RESOLUTION NO., 95- 640
RELATING TO PETITION NUMBER V-95-2, FOR A
VARIANCE ON PROPERTY HEREINAFTER
DESCRIBED IN COLLIER COUNTY, FLORIDA.
WHEREAS, the Legislature of the State of Florida in Chapter 125,
Florida Statutes, has conferred on all counties in Florida the power to
establish, coordinate and enforce zoning and such business regulations
as are necessary for the protection of the public; and
WHEREAS, the County pursuant thereto has adopted a Land
Development Code (Ordinance No. 91-102) which establishes regulations
for the zoning of ~articular geographic divisions of the County, among
which is the granting of variances; and
WHEREAS, the ~oard of Zoning Appeals, being the duly elected
constituted Board "f the area here'Y affected, has he::'d a public
hearing after notice as in said re~rulations made and j.lrovided, and has
considered the advisability of a . 38-acre variance fr:~ the required
2-acre requirement for the Golden ;ate Parkway Profes'.lional Office
Commercial District to 1.12 acres as shown on the attached plot plan,
Exhibit "A", in an RMF-12 zone for the property hereinafter described,
and has found as a matter of fact that satisfactory p~ovision and
arrangement have been made concerr ~ng all applicable Matters required
by said regulations and in accord, .1ce with the Land UF.'Ie Designation
Description Sectior: of the Golden ;ate Master Plan Element of Collier
County's Growth Management Plan and criteria set forth in the Golden
Gate Parkway Professional Office Commercial District of said Element
and in accordance with Section 2.7.5 of the Zoning Re'1Ulations of said
Land Development Code for the un!. ;orporated area of i::ollier County;
and
WHEREAS, all interested part: as have been given opportunity to be
heard by this Board in public meeting assembled, and the Board having
