AN ORDINANCE AMENDING ORDINANCE NUMBER
91-102, THE COLLIER COUNTY LAND DEVELOPMENT
CODE WHICH ESTABLISHED THE COMPREHENSIVE
ZONING REGULATIONS FOR THE UNINCORPORATED
AREA OF COLLIER COUNTY, FLORIDA, BY
AMENDING THE OFFICIAL ZONING ATLAS MAP
NUMBER 9535N BY CHANGING THE ZONING
CLASSIFICATION OF THE HEREIN DESCRIBED
PROPERTY LOCATED IN COLLIER PARK OF
COMMERCE (EAST NAPLES INDUSTRIAL PARK) AT
THE NORTHWEST CORNER OF SOUTH HORSESHOE
DRIVE AND AIRPORT-PULLING ROAD (C.R. 31) IN
SECTION 35, TOWNSHIP 49 SOUTH, RANGE 25
EAST, COLLIER COUNTY, FLORIDA, FROM "I" TO
"C-5" AS HEREIN MODIFIED; PROVIDING FOR
STAFF AND PLANNING COMMISSION STIPULATIONS;
AND BY PROVIDING AN EFFECTIVE DATE.
WHEREAS, Dominick J. Amico, Jr., P.E., representing 3227
South Horseshoe Limited, petitioned the Board of County
Commissioners to change the zoning classification of the herein
described real property;
NOW, THEREFDRE BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA:
SECTION ONE:
The zoning classification of the real property as more
particularly described by Exhibit "A", attached hereto and
incorporated by reference herein, and located in Section 35,
Township 49 South, Range 25 East, Collier County, Florida, is
changed from "I" to "C-5" as herein modified and the Official
Zoning Atlas Map Number 9535N, as described in Ordinance
91-102, the Collier County Land Development Code is hereby
amended accordingly. The herein described real property,
Exhibit "A" attached hereto and incorporated by reference
herein, is the same for which the fezone is hereby approved
subject to the following conditions:
The following uses, as identified within the Standard
Industrial Classification Manual (1987), or as otherwise
provided for within the C-5 Zoning District, are permitted
as a right, or as uses accessory to permitted uses in this
Section.
1. Permitted Uses
a. Unless otherwise provided for, permitted uses
shall include all of those uses permitted in the
C-5 Zoning District at Section 2.2.15 ~.2.1 of
the Collier County Land Development Code with
the exception of those major groups listed under
Division G, Retail Trade of the SIC Manual
(1987) save for Group 5812 Eating Places.
2. No ingress or egress from Airport Road is allowed.
3. All other applicable provisions of the Collier County
Land Development Code shall apply.
SECTION TWO:
This Ordinance shall become effective upon filing with the
Department of State.
PASSED AND DULY ADOPTED by the Board of County
