PROVIDING FOR SEVERABILITY; AND BY PROVIDING AN :: ; .... r-- EFFECTIVE DATE. :~, WHEREAS, the Board of County Commissioners adopted the Collier County Growth'*' I~anagement Plan on January 10, 1989; and WHEREAS, Collier County has held public headngs to provide for and encourage public partialpatton throughout the 1996-97 plan amendment process; and WHEREAS, Collier County did submit the 1996-97 Growth Management Plan Amendments to the Department of Community Affairs for preliminary review on Apdl 29, 1997; and WHEREAS, the Depadment of Community Affairs did review and make wdtten objections to Recreation/Open Space Element Amendments to the Growth Management Plan and transmitted the same in writing to Collier County within the ume provided by law; and WHEREAS, Collier County has 120 days from receipt of the wdtten objections from the Department of Community Affairs to adopt, adopt with changes or not adopt the proposed Recreation/Open Space Element Amendments to the Growth Management Plan; and WHEREAS, the Board of County Commissioners of Collier County did take action in the manner prescribed by law and did hold public hearings concerning the adoption of the Recreation/Open Space Element Amendments to the Growth Management Plan on October 28, 1997; and WHEREAS, all applicable substantive and procedural requirements of law have been met; and NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: ~ECZJD_t2L~,b~: ADOPTION OF AMENDMENTS TO THE RECREATION/OPEN SPACE ELEMENT OF THE GROWTH MANAGEMENT PLAN. This Ordinance as described herein, shall be known as the Recreation/Open Space Element Amendments to the Growth Management Plan for Collier County, Florida. The Collier County Growth Management Plan Recreation/Open Space Element Amendment is attached hereto as Exhibit A and incorporated herein by reference. ~GTLLQ2LJ'D~/J2: SEVERABILITY. O If any phrase or portion of this Ordinance is held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion. 1 ~,.Z.LOjJ_TJJ~: EFFECTIVE DATE. The effective date of this Amendment to the Recreation/Open Space Element shall be the date a final order is Issued by the Depadment o1' Community Affairs or Administration Commission finding the Element In compliance in accordance with Section 163.3184, Florida Statutes, whichever occurs earlier. No development orders, development permits. or land uses dependent on this Element may be issued or commence before It has become effective. If a final order of ncompllance Is Issued by the Administration Commission, this amendment may nevertheless be t~m:de effective by adoption of a Resolution affirrnlng its effective status, a copy of which Resolution shall be sent to the Department of Community Affairs. OBJECTIVE 1.1: Continue to Eensure that a comprehensive system of parks and recreation facilities is available from among facilities provided by the County, other govemmental bodies and the pdvate sector: , . Policy 1.1.1: The following level of sen,dce standards for facilities and land owned by the County or available to the general public are adopted: STANDARD OF SERVICE: A. 1.2882 acres of community park land/1000 population B. 2.9412 acres of regional park land/1000 population C. Recreation facilities. Facilities in place which have a value (as (X) defined) of at least-$468-:O0 $179.00 per capita of population. A Construction Cost Index (CCI) adjustment will be used to determine the construction cost of fadlities planned. The CCI that will be used will be the pdor year of the County's fiscal year budget. 1. Value will be arrived at using the per unit values for each facility type available in the County as set forth in Table A applying the values to the number of each facility type, adding up all values and dividing the total by the County population. 2. VVhere recreation facilities provided by other governmental bodies or the pdvate sector are available through arrangement with the County to the public on a convenient basis, they shall be considered in measuring in place facility value. Policy 1.1.2: Encourage the continuation and expanded use of public school and other public and pdvate radiities by the general public to maximize the benefit from available facilities. Policy 1.1.3: Ensure that economically disadvantaged individuals will not be restricted from any participation due to financial hardships. Policy 1.1.4 Acquire suitable lands for new park sites in areas where major population growth is expected.
