RESOLUTION NO. 95-~
RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY
DETERMINING THAT REVISIONS TO THE
VINEYARDS DEVELOPMENT ORDER 85-2, AS
AMENDED, DOES NOT CONSTITUTE A
SUBSTANTIAL DEVIATION REQUIRING FURTHER
DEVELOPMENT OF REGIONAL IMPACT REVIEW.
WHEREAS, the ~oard of county Commissioners of Collier County,
Florida, approved Develop~ent Order 85-2 (the Development Order) on
May 7, 1985, which approved a Development of Regional Impact (DRI)
known as Vineyards; and
WHEREAS, saie Development Ord'~r 85-2 was previously amended by
Development Order 90-6, approved t . the Collier Count' Board of County
Commissioners on October 23, 1990; and amended by Devllopment Order
91-6, approved by the Collier Coun~y Board ot County '~ommissioners on
August 13, 1991; and
WHEREAS, section 380.06(19) (f)2, Florida Statutes. requires that
proposed changes to a previously approved Development of Regional
Impact (DRI) be submitted by the d'~veloper to the local government, the
~egional planning council, and th( state land planning agency; and
WHEREAS, submittal of the pr( Josed changes was Dclde to the
appropriate public authorities; ar
WHEREAS, section 380.06(19) (f)5, Florida Statutes, requires that
the local government shall determine whether or not Vle proposed change
to the previously approved DRI development order cons1:itutes a
substantial deviat.1.on requir ing f' :-ther Development-c ~-Regional-Impact
review; and
WHEREAS, the Board of county :ommissioners of Collier County has
reviewed and considered the report and recommendation;l ot the Southwest
Florida Regional P'l anning council (SWFRPC) and on sep::ember 15, 1995
held a public hear~ng on the petit ion; and
WHEREAS, by separate action the Board of County Commissioners will
cause Vineyards PUD Development Order to be amended to reflect the
proposed revisions which do not constitute a substantial deviation
requiring further Development-of-Regional-Impact review;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS
OF COLLIER COUNTY, FLORIDA THAT:
The proposed revisions to Vineyards Development Order 85-2,
as amended, descr,~ bed in Petition OOA-95-3, noted as Exhibit "A"
and hereto made a part of this Resolution do not constitute a
substantial devia".ion requiring further Development of Regional
Impact review.
BE IT FURTHE:. RESOLVED that ~ his Resolution be recorded in the
minutes of this Board.
