OF THE BOARD OF COUNTY COHMISSIONERS
LET IT BE REHEHBERED, that the Board of County Commissioners in
and for the County of Collier, and also acting as the Board of Zoning
Appeals and as the governing board(s) of such special districts as
have been created according to law and having conducted business
herein, met on this date at 5:13 p.m. in SPECIAL SESSION in Building
"F" of the Government Complex, East Naples, Florida, with the following
members present:

ORDINANCE 94-71 AMENDING COLLIER COUNTY ORDINANCE NO. 91-24 BY
EXTENDING THE MORATORIUM PROHIBITING THE INSTALLATION OF DRAINAGE
CULVERTS INCLUDING PIPES OR OTHER APPURTENANCES WITHIN THE SWALES IN
THE PUBLIC RIGHT-OF-WAY OF THE AREA GENERALLY KNOWN AS NAPLES PARK
UNTIL DECEMBER 31, 1995 - ADOPTED
CHAIRMAN CONSTANTINE: Hi. Welcome to the BCC workshop. Oh, no,
it's not a workshop. We can't have public input or vote on anything in
a workshop. Evening public meeting Wednesday December 21. Mr. Boldt,
how are you?
MR. BOLDT: Very good, thank you. Just a reminder why we're
having this meeting, ordinances of this nature require two public
evenings -- two evening meetings open to the public otherwise we would
incorporate this in your daytime. We wouldn't have bothered you.
We're here as a result of the action you took yesterday, Naples Park
regarding the Drake project.
CHAIRMAN CONSTANTINE: Mr. Boldt, it's no bother. We're happy to
be here.
MR. BOLDT: Very good.
COHMISSIONER HAC'KIE: Speak for yourself.
MR. BOLDT: Just very simply based on the action two weeks ago
when we had this public hearing in the evening and the action yesterday
it's my recommendation that you extend the moratorium prohibiting the
closure of swales in Naples Park for one additional year to December
31st of 1995. Is there any questions regarding that? CHAIRMAN CONSTANTINE: Questions regarding that?
COHMISSIONER HANCOCK: One quick one. When will this no longer be
necessary? When can we give them the green light?
MR. BOLDT: Actually if we go ahead and install the project as
it's presently designed, this will become a permanent prohibition
against closure of the swales. Right now it's temporary because we
haven't changed the physical locations out there.
COHMISSIONER HANCOCK: So should we complete the improvements on
eighty -- 91st and 92nd, once that's complete then this becomes a
permanent moratorium. The folks will not ever be allowed to enclose
the swales?
MR. BOLDT: That's correct.
CHAIRMAN CONSTANTINE: Do we have any public speakers, Mr. Cuyler?
MR. CUYLER: I have no one registered. I think the public was
pleased with the board's action the other day.
CHAIRMAN CONSTANTINE: Seeing none, we'll close the public hearing
and entertain a motion.
COHMISSIONER NORRIS: Mr. Chairman, I would like to make a motion
that we adopt ordinance 91-24.
MR. CUYLER: That should be an amendment --
COHMISSIONER NORRIS: Amendment to that ordinance.
MR. CUYLER: -- extending that moratorium.
COHMISSIONER NORRIS: I will make a motion that we adopt an
amendment amending ordinance number 91-24.
CHAIRMAN CONSTANTINE: Is there a second for the motion?
COHMISSIONER HAC'KIE: Second.
CHAIRMAN CONSTANTINE: There is a motion from Commissioner Norris,
second from Commissioner Hac'Kie to adopt an ordinance amending Collier
County Ordinance number 91-24.
All those in favor of the motion please state aye.
Anyone opposed?
Motion carries 4-0, Commissioner Matthews absent.
Any other business?
MR. CUYLER: No further business from staff.
CHAIRMAN CONSTANTINE: Merry Christmas to all and to all a good
night.
MR. CUYLER: Thank you.
There being no further business for the Good of the County, the
meeting was adjourned by Order of the Chair at 5:16 p.m.
