WHEREAS,::ollier County has recognized ancl attempted to address the lack of adequate and affordable housing for moderate, low, and very-low income hOUSE holds in the County and the need for creative a~d innovative plJgrams to assist i I the provision of such housir':1 by including ;everal provisions in the Collier $'J~.~ /'"~ County Growth ~anagement Plan, including: object ve 1.4, policy 1.4.1; objective 1.5, policy 1.5.2, policy 1.5.3, policy 1.5.4, policy 1. 5.5, policy 1. 5.6; obj ecti va 1. 6, policy 1. 6.3; objective 2.1, policy 2.1.1, policy 2.1.2, polici' 2.1.3, policy 2.1.5, and policy 2.1.6 of the lous ing Element; arl' I WHEREAS, Collier County hi'; received funding ;Jursuant to the State Housing Initiatives Pc ;tnership Program set forth in Section 420.907 et. seq., Florida statutes and Chapter 91-37, Florida Administrative Code; and WHEREAS, in accordance w L th Collier County Ordinance No. 93-19, the County is authoriz d to use funding from the State Housing Initiat...ves Partnersh.) (SHIP] Program 'or waivers of Collier County impact fees; an, WHEREAS, Immokalee Habitat for Humanity, Inc. is seeking a waiver of impact fees; and WHEREAS, Inmokalee Habitat for Humanity, Inc. will construct one (1) three-bedroom unit (.:he "Dwelling Unit") on Lot 1, Highlands Habitat SUbdivision, Immokaleo which 1 s proposed to sell for Forty-Six Thousand Five Hundred Dollarr ($46,500.00); and WHEREAS, t e Dwelling Uni\ will be purchased by a very low income household which is req tired to invest a m tnimum of five nrn ......,'"l.. ... '-I I '- 1;;;l;;':.J hundred (500) hours of "Sweat Equity" before it obtains title to the house; and WHEREAS, Mr. Charles C. Smith, Vice President of Immokalee Habitat for Humanity, Inc., submitted to the Office of Housing and Urban Improvement an Affordable Housing hpplication dated August 23, 199: for a waiver of impact f(~es for the construction of a house on ;,ot 1, Highlands Habitat SUbdivision, Immokalee, a copy of said i. pplication is on file in the Housing and Urban r f ! ,. I. t Improvement Derartment; and WHEREAS, in accordance ". The Dwelling Unit sh II be sold to a household with a very low income level as that term is defined in the Appenl, ices to the respective Inpact Fee Ordinances and the m'nthly payment to purchase the unit must be within the affordable housing guidelines estahlished in the Appendices to the respective Impact Fee IJrdinances. C. The Dwelling Unit shall be the Homestead of the owner. D. The Dwelling Unit sh.'\ll remain affordable for fifteen (15) 'ears from the ,late the certificat-e of occupancy is ist;ued. The Board of County Commissionars hereby authorizes the County Manager to issue an Authorization for waiver of impact fees to Immokalee Habit::\t for Hun.anity, Inc. for one (1) house which shall b(~ constructed on Lot 1, High~ ands Habitat Subdivision, Immokalec, ColI ier Coun~y, Florida. 2. Upon receipt by the Housinc;r and Urban Development Dire~tor of an agrE ement for waiver of impact fees sign.-d by Immokaleelabi tat for Humanit., , Inc., and/or the )urchaser, or otl,er documentation a(ceptable to the County Attorney, tt 1 Board of Coun~ Commissioners hereby authorizes the payment by Collier County of the following impact fees from the Affordable Housing Trust Fund, Fund (191), in the following amo\~ts for the one (1) house to be b\ llt on Lot 1, Hi('hlands Habitat Subdivision, Immok, Lee by Immokalet' Habitat for Human,;ty, Inc.: 3.
