Florida Licensed Real
Estate Broker.
Attorney - one appointee - JD from an accredited university
and licensed by the Florida Bar with 5 years experience as an
attorney.
Water Resources Specialist - one appointee - A practicing
professional hydrologist or civil engineer or environmental
engineer or aquatic ecologist with a minimum of a BA/BS in
the appropriate university discipline and a specialty in
water resources management from an accredited university.
Advanced degree preferred with five years of work experience
as a water resources specialist.
Engineer - one appointee - A practicing professional engineer
(licensed PE) with a minimum of a BA/BS in engineering with
civil or environmental engineering preferred from an
accredited university. Advanced degree preferred with five
years of work experience as an engineer.
Land Use Planner - one appointee - A practicing professional
land use planner with an advanced degree preferred in urban
or land use planning from an accredited university. With ,,
five years of work experience as a planner and member of
American Institute of Certified Planners.
Landscape Architect - one appointee - A practicing landscape
architect with an advanced degree preferred in landscape
architect from an accredited university. With five years of
work experience as a Landscape Architect and a member of the
American Society of Landscape Architects.
Environmentalists - two appointees - Members in good standing
of local or regional environmental organizations.
One citizen at Large from each of the five Collier County
Commission Districts.
The Board of County Commissioners may appoint as non-voting
members, representatives of the City and County Government as
deemed appropriate by the Board of County Commissioners. No
elected official shall be appointed to the Land Acquisition
Advisory Board.
B. Members of the Land Acquisition Advisory Board shall
serve at the pleasure of the Board of County Commissioners. Said
members sha].l be permanent residents and electors of Collier
County.

C. Appointment of members to the Land Acquisition Advisory
Board shall be by resolution of the Board of County Commissioners
which resolu~:ion shall set forth the date of appointment and the
term of office.
SECTION FOUR, Terms of Office.
The initial terms of office of the Land Acquisition Advisecry
Board member~ shall be as follows:
A. Four (4) members for one (1) year.
B. Four' (4) members for two (2) years.
C. Four' (4) members for three (3) years.
D. Three (3) members for four (4) years.
Thereafter, each appointment or re-appointement shall be for
a term of four (4) years. Appointments to fill any vacancies on
the Land Acquisition Advisory Board shall be for the remainder of
the unexpired term of office.
SECTION FIVE. Removal From Office~ Failure to Attend Meetingss.
A. Any member of the Land Acquisition Advisory Board may be
removed from office, with or without cause, by a majority vote
the Board of County Commissioners.
B. In the event that any Advisory Board member is absent
from two (2) consecutive Advisory Board meetings without a
satisfactory excuse acceptable to the Advisory Board Chairman, the
Advisory Boar~J Chairman shall state such fact at the next
regularly scheduled Advisory Board meeting and shall thereafter
notify, in writing, the Administrative Assistant to the Board of
County Commissioners of the Advisory Board member's failure to
attend without satisfactory excuse. The Board of County
Commissioners shall review the Advisory Board Chairman's
notification ~Lt a County Commission meeting, and ~hall declare the
Advisory Board member's position to be vacant if the Commission
concurs that the Advisory Board member was absent from two
consecutive Board meetings without a satisfactory excuse and shall
promptly fill the vacant position.

