RESOLUTION AUTHORIZING IMPLEMENTATION OF A SCHOOL
ZOl\fE SPEED LIMIT REDUCTION TO 20 MPH DURING SCHOOL
ARRlV AL AND DISMISSAL HOURS AS INDICA TED BY
FLASHING BEACONS ON WESTBOUND LEL Y CULTURAL

WHEREAS, Chapter 316, Florida Statutes, permits the Board of County
Commissionc~rs (BCC) to alter established speed limits on roads under its jurisdiction; and
Wlll~REAS, Lely Cultural Drive adjacent to Lely Elementary School falls under
the jurisdiction of the BCC and has a normal speed limit in excess of twenty miles per hour
(20 mph); and
WHEREAS, in accordance with Florida Statute ~ ~ 3 16.189 and 316.1895, the
BCC may alter existing speed limits within school zones as may be appropriate upon the
basis of an engineering and traffic investigation; and
WHE,REAS, in accordance with Florida Statute ~ 316.1895, a school zone speed
limit "may be in force only during those times thirty (30) minutes before, during, and thirty
(30) minutes after the periods of time when pupils are arriving at a regularly scheduled
breakfast program or a scheduled school session and leaving a regularly scheduled school
session;" and
WHEREAS, the results of the County's engineering traffic investigation indicate
that a reduction of the existing school zone speed limits to twenty miles per hour (20 mph)
is reasonable and safer under the conditions found to exist during the times that students
are traveling to and from the schools served by the subject school zones.
NOW, THERFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA THAT:
1. Thl;lre is hereby established a twenty miles per hour (20 mph) school zone speed
limit on Lely Cultural Drive during school arrival and dismissal hours at Lely Elementary
School and that the County Manager or his designee direct the Collier County Traffic
Operations Dc~partment to maintain appropriate school zone speed limit signs at that
location, including installing flashing beacons to inform motorists of the school zone and
school zone speed limit in effect when beacons are flashing.
2. A I;;OPY of this Resolution shall be forwarded to the Collier County Sheriffs
Office for proper enforcement of the established school zone speed limit of twenty miles
per hour (20 mph) at the specified location.
3. The;: effective date of the reduced school zone speed limit shall be after written
notification to the Sheriff's Office and upon posting of appropriate signage.
