THE INCLUSION IN THE CODE OF LAWS AND ~
ORDINANCES; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Board of County Commissioners on June 4, 1996
directed the County Attorney to prepare the necessary amendments
to Collier County Ordinance No. 83-55 to permit landscape
improvements and accent lighting within the road rights-of-way
within the Unit and to expand the Municipal Service Taxing Unit to
include certain additional road rights-of-ways.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
SECTION ONE: Amendments to Section Two of Collier County
Ordinance No. 83-55.
Section Two of Collier County Ordinance No. 83-55 is hereby
amended to read as follows:
Section Two: Creation of Golden Gate {~ Beautification
Municipal Service Taxing Unit and Boundaries.
There is hereby created and established the Golden Gate
{~ Beautification Municipal Service Taxing Unit
(hereinafter referred to as the "M.S.T.U."). The boundaries
of the M.S.T.U. are as follows:

Flcrida~ Beginning at the intersection of the North
right-of-way line of Green Boulevard and the East
right-of-way line of County Road 951; thence southerly
along the East right-of-way line of county Road 951 to
the South easement line of the Golden Gate Canal; thence
Westerly along the south easement line. of the Golden
Gate Canal to the west right-of-way of santa Barbara
Boulevard; thence northerly along the west right-of-way
line of Santa Barbara Boulevard to the north
right-of-way line of Green Boulevard; thence easterly

alonq the north right-of-way line of Green Boulevard to
the east right~of-way line of county Road 951 and the
Point of Be~innin~. The M.S.T.U. shall include all
lands located within the above described boundaries and
the M,S.T,U, Shall be bounded on the north bv the north
line of Green Boulevard: bounded on the east by the east
line of County Road No. 951: bounded on the south by the
south line of the Golden Gate Canal: bounded on the west
by the west line of Santa Barbara Boulevard; all within
Collier County. Florida.
SECTION TWO: Amendments to Section Three of Collier County
Ordinance No. 83-55.
Section Three of Collier County Ordinance No. 83-55 is hereby
amended to read as follows:
Section Three: Purposes and Governing Body.
The M.S.T.U. is created for the purpose of providing
general landscape improvements within the road right-of-way
such as; curbing, watering facilities, planrings, accent
li~htin~ and maintenance for that portion of Ccldcn Catc

Boulevard, county Road 951. Green Boulevard. Tropicaria
Boulevard, Sunshine BoUlevard. Hunter Boulevard, Coronado

boundaries o~ the Goldep Gate Beautlfication Municipal
Serv,Ce Taxing Unit.
The governing body uf the M.S.T.U. shall be the Board of
County Commissioners of Collier County, Florida.
SECTION THREE: Amendments to Section Six of Collier County
Ordinance No. 83-55.
Section Six of Collier County Ordinance No. 83-55 is hereby
amended to read as follows:
Section Six: Millage Referendum.
A referendum of the qualified electors residing in the
M.S.T.U. is by concurrent resolution called to be held on
March 13, 1984 to determine whether or not an M.S.T.U. tax
millage not to exceed one/half (1/2) mill shall be levied to
provide curbing, watering facilities, planrings, accent
liuhtin~ and maintenance for that portion of Golden Gate

Parkway lying between Santa Barbara Boulevard and State Road
951.
SECTION FOUR: Conflict and Severabil~ty.
In the event this Ordinance conflicts with any other
ordinance of Collier County or other applicable law, the more
restrictive shall apply. If any phrase or portion of this
Ordinance is held invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed a separate,
distinct and independent provision and such holding shall not
affect the validity of the remaining portion.
SECTION FIVE: Inclusion in the Code of Laws and Ordinances
The provisions of this Ordinance shall become and be made a
part of the Code of Laws an~ Ordinances of Collier County,
Florida. The sections of the Ordinance may be tenumbered or
relettered to accomplish such, and the word "ordinance" may be
changed to "section", "article", or any other appropriate word.
SECTION SIX: Effective Date.
This Ordinance shall become effective upon filing this
Ordinance with the Department of State.
