RESOLU~ION NO. 95-~
RELATING TO PETITION NUMBER V-95-16, FOR
A VARIANCE ON PROPERTY HEREINAFTER
DESCRIBED IN COLLIER COUNTY, FLORIDA.
WHEREAS, the Legislature of the State of Florida in Chapter 125,
Florida Statutes, has conferred on all counties in Florida the power to
establish, coordinate and enforce zoning and such business regulations
as are necessary for the protection of the publici and
WHEREAS, the County pursuant thereto has adopted a Land
Development Code (Ordinance No. 91-102) which establishes regulations
for the zoning of ~articular geographic divisions of the County, among
which is the granting of variances; and
WHEREAS, the Roard of Zoning Appeals, being the duly elected
constituted Board ,)f the area herey affected, has he:~d a public
hearing after notice as in said re'[ulations made and j.rovided, and has
considered the ad'isability of a 2 L-foot variance fro: I the required
front setback of 45 feet to 24 fee', as shown on the a .~tached plot plan,
Exhibit "A", in a "PUD" zone for the property hereinafter described,
and has found as a matter of fact that satisfactory provision and
arrangement have been made concerning all applicable ,1atters required
by said regulations and in accord" Ice with Section 2.....5 of the Zoning

of Collier CountYi and
WHEREAS, all interested parties have been given opportunity to be
heard by this Board in public meet ing assembled, and t;he Board having
considered all matters presented;
NOW THEREFORE BE IT RESOLVED 3Y THE BOARD OF ZO~rNG APPEALS of
Collier County, Florida, that:

Consultants, Inc., representing Hideaway Beach Assocjation, with
respect to the pr..'perty hereinafter described as:
Golf Course a:~ Recreational fract, Hideaway Beach Golf
Course Addition, as recorded in Plat Book 13, Pages 59-60, of
the Public Records of Colliel County, Florida.

required front setback of 45 feet to 24 feet as shown on the attached
plot plan, Exhibit "A", of the "PUD" zoning district wherein said
property is located, subject to the following conditions:
1. The site development plans shall include a site clearing
plan which clearly depicts the oak trees to be removed and
those to be retained. The trees being retained shall be
structurally barricaded until construction is completed.
2. A historic and archaeological survey and assessment ,
conducted by a certified archaeologist or a waiver thereof
will be required prior to site development plan approval.
BE IT RESOLVED that this Resolution relating to Petition Number
V-95-16 be recordec' in the minutes of this Board.
