Ordinance 96-10 ORDINANCE NO. 96-10 AN ORDINANCE AME~DING COLLIER COUNTY ORDINANCE NO. 91-10, AS AMENDED BY ORDINANCE NO. 93-13, THE COLLIER COUNTY PRODUCTIVITY COMMITTEE; AMENDING SECTION TWO, APPOINTMENT AND COMPOSI- TION, TO PROVIDE FOR THE APPOINTMENT OF THE VICE CHAIRMAN OF THE BOARD OF COUNTY COMMIS- SIONERS IN ITS MEMBERSHIP AND TO FURTHER PROVIDE FOR THE APPOINTMENT OF A LIMITED NUMBER OF HIGH RANKING GOVERNMENT EMPLOYEES TO SERVE ON THE COMMITTEE; AMENDING SECTION THREE, TERMS OF OFFICE, TO ESTABLISH A TERM OF OFFICE FOR THE VICE CHAIRMAN OF THE BOARD OF COUNTY COMMISSIONERS; AMENDING SECTION SEVEN, FUNCTIONS, POWERS, AND DUTIES OF THE COM~.ITTEE, TO FURTHER SPECIFY THE POWERS 0F THE COMMITTEE; PROVIDING FOR CONFLICT A~D SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE OF LAWS AND ORDINANCES; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Board of County Commissioners of Collier County adopted Collier County Lrdinance No. 91-10, as amended by Ordinance No. 93-13, creating a County Government Productivity Committee for the purpose of reviewing the efficiency of departments of county government under the jurisdiction of the Board of County Commissioners; and WHEREAS, on October 31, 1995, the Committee presented to the Board of County Commissioners an update on the activities of the Committee and identified issues which the Committee would like to review; and W~EREAS, at the October 31, 1995 workshop, the Board of County Commissioners directed the County Government Productivity Committee to report back to the Board with specific recommenda- tions for changes to its enabling ordinance; and WHEREAS, on November 14, 1995, the Committee presented to the Board its recommendations for amendments to Ordinance No. 91-10, as amended; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that Collier County Ordinance No. 91-10, as amended, is hereby amended to read as follows: - 1 - Words Underlined are added; Words Struc:~ Throug~ are deleted. SECTION ONE: Amendments to Section Two of Collier County Ordinance No. 91-10, as amended: Section Two of Collier County Ordinance 91-10, as amended, Is hereby amended to read as follows: SECTION TWO. Appointment and Composition. A. The Committee shall be composed of thirteen (13) members, one of whom sba~l be the vice chairman of the Board o[ County Commissi0De~$ Or his;her Board des~gnee. The ~ema~ninG twelve members '~hich are appointed by resolution of the Board of County Commissioners. They shall DOSSeSS ~Decial expertise and experience related to managing large organizations. but the membership shall be balanced in reDreseDtin~ views of the community. Further. the Committee may include count~ _~/ld/or city Governmental employees apDroved bv the Countv Manager or City Manager. respectively. but Shall not exceed four ~4] members. as well as members of the Drivat~ sector. B. Members of the Committee shall be appointed by and serve at the pleasure of the Board of County Commissioners. Said members shall be permanent residents and electors of Collier County. C. Appointment of members to the Committee shall be by resolution of the Board of County Commissioners, which resolution shall set forth the date of appointment and the term of office. SECTION TWO: Amendments to Section Three of Collier County Ordinance No. 91-10, as amended. Section Three of Collier County Ordinance 91-10, as amended, is hereby amended to read as follows: SECTION THREE. Terms of Office. The initial terms of office of the Committee members shall be as follows: A. Five (5) members shall serve for one (1) year. B. Six (6) members shall serve for two (2) years. C. Thereafter, each appointment or re-appointment shall be for a term of two (2) years. A member of the Committee may be re-appointed by the Board of County Commissioners for one (1) successive term. However, other qualified applicants may be considered for any vacancy. Appointments to fill any vacancies on the Committee shall be for the remainder of the unexpired term of office. D, Purina his/her term of office as vice chairman of the Board of county Commissioners. the vice chairman. or his/her 'Board desianee, shall serve on. the County Government Produc~ivity Committee. After expiration of his/her term as vice chairman. the SuCceeding vice chairman Shall ~omaticallv become a member of the Committee. SECTION THREE: Amendments to Section Seven of Collier County Ordinance No. 91-10, as amended. Section Seven of Collier County Ordinance 91-10, as amended, is hereby amended to read as follows: SECTION SEVEN. Functions, Powers and Duties of the Committee. The functions, powers and duties of the Committee shall be as follows: A. The Committee shall evaluate departments of county government under the jurisdiction of the Board of County e~ommissioners and determine if the departments are operating at appropriate levels of efficiency. The objective is to ensure the County's taxpayers that their tax dollars are being used in an appropriate manner and the the Board of County Commissioners is taking all reasonable steps to avoid waste of tax dollars. w~thout limitina the aeneralitv of the foreaoina. the Committee may analyze and review existina ~tructure, organization, staffing, manageRent, functiOnS, business practices, and procedures of any or all Darts of County government and make recommendations for increased efficiency and cost-effectiveness and to assist in - 3 - Words Underlined are added; Words Struck Thrcu,~ are deleted. imPlementatiop of those recommendations. If so requested by a constitutional officer, the Committee may perform similar functions for that office~, B. Each member of the Committee may be assigned a department or group of departments to review. C. The Committee or each member thereof shall prepare a report of findings and recommendations to be submitted directly to the Board of County Commissioners at the last Commission meeting prior to June 1 of each year; provided, however,' that such report and recommendations shall be submitted to the County Manager's Office by May 1 of each year to provide an opportunity for Staff review. D. The Committee may adopt and amend "Guidelines" to govern their operatioD~ subject to approval by the Board of County Commissioners. E. The Committee meetings shall be open to the public. SECTION FOUR: Conflict and Severability. In the event this Ordinance conflicts with any other ordinance of collier county or other applicable law, the more restrictive shall apply. If any phrase or portion of this Ordinance is held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portion. SECTION FIVE: Inclusion in the Code of Laws and Ordinances. The provisions of this Ordinance shall become and be made a part of the Code Of Laws And Ordinances of Collier County, Florida. The sections of the Ordinance may be renumbered or relettered to accomplish such, and the word "ordinance" may be changed to "section", "article", or any other appropriate word. SECTION SIX: Effective Date. This Ordinance shall become effective upon filing with the Department of State. - 4 - Words Underlined are added; Words Struck ~ ..... ~ are deleted.