C. If any member of the Advisory Board is absent for more
than one-quarter of the Board's meetings in a given fiscal year,
it shall be deemed that the member has tendered his resignation
from such Advisory Board. The Board of County Commissioners shall
as soon as practicable after such resignation, declare the
position to be vacant and shall promptly act to fill the vacancy.
The Advisory Board member shall not serve at any meetings after
his position has been declared vacant by the Board of County
Commissioners.
D. A member of the Advisory Board shall be deemed absent
from a meeting when he/she is not present during at least 75% of
the meeting.
SECTION SIX. Officers; Quorum; Rules of Procedure.
A. Annually the membership of the Advisory Board shall elect
a chairman and vice chairman from among the members. Officers'
terms shall be for one (1) year with eligibility for re-election.
B. The presence of eight (8) or more members shall
constitute a quorum of the Advisory Board necessary to take actio~
and transact business. In addition, an affirmative vote of eight
(8) or more members shall be necessary in order to take official
action, regardless of whether eight (8) or more members of the
Advisory Board are present at the meeting.
C. The Advisory Board shall, by majority vote of the entire
membership, adopt rules of procedure for the transaction of
business and shall keep a written record of meetings, resolutions,
findings and determinations. Copies of all AdviSory Board
minutes, resolutions, reports, and exhibits shall be submitted to
the Board of County Commissioners.
SECTION SEVEN. .Reimbursement of Expenses.
Members of 'the Advisory Board shall serve without
compensation, but may receive reimbursement for expenses
reasonably incurred in the performance of their duties upon prior
approval of the Board of County Commissioners.

SECTION EIGHT. Functions, Powers and Duties of the Advisory Board.
The functions, powers and duties of the Advisory Board shall
be as follows:
A. To aid and assist the Board of County Commissioners
in carrying out the purposes of Collier County Ordinance No.
96-34. The Advisory Board shall be governed by the "Policy
and Implementation Strategy", attached hereto and
incorporated herein as Exhibit "A", and the "Acquisition
Procedures", and "Land Acquisition/Site Assessment Criteria",
attached he:reto and incorporated herein as Exhibit "B".
B. To prepare and recommend to the County Administrator and
the Board of County Commissioners an itemized budget of the
amount of money required to carry out the plans and
recommendations of acquiring lands for green space as set
forth in Collier County Ordinance No. 96-34 and the projected
revenue to be received within each fiscal year to fund said
acquisition~. In carrying out this responsibility, the
Advisory Board shall, no later than March 1st of each year,
meet with the County Administrator or his Oesignee and
recommend to the County Administrator those properties which
the Advisory Board wishes to see procured during the next
fiscal year. Based upon this information the County
Administrator or hie Designee shall prepare a proposed budget
for the acquisition of green space. This proposed budget
shall then be reviewed by the Advisory Board and upon
approval by the Advisory Board be transmitted through the
County Administrator or his Designee to the Board of County
Commissioners. Should the Advisory Board fail to approve a
budget by March 1st of each year, the County Administrator or
his Designee shall be authorized to submit a proposed budget
to the Board of County Commissioners.
C. The Land Acquisition Advisory Board shall develop an
overall master plan to ensure the most effective and

efficient green space acquisition program to accomplish the
goals and objectives contained herein. The proposed master
plan shall be submitted to the Board of County Commissioners
for review and approval by resolution of the Collier County
Commission. The Board of County Commissioners is authoriz~d
to accept or modify the proposed master plan as deemed
appropriate. The Master Plan shall be reviewed by the Land
Acquisition Advisory Board and the Board of County
Commissioners annually.
D. The Advisory Board may adopt and amend "Guidelines" to
govern their meetings and operations, subject to the approval
of the Board of County Commissioners.
E. The Advisory Board meetings shall be open to the public:.
SECTION NINE. Duties of the county Administrator or his Designee.
The duties of the County Administrator or his Designee sha].l:
A. Administer the activities of the Land Acquisition
Advisory Board in accordance with established policies of the
Board of County Commissioners.
B. Provide periodic written reports to the Board of
County Commissioners on the activities of the Advisory Board
in accordance with established guidelines and policies of the
Advisory Board and the Board of County Commissioners.
C. Assist in the preparation of the annual budget in
accordance with Section Seven, Paragraph B, contained within
this Ordinance.
D. Assure that all reports, studies, plans, etc. are
forwarded to the Board of County Commissioners for review a~nd
coordination of activities, if applicable.
E. Attend all Advisory Board meetings.
SECTION TEN. Review Process.
This Advisory Board shall be reviewed once every four (4)
years commencing in 2000, in accordance with the procedures
contained in Collier County Ordinance No. 86-41, as amended.

