RESOLUTION NO. 95- 591
RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS, COLLIER COUNTY, FLORIDA,
AUTHORIZING WAIVER OF LIBRARY SYSTEM IMPACT
FEES, PARKS AND RECREATIONAL FACILITIES IMPACT
FEES, ROAD IMPACT FEES, EMERGENCY MEDICAL
SERVICES SYSTEM IMPACT FEES AND EDUCATIONAL
FACILITIES SYSTEM IMPACT FEES FOR ONE HOUSE TO
BE CONSTRUCTED BY CLIFFORD W. CONNELLY AT
4381 8th AVENUE S. E. IN COLLIER COUNTY,
FLORIDA.
WHEREAS, Col:.ier County has recognized and attempted to
address the lack oE adequate and affordable housing fur moderate,
low, and very-low income households in the County and the need
for creative and innovative programs to assist in the provision
of such housing by including several provisions in the Collier
County Growth Management Plan, iT :::luding: objective 1. 4, policy
1.4.1; objective 1.5, policy 1.5.~, policy 1.5.3, p 'licy 1.5.4,
policy 1.5.5, rolicy 1.5.6; <bjective 1.6, po.icy 1.6.3;
objective 2.1, policy 2.1.1, polj:y 2.1.2, policy 2 1.3, policy
,,2.1.5, and policy 2.1.6 of the Housing Element; and
WHEREAS, Collier County has received funding pursuant to the
'state Housing Initiatives Partnership Program SIt forth in
Section 420.907 et. seq., Flori( a Statutes and Ch.lpter 9I-37,
Florida Administrative Code; and

WHEREAS, Clifford W. Connol ' is seeking a wai"er of impact
fees; and
" , WHEREAS, Clifford W. ConnCL ly will construct a three (3)
bedroom unit (the "Dwelling Unit") at 4381 8th A"enue S. E.,
Collier County, Fj.orida, which is proposed to sell f,Jr Eighty-Two
, Thousand Dollars ($82,000.00); ar.,l
'~ WHEREAS, the Dwelling Unit will be owned by a very low
income household, ~nd
WHEREAS, Clifford W. Connolly submitted to the Office of
the Housing and Urban Improvement Department an Affordable
Housing Application dated August 14, 1995 for a waiver of impact
fees for the construction of a house at 4381 8th Avenue S. E.,
Collier County, Florida, a copy of ,said application is on file in
the Housing and Urban Improvement Department; and
WHEREAS, in accordance with Section 3.04 of the Library
System Impact Fee Ordinance, Ordinance No. 88-97, as amended;
section 4.05 of the Parks and Recreational Facilities Impact Fee
Ordinance, Ordina~ce No. 88-96, as amended; Section 3.04 of the
Road Impact Fee Ordinance, Ordinance No. 92-22, as amended;
Section 3.05 of the Emergency MEldical Services System Impact Fee
Ordinance, Ordinalce No. 91-71, ~s amended; and Section 3.05 of
the Educational Facilities System Impact Fee Ordinarue, Ordinance
No. 92-33, as amended; an applica:'t may obtain a wai"er of impact
fees by qualifying for a waiver; und
WHEREAS, Clifford W. Connolly has qualified f"r an impact
fee waiver based upon the following representations made by
Clifford w. Connolly:
A. The Dwelling Unit shal] be owned by a fi~st-time home
buyer.
B. The Dwelling Unit shal~ be owned by a hou~ehold with a
very low income level 1S that term is defined in the
Appendices to the respective Impact Fee Ordinances and
the monthly payment to purchase the unit ml'st be within
the affordable housing guidelines establIshed in the
Appendic~s to the respE tive Impact Fee Or.inances.
C. The Dwelling Unit. shall be the Homestead 0:, the owner.
D. The Dwelling Unit shall remain affordable for fifteen
(15) years from the date the certificate of occupancy
is iSSUEr}.
WHEREAS, Clifford W. Connell '! has requested that the County
subordinate its rights, interest and lien to Ownlr's primary
lender.

WHEREAS, Owner has provided sufficient documentation that it
requires a subordination of the County's impact fees to Owner's
primary lender.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
1. The Board of County Commissioners hereby authorizes the
County Manager to issue an Authorization for waiver of
impact fees to Clifford W. Connolly for one (1) house
which shall be constructed at 4381 8th Avenue S. E.,
Collier County, Florida.
2. Upon receipt by the Housing and Urban Development
Directo: of an agreement for waiver signed by Clifford
W. Connolly, or other documentation acceptable to the
County Attorney, the 30ard of County (:ommissioners
hereby authorizes the Flyment by Collier County of the
following impact fees fom the Affordable lousing Trust
Fund, Fund (191) I in tr~ following amounts for the one
(1) house to be built a\~ 4381 8th Avenue S. E., CO,llier
County, Florida by Clifford W. Connolly:

The paym-mt of impact ff,es by Collier County is subject
to the execution and recordation of an Affordable
Housing Agreement for p~yment of Collier County Impact
Fees between the property owner and/or purchaser and
the County.
