RELATING TO PETITION NO. CU-94-7 FOR
EXTENSION OF CONDITIONAL USE OF PROPERTY
HEREINAFTER DESCRIBED IN COLLIER COUNTY,
FLORIDA
WHEREAS, the Legislature of the State of Florida in Chapter 125,

Florida statutes, has conferred on all Counties in Florida the power to
establish, coordirate and enforce zoning and such business regulations
as are necessary tor the protection of the public; an,i
WHEREAS, the County pursuant thereto has adopted a Land
Development Code (Ordinance No. 91-102) which establi~hes comprehensive
zoning regulations for the zoning "f partiCUlar divislons of the
County, among which is the grantirq and extending the time period of
Conditional Uses; and
WHEREAS, on September 27, 1994, the Board of zoning Appeals
enacted Resolution No. 94-710, which granted a condit.ional use pursuant
to Ordinance No. 91-102, for cluster housing, on the ~elow described
property; and
WHEREAS, Subsection 2.7.4.5 'f the Land Developl,mt Code provides
that the Board of :~oning Appeals 1 lY extend the one (1) year time
period for a conditional use which has not been commenced;
NOW, THEREFORE BE IT RESOLVED, by the Board of : ,:ming Appeals of
Collier County, Florida that:
The written request of David 3. wilkison of Wil~ison and
Associates, Inc., l:epresentinq Ja' 9S P. Lennane for, :le first of three
(3) permitted one (1) year extens..~ns, in interest of the following
described property:

is hereby approved pursuant to Suhsection 2.7.4.5 of the Land
Development Code (Ordinance No. 91-102), and the expj:ation date for
Resolution Iro. 94-710, attached hereto and incorporatad herein as
Exhibit "B", and all conditions applicable thereto, i~ extended hereby
for one year until september 27, 1996.