SECTION ELEVEN. Sunset (Termination) of this Ordinance.
This Ordinance and any ordinance amending this Ordinance
shall sunset (terminate) and no longer exist after all funds
collected pursuant to Collier County Ordinance No. 96-34 have been
expended for capital expenditures and the purposes set forth in
Collier County Ordinance No. 96-34.
SECTION TWELVE. Conflict and 8everabilit~.
In the event this Ordinance conflicts with any other
ordinance of Collier County or other applicable law, the more
restrictive shall apply. If any phrase or portion of this
ordinance is held invalid or unconstitutional by any court of
competent Jurisdiction, such portion shall be deemed a separate,
distinct and independent provision and such holding shall not
affect the validity of the remaining portion.
SECTION THIRTEEN. Inclusion in the Code of Laws and Ordinances.
The provisions of this Ordinance shall become and be made a
part of the Code of Laws and Ordinances of Collier County,
Florida, if Collier County Ordinance No. 96-34 is approved by the
qualified electors of Collier County voting in a referendum
election to be held on November 5, 1996. The sections of this
Ordinance may be renumbered or relettered to accomplish such, and
the word "ordinance" may be changed to "section", "article", or
any other appropriate word.
SECTION FOURTEEN. Effective Date.
This Ordinance shall become effective upon filing this
Ordinance with the Department of State and only if the qualified
electors of Collier County voting in a referendum election on
November 5, 1996 approve the: aCditional one-half of one percent
Local Government Infrastructure Discretionary Sales Surtax as set
forth in Collier County Ordinance No. 96-34.

Policies:
In implementing this program, a Land Acq,,{~on Advisory Board (LAAB) shall
be appointed to receive iaominations from interested parties ofs~te~ to be considered for
purchase. For consideration by LAAB, evidence must show that the subject parcel
currently for sale or that the owner is willing to receive a~[ evakate an offer. la no case
shall a site be evaluated for potential ac, quisit~on against the wishes of the owner.
The LAAB, in prioritizing parcels for potential puttbase, shall take into
consideration the amount of public green space cun'ently existing in the various urban
areas of Collier County. This evaluation shall be on a per capita basis for both p~'manent
residents and visitors. The results of this analysis shall be used in the prioritization process
to help ensure that the urban areas are approximately equal in tern~ of green space on a
per capita basis.
The LAAB, on an annual basis, ~tll recommend to the Board of Counry
Commissioners CBC C) which of the nomiratecl parcels shoultt be putr. bued. The BCC
may reject the recommended parcels and ask the LAAB to provide new recommendations.

ACQUISITION PROCEDURES
1. Properties/parcels can be nominated oc submi~ed to the Land Acquisition Advisory Board (LAAB) by any citizen of Collier Couaty.
2. Each parcel. is evaluated and ranked according to accepted criteria (see ~nached).
Evaluation will be conducted by County suffaz~d should take no longer than two
staff days.
3. Rankings, narrative descriptions 0ocation, values, restrictions, etc.), an evaluation of
maintenance costs, and spec~c information on the availability of volunteer
management are reported to the LAAB which meets quarterly to conduct business
and review prop,,-rties to be acquiced.
4. The LAAB votes to accept those most highly rmnlted properties which can actually
be purchased within the foRowing fiscal year. All other properties are dropped from
the acquisition li.,~ but evalualion information is retained. Only those properties to
be purchased in the next fiscal year are announced to the public.
5. Those properties previousty nominated must be re-nomkated in foEowing years.
However, previous evaluations can be used in the ranking process unless si~m~iflcant
alteration to nor~tinated properties have occurred.
6. County staff(with volunteers from LAAB and volunteer manaSunent groups) will
prepare ,, more extensive narrative of the features of the identi~ lands along with
a management plan and maintenance estimate for each property.

budget of the Land Acquisition process. Only capital improvements (structures and,
